February 22, 2016 California Civil Code requires the Association to provide its members thirty (30) days notice of any proposed Operating Rules change in order to give the members an opportunity to offer comments and opinions on the proposed changes. Specifically, the Board of Directors is considering changes to Parking Policy of the Coto De Caza Association Rules and Regulations. Purpose and Effect: The purpose and effect of the proposed revisions to parking policy are: 1. Establish an easily understood method for controlling street parking, 2. Reduce homeowner and association liability of having emergency vehicle access blocked by cars parked on both sides of narrow streets, and 3. Reinforce that there is no street parking between the hours of 12:00 AM to 6:00 AM The provisions that will be added are shown with a strikethrough, and the new proposed provisions are noted as underlined. COTO DE CAZA COMMUNITY ASSOCIATION PARKING POLICY After a successful trial period from July 1, 2011 to August 31, 2011, during the September board meeting the Board adopted the Parking Committee s recommendation of the below described parking policy that will apply to ALL Village residents and their renters, guests, vendors. The goal of the revised parking rules are to: 1.) Establish an easily understood method for controlling street parking, 2.) Establish off-street parking locations, andreduce homeowner and association liability of having emergency vehicle access blocked by cars parked on both sides of narrow streets, and 3.) Reduce homeowner and association liability of having cars parked on both side of the streetreinforce that there is no street parking between hours of 12:00AM 6:00AM. New Parking Rules & Regulations Homeowner driveways must be utilized as the primary location for parking Once all space of a homeowner s driveway has been utilized, parking is permitted on one side of the street only, following an odd/even year parking process (for example during 2016, cars will be required to park on the even-numbered side of the street). This on-street parking is permitted only during the hours of 6:00 AM to 12:00 AM Parking is also permitted on the street shoulder areas of streets. Examples are the shoulder areas on Via Ortega, Via Pavo Real, and the base of Via Alondra. This off-street shoulder parking is permitted only during the hours of 6:00 AM to 12:00 AM. No parking is permitted on the streets, street shoulders, greenbelt or vacant lots between the hours of 12:00 AM (midnight) and 6:00 AM. Homeowners are responsible for communicating and facilitating the Village Parking Policy to their guests, renters, and service personnel. All day and overnight parking for up to 3 days in the Overflow Parking Lot located at the corner of Via Ortega and Via Coyote, subject to availability. Enforcement Vehicles that are improperly parked in violation of the above rules may be CITED AND/OR TOWED AT THE OWNER S EXPENSE The success of this policy is imperative for the safety and well-being of every homeowner, resident, guest, and service person in the Village. Whenever possible, all residents, guests and service personnel should park in homeowner driveways. If it is not possible to park in a homeowner s driveway, guests and service personnel should first look to park in designated off-street parking areas.
On-street parking in the Village will be by permit only and will follow odd/even year parking process (for 2015, cars will be required to park on the odd-numbered side of the street). All cars parked on the streets of the Village will be required to have a Village Resident/Resident Guest Parking Permit clearly displayed on the left side of their dashboard. The Village Parking Permits will be valid ONLY between the hours of 6 a.m. and midnight. No overnight street parking will be permitted. At the beginning of each year Village residents will be issued two Village Resident/Resident Guest Parking Permits for their personal use. Residents (or their renters) must fill in their name and address on all parking permits. Residents are responsible for communicating and facilitating the Village Parking Policy to their guests. Residents may make photocopies of their personal Village Parking Permits to give to their visiting guests and service vendors. No parking permitted on undeveloped easements or greenbelts between 2:00 am and 6:00 am. Parking is permitted in your garage and driveway only. The Association-owned streets are narrow and on-street parking is dangerous and could create liability. Your adherence will make our community a safer place to live. VEHICLES IN VIOLATION WILL BE TICKETED AND TOWED AT VEHICLE OWNERS EXPENSE. The success of the new parking policy will be largely dependent on the cooperation of each individual resident of the Village. Efforts as neighbors to inform our fellow neighbors of the policy and additional efforts of the parking committee will help facilitate the adoption of the policy. These efforts will include posting of friendly reminders on improperly parked vehicles. It is the intent that our cooperation as neighbors and posting reminders will satisfy any needed enforcement efforts; however, if after a period of time these efforts are not successful a formal notice and towing policy will be implemented (proper notice will be given prior to enforcing any such policy). The success of this new policy is imperative to the safety and wellbeing of every homeowner in the Village.
