Road Raes (Manx National Rally) Order 2016 Artile 1 Statutory Doument No. 2016/0126 Road Raes At 1982 ROAD RACES (MANX NATIONAL RALLY) ORDER 2016 Made: 3 May 2016 Coming into Operation: The Department of Infrastruture makes the following Order under setions 1 and 2 of the Road Raes At 1982. 1 Title This Order is the Road Raes (Manx National Rally) Order 2016. 2 Commenement This Order omes into operation on. 3 Interpretation In this Order Clerk of the Course inludes, in the absene of the Clerk of the Course, any Deputy Clerk of the Course appointed by the promoter; losure period means any period during whih an authorisation under artile 4 is in fore in relation to the rae area or any part of the rae area; pedestrian inludes wheelhair users and any persons using another mobility aid other than a biyle or motor vehile; prohibited area means the areas listed in Shedule 2; promoter means Manx Auto Sport Ltd; rae area means the roads speified in Shedule 1 and inludes all footways and roadside grass verges exept where speifially exluded; all areas inside or on bus shelters; all areas in front of any road losing barrier or rope and any roadside gateway, lay-by or parking area; senior polie offier means a member of the Isle of Man Constabulary (a) of the rank of sergeant or above; and (b) authorised by the Chief Constable to at as senior polie offier for the purposes of this Order; SD No.2016/0126 Page 3
Artile 4 Road Raes (Manx National Rally) Order 2016 side road means any part of a road that leads onto a rae area; and signage inludes any barrier, tape, sign, markings or struture whih indiate restrited aess to a rae area, a side road or a prohibited area. 4 Authorisation for use of rae area for motor raes (1) The promoter is authorised to use suh parts of the roads listed in olumn 1 of the table in Shedule 1 for motor raes on the days and times speified in olumn 2 of that table. (2) The Clerk of the Course may for any reason, anel, suspend or annul suh a rae, or any part of a rae. (3) The Clerk of the Course must suspend any raing if required to do so by the Department. (4) If the Clerk of the Course anels, suspends or annuls a rae or part of a rae under paragraphs (2) or (3) he or she must notify the senior polie offier. (5) Any motor vehile, whilst travelling on losed roads, must not exeed a speed of 90mph exept for ompeting vehiles and emergeny servie vehiles. 5 Suspension of right of way et. Subjet to artiles 7 and 8, during any losure period in relation to any part of the rae area, the right of way over it is suspended and aordingly, no traffi may enter or remain on it. 6 Regulation of traffi on side roads Subjet to artiles 7 and 8, during any losure period, a person must not enter or remain, or ause or permit any vehile or animal to enter or remain on a side road that is marked with signage without the permission of a onstable or marshal. 7 Exemptions from artiles 5 and 6 (1) Artiles 5 and 6 do not apply to the following persons (a) (b) () the Clerk of the Course; persons appointed by the promoter as offiials for the purpose of the rae in question and bearing an offiial badge, armlet or tabard issued by the promoter; persons approved by the Clerk of the Course; (d) onstables, fire offiers and medial persons, highway maintenane and reovery persons; Page 4 SD No.2016/0126
Road Raes (Manx National Rally) Order 2016 Artile 8 (e) (f) persons lawfully taking part in the rae in question and any person authorised by the promoter to assist those persons; and media representatives and photographers approved by the promoter and bearing an offiial badge, armlet or tabard issued by the promoter. (2) Artiles 5 and 6 do not apply to the ompeting vehiles and any vehile approved by the Clerk of the Course. 8 Temporary opening of the rae area (1) This artile has effet despite anything in artiles 4 to 6. (2) If any rae is temporarily postponed or suspended during a losure period, the Clerk of the Course may authorise traffi, in aordane with the diretions of a onstable or marshal, to ross or proeed along suh part of the rae area, and at suh times, as he or she may speify. (3) In any interval during the times speified for raing, the Clerk of the Course may authorise pedestrians, in aordane with the diretions of a onstable or marshal, to ross or proeed along the rae area at suh plaes, and at suh times, as he or she may speify. (4) Nothing in paragraph (2) permits vehiles to proeed in the reverse diretion of the rae, exept with the express authorisation of the Clerk of the Course. (5) A person must not, during a losure period, drive any vehile or ause or permit any vehile to be driven on any part of the rae area, whih is the subjet of any authorisation under paragraph (2), otherwise than pursuant to that authorisation and in aordane with the diretions of a onstable or marshal. 9 Prohibited areas (1) No person or vehile may, during a losure period, enter or remain on a prohibited area, exept to go to the aid of a person or to prevent further danger or risk to the ompetitors or any other person. (2) The extent of the prohibited area must be learly marked and indiated by signs bearing the words Prohibited Area. 10 Publiity for anellation et If the senior polie offier is notified of the anellation of the rae or a part of the rae under artile 4, he or she must take suh measures (if any) as he or she onsiders appropriate to inform the publi of the effet of it. Artile 11 Road Raes (Manx National Rally) Order 2016 11 Notifiation of end of losure (1) At the end of eah losure for whih an authorisation under artile 4 is in fore (a) (b) the Clerk of the Course; or senior polie offier, after onsulting the Clerk of the Course; must arrange for one or more motor vehiles, marked in aordane with paragraph (2), to travel the rae area. (2) As respets any part of the rae area, a losure period will be treated as ompleted for the purposes of this Order when an offiial motor vehile, displaying in a prominent position, a notie with the words Roads Open has passed along that part of the rae area. (3) Any offiial motor vehile referred to in paragraphs (1) and (2) above, displaying the words Roads Open must not exeed a speed in aordane with artile 4(5). 12 Eretion of signage (1) The Clerk of the Course must ensure that barriers, diversion signs and losure signs are ereted and maintained on all side roads immediately before, or as soon as possible after, the beginning of every losure period, and in any event before the relevant part of the rae area is used for a rae. (2) The Clerk of the Course must ensure that all signs required by paragraph (1) are plainly visible to approahing traffi. (3) The Clerk of the Course must ensure that all prohibited areas are adequately marked and delineated. (4) The barriers and signage referred to in paragraph (1) must onsist of (a) (b) strutures and signage approved by the Department; or if the Department so direts for any partiular loation, a banner stating Road Closed in red letters on a white bakground, and suspended from a tape, rope or struture. (5) The losure signs referred to in paragraph (1) shall be of the size, olour and type shown in diagram 7010.1 (warning, informatory and regulatory) in shedule 12 of the Traffi Signs Regulations and General Diretions 2002. (6) The Clerk of the Course must ensure that the barriers, diversion signs and losure signs referred to in paragraph (1) are removed at the end of every losure period. Page 6 SD No.2016/0126
Road Raes (Manx National Rally) Order 2016 Artile 13 13 Insurane The promoter must seure insuranes and indemnities against death, injury or damage to persons or damage to property arising out of the ondut of the raes or arrangements inidental to them of at least thirty million pounds ( 30,000,000).
