Parking Ordinance ( December 06) The Executive Board of ETH Zurich, on the basis of Art. 0, para., letter a, and, para. of the Fees Ordinance in the ETH Domain of May 995 and Art. 6 of the General Fee Ordinance ETHZ of 6 April 996 and Art., para., letter c, of the Organisation Ordinance ETH Zurich of 6 December 00 issues the following decree: Teil I. General Provisions Part. Scope of application This parking ordinance applies to all parking spaces at ETH Zurich whether owned or rented. The term parking spaces refers to both unsheltered (outdoor spaces) and sheltered spaces. Part. Superordinate federal law Users of ETH Zurich parking spaces are subject to federal regulations on road traffic, in particular the Federal Road Traffic Act 5, the Ordinance on Road Traffic Rules 6 and the Ordinance on Road Signalling 7. Part. Liability ETH Zurich expressly disclaims all liability arising from theft or damage to vehicles parked on its premises, subject to the provisions in paragraph. Liability on the part of ETH Zurich is reserved for any material damage caused to parked vehicles by employees of ETH Zurich in the course of duty. ETH Zurich can take recourse against employees if the damage was caused intentionally or through gross negligence. Part. Body of authority The body of authority responsible for implementing this parking ordinance is the Services Department, in particular the Mobility and Transport office. In consultation with the Facility Management department, it may delegate this responsibility or parts thereof, especially in the case of parking spaces at external ETH Zurich locations, to the relevant building area. ETH Zurich parking facilities are classified as follows: a) Outdoor parking spaces on the ETH Zentrum campus b) Parking garages on the ETH Zentrum campus c) Parking garages on the ETH Hönggerberg campus d) Parking spaces at external ETH Zurich locations Parking is only permitted on the correspondingly marked areas. Part. 6 External ETH Zurich locations In exceptional cases and for justified work-related purposes, staff working at an external ETH Zurich location can use any of the other ETH Zurich car parks provided they have parking permits valid for their external location. In exceptional cases and for justified work-related purposes, staff working at the ETH campus or ETH Hönggerberg campus can use the car parks of the external ETH Zurich locations provided they have parking permits valid for their own campus. External locations chiefly comprise: a) Schwerzenbach b) Oerlikon c) Lindau d) Lugano e) Basel. Teil II. Parking entitlement Part. 7 Principle No automatic entitlement to a parking permit is derived from employment or any other contractual relationship with ETH Zurich or matriculation at ETH Zurich. As a rule, parking spaces are not personally ascribed (non-personal), except for the parking spaces described in Art. 8 (permanent rental). No claim can be made for a particular parking space. Students may park only in the parking garages on the ETH Hönggerberg campus. Only vehicles (including motorcycles and mopeds) with a valid licence plate may be parked except for motorcycles which are left over winter as per Article. However, these require a parking permit. Part. 8 Authorisation categories In order to park in ETH Zurich car parks, the following forms of authorisation exist: a) Parking permits (Art.0 ff.) b) Tickets (Part. ) c) Daily, weekly, or monthly passes (Art.5) d) Business journey permits (Art.6) e) Visitor permits (Art.7) f) Permanent rental (Art.8). The Mobility and Transport office can issue special permits in exceptional cases. Seite /0
Part. 9 Allocation criteria As a rule, the criteria for awarding the authorisation to park are: a) the necessary use of a private vehicle for work-related reasons, e.g. due to i. commitments at several ETH Zurich locations ii. iii. unusual working hours during which no means of public transport is available before work starts or ends regular car journeys for business purposes b) the absence of a sufficient and reasonable connection by public transport between the home and place(s) of work or study at ETH Zurich c) the amount of time required for the journey from home to the place of work or study. Persons dependent on the use of a vehicle due to physical handicap are given preferential treatment.. Section Parking permits Part. 0 Persons entitled to park In line with the allocation criteria described in Article 9, the following persons are entitled to a parking permit, which is bound to a specific vehicle: a) Staff members of ETH Zurich b) Doctoral candidates at ETH Zurich c) Students at ETH Zurich d) Staff members of ETH Zurich partner organisations. Staff members are defined as all persons officially employed by ETH Zurich, regardless of their function. Doctoral candidates are defined as all persons who are matriculated on a doctoral degree program at ETH Zurich, regardless of whether they are officially employed by ETH Zurich or not. Students are defined as all those who are matriculated at ETH Zurich on a Bachelor s or Master s programme. 5 Staff members of partner organisations are defined as those persons officially employed by partner organisations (e.g. VSETH, AVETH, ASVZ, ETH Store, SV Group, etc.). 6 Anyone belonging to more than one category pays for the category with the lowest price. Part. Displaying the parking permit Car drivers must display the parking permit in an easily visible position behind the front windscreen. Motorcycle drivers must display the parking permit in an easily visible position in the front steering area. Part. Changes Any of the following changes must be reported to the Transport and Mobility office: a) Change of licence number b) Change of home address c) Change of office address Courtesy cars must be indicated as such: a written reference to the licence plate of the regular vehicle for which the parking permit is valid must be clearly displayed behind the front windscreen. If the owner of a parking permit leaves ETH Zurich (termination of employment or dematriculation) or the partner organisation, the parking permit must be returned to the Mobility and Transport office at the nearest possible date (Art. para. and ). Part. Length of validity Except in the case of para., parking permits are issued for an indefinite period. Parking permit agreements may be terminated by either party on the basis of one month's notice at the end of each month. Parking permits for students are valid for a limited period, namely for one semester and the following semester break. The authorisation to park ends on expiry of the validity period printed on the parking permit. Early termination is not possible.. Section Tickets and daily, weekly and monthly passes Part. Tickets Provided they have a valid parking ticket, ETH members can park in the parking garage of the ETH main building (HG) as well as in the parking garages on the Hönggerberg any day of the week, day and night. The parking garage of the ETH Main Building (HG) is open to the public and can be used by any person with a valid ticket from Monday to Friday between 5 pm and 7 am, as well as on weekends and public holidays all day. The parking garages at the Hönggerberg campus are permanently open day and night throughout the week for non-eth members with valid tickets. Part. 5 Daily, weekly and monthly passes Entitled persons as per Art. 0 may purchase daily, weekly or monthly passes (paying directly by cash, debit or credit card) from the Services Department (Campus Info, web shop) or from the Information and Service Centre of the Facility Management department. The passes must be placed in a clearly visible position behind the front windscreen. Manual workers and staff from companies commissioned by ETH Zurich to work at ETH Zurich locations can also obtain daily, weekly or monthly passes. Monthly passes are limited to a maximum of three months after which a new pass may be requested. With vehicles under a height of.0 metres, those persons mentioned in paragraph must use the parking garages and underground delivery entrances. Vehicles over.0 metres must be parked on the Seite /0
marked outdoor parking spaces. The same applies when a manual worker requires regular access to his vehicle in order to carry out his work. 5 Persons described in paragraph who work on an ETH Zurich building site must use the parking spaces specially provided on the building site. 6 Entitled persons as described in Art. 0 can for a flat rate (multiplication of the single price) buy daily, weekly or monthly passes from the Services Department for guests, provided the guest s stay has a connection to ETH Zurich. It is not permitted to finance a parking space for staff members, students or persons with no connection to ETH Zurich in this way.. Section Business journey permits and guest permits Part. 6 Business journey permits Business journey permits entitle the driver of a private vehicle who does not have a parking permit or any other parking authorisation to park temporarily in connection with business journeys. The commute to work does not count as a business journey. For monitoring purposes, business journey permits are limited to a year. Business journey permits are only issued and provided to the secretariats of teaching research and administration units at ETH Zurich or to offices of partner organisations. They are not issued to individual persons. The organisational units mentioned in paragraph are responsible for issuing the permits in line with regulations. They may not issue business journey permits to compensate for a driver s insufficient entitlement to a parking space. 5 When occupying a parking space, drivers must clearly display the business journey permit behind the front windscreen. 6 Business journey permits are valid for all ETH Zurich locations as described in Art. 5 and Art. 6. Part. 7 Guest permits Persons participating as a guest at an event at ETH Zurich on the invitation of a member of the Executive Board or a Department Management Board are permitted to park free of charge. For this purpose, the event s organisational unit must submit an application form for a guest permit to the Transport and Mobility office at least two weeks in advance. The guest permit entitles the holder to free parking during the event. It must bear the date of the event.. Section Permanent rental Part. 8 Permanent rental of parking spaces A written rental contract needs to be concluded in order to permanently rent a particular parking space (personal parking space). This is valid indefinitely. Parking spaces are personally allocated according to the following priority list. It must be noted that the people entitled to a parking space, in line with the following c) to e) provisions, are subject to the allocation criteria described in Art.9, para.: a) Tenants of the HWO and HWW buildings on the Hönggerberg parking areas, provided that the limit of 57 parking spaces set by the City of Zurich has not already been reached b) Physically disabled members of ETH Zurich and ETH Zurich partner organisations who depend on the use of a vehicle Seite 5/0
c) ETH Zurich staff members d) Doctoral candidates and students at ETH Zurich, provided they are not officially employed by ETH Zurich e) Staff members of ETH Zurich partner organisations f) Members of ETH Zurich and partner organisations who do not fulfil the allocation criteria listed in Art. 9 para. g) External persons Responsibility for concluding the rental contract, for collecting payment and for administrative matters in this connection lies with the Transport and Mobility office. The rental contract can be terminated by either party on the basis of a three-month notice period at the end of each month. 5 Parking spaces for permanent rental are limited in number and cannot be selected. For fire safety reasons, permanent parking is only possible at specially designated places (signage, fire zones, firefighting equipment). 6 If all the spaces available in accordance with the priorities set out in paragraph are filled, a waiting list is drawn up. In the event of heightened demand, users with lower priority may have their rental contract terminated. The -month notice period will be adhered to. 7 Garage keys can be obtained from the Information and Service Centre of the Facility Management Department s building area and must be returned there when the rental contract expires. Keys are ordered through the Mobility and Transport office. Teil III. Charges Part. 9 Basic principle Charges for the different types of authorisation to park are regulated in Appendix.These are reviewed every five years at the latest and adjusted as necessary. Parking permit charges for staff members are deducted directly from their monthly salary. Students pay directly for the parking permit at the time of issue. Staff members of ETH Zurich partner institutions and doctoral candidates not employed by ETH Zurich who have a parking permit and permanent rental drivers as described in Art. 8 are billed at half-year intervals. 5 With the exception of Art. 5 para. 6, charges for the right to park may not be paid from ETH Zurich funds. Part. 0 Exemptions and reductions Drivers with physical disabilities who depend on the use of a vehicle are exempt from charges. Those entitled in line with Art. 0 and 8, who are obliged to use their private vehicle for business journeys (Art. 9 para. letter. a, e.g. stand-by duty or shift work) are exempt from charges. Building works or operational changes can temporarily restrict or prevent parking. This does not entitle drivers to a reduction or refund of the charges, provided an alternative is offered or the restriction does not exceed two weeks. Seite 6/0
Part. Absence A short-term absence (holiday, sickness, accident, etc.) does not result in an interruption of the monthly or half-yearly billing process. In the event of an absence of two or more months, it is possible to suspend the parking permit. The driver submits the parking permit to the Mobility and Transport office. During this time, no charges are incurred and no billing takes place. Rental contracts as described in Art. 8 cannot be suspended. Teil IV. Violation Part. Policing fee, offences, fines Anyone failing to comply with a judicial prohibition on a parking facility shall pay an administrative fee (policing fee). If the policing fee is not paid, criminal charges may be brought for violation of a judicial prohibition. According to Art. 58 para. of the Swiss Civil Procedure Code of 9 December 008 8, this can be punished with a fine of up to CHF '000.-. In addition, the offender will be required to pay for the costs of the criminal proceedings. Any fines and proceedings costs as well as policing fees must always be paid personally by the driver in question, even if the vehicle was used for work-related purposes, and may not be paid with ETH Zurich funds. Part. Removal of illegally parked vehicles Illegally parked vehicles, in particular those parked outside of the indicated parking spaces or those which block exits marked for safety reasons (e.g. fire service, ambulance) or other accesses can be removed by the Mobility and Transport office at the expense of the holder. This also applies to bicycles, mopeds and motorcycles parked outside the marked areas or within building premises. Part. Storing goods on parking areas Storing goods of any kind is forbidden on all parking areas, including personal parking spaces. Should a warning be ignored, all goods stored on parking areas can be removed at the expense of the offender. Part. 5 Further violations Further violations against this ordinance chiefly include: a) changing the printed text on the parking authorisation or the date (e.g. on daily, weekly or monthly passes) b) sub-letting parking spaces c) passing on the parking permit to others If, despite a reminder, a new violation of the parking ordinance is committed, the Mobility and Transport office can immediately withdraw the parking authorisation and inform superiors. 8 SR 7 Seite 7/0
Teil V. Special provisions Part. 6 Loading and unloading For short-term loading and unloading of deliveries, suppliers to ETH Zurich or one of their partner organisations do not require parking permission. If the loading or unloading requires longer than 0 minutes, the Mobility and Transport office must be informed. Part. 7 Permanent parking Permanent parking is permitted exclusively for users of parking spaces as described in Art. 8. Exceptions to paragraph are decided upon by the Mobility and Transport office. Part. 8 Parking spaces with power supply Renting a parking space with a power supply in order to charge a private e-vehicle is only permitted for drivers in the permanent rental category described in Art. 8. Part. 9 Reserving parking spaces In principle, parking spaces cannot be reserved. When hosting large events, a request to reserve parking spaces can be submitted to the Mobility and Transport office. This is only granted in exceptional cases. The space(s) will be blocked by the Mobility and Transport office in consultation with the Facility Management department. Part. 0 Exchangeable licence plates / Second vehicle Each parking permit is specific to a licence number. Only one parking permit will be issued per licence number. In the case of exchangeable licence plates, a maximum of two parking permits are issued. Further parking permits for exchangeable licence plates are available for a fee. If a household owns two vehicles, two parking permits can be supplied for the price of one parking permit. However, the parking permits remain specific to the licence number. Part. Motorcycles Parking motorcycles is free. However, motorcycles must display a parking permit. The permanent parking of motorcycles is not permitted, subject to the provisions of paragraph. Motorcycles can only be parked over winter with a parking permit. The maximum period is from the start of November until and including the end of March, after which the motorcycles must be removed. Part. Coaches On the ETH Zentrum campus, coaches and buses must be parked only on the corresponding spaces in the Leonhardstrasse passage. On the ETH Hönggerberg campus, coaches and buses must be parked only on the parking spaces on Wolfgang-Pauli-Strasse and at HEZ. Seite 8/0
The use of coach or bus parking spaces must be communicated to the Mobility and Transport office. Parking is limited to a maximum period of three hours. In the case of longer periods, a public bus park (e.g. Zurich main station) must be used. Part. Trailers Trailers owned by ETH Zurich that are required for work-related purposes may only be parked on the parking spaces reserved for this purpose. Private trailers may not be parked on ETH Zurich parking spaces. Part. Market drivers Market drivers must pay a fee for operating on ETH Zurich premises. No additional parking charges are due. The standpoint is allocated to the market drivers by the Mobility and Transport office of the Services department in consultation with the Financial Services department. It is possible for market drivers to leave their vehicle parked between operations on ETH Zurich premises on request. The application must be submitted to the Mobility and Transport office. The parking fee for staff members applies. Part. 5 Parking vehicles over winter With the exception of motorcycles (Part. ) and on permanently rented spaces (Art. 8), private vehicles may not be parked over winter on the outdoor premises of ETH Zurich nor in ETH Zurich parking garages. Part. 6 Overnight stays in vehicles Spending the night in a vehicle (private car, truck, mobile home, caravan, etc.), is not permitted on ETH Zurich outdoor premises or in ETH Zurich parking garages. Part. 7 Video surveillance for security reasons The parking facilities, especially the parking garages, can be subject to video surveillance for security reasons.
