GOVERNMENT RELATIONS BULLETIN September 2, 2015 GRB 15-008 Contact: Kathy Van Kleeck Summary of State Laws Governing Mopeds September 2015 This chart summarizes the laws governing "limited displacement/speed" motor-driven cycles that are legally classified as mopeds (or motorized s). Reprinted directly from the statute, each vehicle definition clarifies the state's use of the term "moped." All types of limited displacement cycles are not always included in a state's definition of moped. Some states may make other special provisions in law for these cycles, otherwise they are treated the same as motorcycles or larger displacement motor-driven cycles. One state Alabama - does not govern mopeds separately. In Alabama, a moped falls the category of motor-driven cycle and is regulated as such. (Although Alaska, Connecticut, Indiana and Vermont call a moped a motor-driven cycle, the definition includes 50 cc or less cycles only.) Additional information on laws and regulations about all "limited displacement/speed" motor-driven cycles is available from the Motorcycle Industry Council's Government Relations Office. STATE CO Low-Power Scooter: A self-propelled vehicle designed primarily for use on the roadways with not more than three wheels in contact with the ground, no manual clutch, and either of the following: (i) a cylinder capacity not exceeding fifty cubic centimeters if powered by internal combustion; or (ii) a wattage not exceeding four thousand four hundred seventy-six if powered by electricity. If an internal combustion engine is used, the displacement may not exceed 50 cubic centimeters. 30 NE 16 16/ GA Moped: A motor driven cycle equipped with two No more or three wheels, with or without foot pedals to than permit muscular propulsion, and an independent 50 cc power source providing a maximum of two brake horsepower. If a combustion engine is used, the No more maximum piston or rotor displacement shall be than 3.05 cubic inches (50 cubic centimeters) 2 bhp regardless of the number of chambers in such power source. The power source shall be capable of propelling the vehicle, unassisted, at a speed not to exceed 30 miles per hour (48.28 kilometers per hour) on level road surface and shall be equipped with a power drive system that functions directly or automatically only, not requiring clutching or shifting by the operator after the drive system is engaged. 30 NE 15, instruction or limited permit / 2 STATE MOPED LAWS

GRB 15-008 STATE HI Moped: A device upon which a person may ride No more which has two or three wheels in contact with than the ground, a motor having a maximum power 50 cc output capability measured at the motor output shaft, in accordance with the Society of No more Automotive Engineers standards, of two than horsepower (one thousand four hundred ninetytwo watts) or less and, if it is a combustion 2 hp engine, a maximum piston or rotor displacement of 3.05 cubic inches (fifty cubic centimeters) and which will propel the moped, unassisted, on a level surface at a maximum speed no greater than thirty miles per hour; and a direct or automatic power drive system which requires no clutch or gear shift operation by the moped driver after the drive system is engaged with the power unit. 30 NE 15.5 - one time only, ID Moped: A limited-speed motor-driven cycle No more having: (a) Both motorized & pedal propulsion than 50 that is not capable of propelling the vehicle at a cc speed in excess of thirty (30) miles per hour on ---- level ground, whether two (2) or three (3) wheels No hp are in contact with the ground during operation. GRB 15-008 STATE MD Moped: (A) A that: (1) Is designed to be No more operated by human power with the assistance of than a motor; (2) Is equipped with pedal that 50 cc mechanically drive the rear wheel or wheels; (3) Has two or three wheels, of which one is more No more than 14 inches in diameter; and (4) Has a motor than with a rating of 1.5 brake horsepower or less 1.5 bhp and, if the motor is an internal combustion engine, a capacity of 50 cubic centimeters piston displacement or less. (b) Its power drive system does not require the operator to shift gears. 30 NE 15 or special restricted (moped), 19/ MN Motorized Bicycle: A that is propelled by No more an electric or a liquid fuel motor of a piston than displacement capacity of 50 cubic centimeters 50 cc or less, and a maximum of two brake horsepower, which is capable of a maximum No more speed of not more than 30 miles per hour on a than flat surface with not more than one percent 2 bhp grade in any direction when the motor is engaged. Is capable of a maximum speed of not more than 30 miles per hour on a flat surface with not more than 1 percent grade in any direction when the motor is engaged.
