ES Vol 2, CFA 25 2.6.18 The potential for a longer tunnel, moving the eastern tunnel portal to the east of the B4118 Birmingham Road, was raised at the 20th March 2013 community forum. Lengthening the tunnel would have the potential benefit of avoiding disruption to the Castle Bromwich Business Park and also not requiring the realignment of the River Tame and associated impacts on floodplain and the Park Hall nature reserve. It would, however, likely require two tunnel shafts, and would require a complicated connection with the Proposed Scheme Delta junction to the east. It has not been included in the Proposed Scheme. Assurances offered to BCA 1. Once the Bill has received Royal Assent, the Secretary of State will provide British Car Auctions with six months advanced notice of entry on the property at Hayward Industrial Estate, Langley Drive, Birmingham, under section 11(1) of the Compulsory Purchase Act 1965 or section 8 of the Compulsory Purchase (Vesting Declarations) Act 1981. 2. The Secretary of State is willing to pay British Car Auctions up to 90 % of the nominated undertaker s estimate of the compensation (including for disturbance) payable to British Car Auctions for compulsory purchase of its leasehold interest, upon service of the notice referred to in assurance (1) above. The Secretary of State will require the nominated undertaker to keep British Car Auctions updated on the progress of the Bill and likely target dates for taking possession of the property at Hayward Industrial Estate, Langley Drive, Birmingham. ii. The Promoter will encourage the Agency service to engage proactively with British Car Auctions to assist it, as and when necessary, whilst it undertakes the search for alternative premises, to identify its requirements and plan its relocation in advance of Royal Assent; iii. The Promoter will, in these circumstances, agree to treat the reasonable costs incurred by British Car Auctions in connection with the search for alternative premises as proper disturbance costs in British Car Auctions claim for compensation; and iv. In the event that British Car Auctions shall identify suitable premises for the relocation of their business on a date prior to the date of notice, on receipt from British Car Auctions of details of those premises, the Secretary of State will confirm whether or not he/she accepts that those premises provide a reasonable basis for British Car Auctions claim for compensation under Rule 6 of the Land Compensation Rules 1961. HOUSE OF COMMONS SELECT COMMITTEE HIGH SPEED RAIL (LONDON - WEST MIDLANDS) BILL PROMOTER S RESPONSE TO PETITION OF: British Car Auctions Limited PETITION NO: 182 PARAGRAPH NO: 10-11 ISSUE RAISED: PETITION PARAGRAPH: Alternative proposals 10. In short, the Petitioner objects to the currently proposed location of the route of the railway and the associated works and hereby requests that the route of the railway in this location is either (a) moved 100 metres to the north of the Petitioner's land; (b) moved 100 metres to the south of the Petitioner's land; or (c) if the route of the railway line as proposed in the Notice is not moved laterally then it should be tunnelled to a suitable depth under the Property. 11. In particular the Petitioner notes that the proposed railway is to be tunnelled at the Bromford Tunnel East Portal which is to the west of the Petitioners land which lies roughly between this point and east of Castle Bromwich Court. The Petitioner requests that tunnelling commences at a location approximately 500 metres to the east of the currently proposed Bromford Tunnel East Portal. This would prevent the necessity for the compulsory acquisition of the Property and other land on the adjacent industrial estate. This in its self will substantially reduce any compensation claim by the Petitioner (and others) under the terms of the bill in respect of the compulsory acquisition of the Petitioners property and the permanent relocation of the business elsewhere. Due to the nature of the business and the type of replacement facility that will be needed, a compensation claim may run into several million pounds. PROMOTER S RESPONSE: 1. In January 2012 the HS2 scheme was announced by the Secretary of State for Transport. At that time there was an above ground alignment through Castle Bromwich Business Park under the elevated through Bromford, requiring extensive works particularly to A452 Chester Road, A4040 Bromford Lane and River Tame realignment. 2. As stated in the Environmental Statement, Volume 2, CFA25, Section 2.6.14, the following options were considered for this section of the route: Option 1 (Surface Option): the January 2012 announced scheme beneath viaduct, but with a concrete cover to the Proposed Scheme to allow maintenance of the elevated P365(6)
viaduct above; Option 2 (Surface Option): the January 2012 announced scheme but within a new combined HS2/ viaduct structure; Option 3: the Proposed Scheme (tunnel); Option 4 (Surface Option): crossing the further east, passing through Castle Bromwich Business Park and running the route parallel to the through Bromford; Option 5 (Surface Option): crossing the further east, opposite the Park Hall nature reserve, passing south of Castle Bromwich Business Park and running the route parallel to and south of the through Bromford; and Option 6 (Surface Option): use the classic rail infrastructure corridor. 3. The tunnel option would avoid any major works or disruption beneath the viaduct and also there is no need to move the River Tame south (from under the ), which would have resulted in the loss of community facilities, open space and play areas. This option also avoids substantial relocation of National Grid overhead power lines and pylons. The proposed tunnel will also no longer require any major highway works in this area, which would have significantly impacted the local businesses and traffic. 4. The lengthening of the tunnel may have the potential of avoiding disruption to the Castle Bromwich Business Park. However, such an extension would require extensive works to reconfigure the connection with the Proposed Scheme s delta junction to the east and would also likely require the construction of two further tunnel shafts. The Promoter concluded that, on balance, the net additional costs of an extended tunnel option would be likely to outweigh any net benefits of the proposal. Therefore, it has not been included in the Proposed Scheme. P365(7)
