All bids must be made on the blank VEHICLE BID FORM proposal attached hereto. 3. The District reserves the right to reject any and all bids or to accept any bid, whichever is in the best interest of the District. 4. Proposals which are incomplete, unbalanced, conditional, or obscure or which contain additions not called for, erasures, alterations or irregularities of any kind or which do not comply with the NOTICE INVITING BIDS may be rejected at the option of the District. 5. A bidder may withdraw any proposal he has submitted at any time prior to the hour set for the closing of the bids provided the request for withdrawal is signed in a manner identical with the proposal being withdrawn. No withdrawal or modification will be permitted after the hour designated for closing the bids. 6. CARMICHAEL WATER DISTRICT BIDDER QUALIFICATION FORM The District is looking to purchase one new vehicle. SCOPE AND INTRODUCTION: This specification described one NEW, UNUSED, latest model heavy duty truck as follows: The term heavy duty, as used in these specifications, shall mean that the item to which the term is applied shall exceed the usual quantity, quality or capacity supplied with standard production vehicles; and it shall be able to withstand unusual strain, exposure, temperature, wear and use. The vehicle will be supplied with all equipment and accessories so indicated as standard equipment in the manufacturer s published literature The vehicles shall be complete with all the equipment and accessories necessary for safe and efficient operation. All parts, equipment and accessories shall conform in strength, quality of material and workmanship to latest recognized industry standards. It is intended that the manufacturer, in the selection of components, will use only those material and design practices that are the best available in the industry for the type of operating conditions to which the heavy duty vehicle shall be subjected. Suspension, wheels, tires and other component parts shall be selected by the manufacturer to give: maximum performance, service life and safety and not merely meet the minimum requirements of this specification. The dealer or manufacturer at no additional charge to the District shall also install optional equipment, as necessary, to meet requirements of this specification. If any of the equipment bid varies from the specifications, such variation must be listed in writing and attached as a part of this proposal. Carmichael Water District reserves the right to waive minor variations if in the opinion of the District the basic unit meets the general intent of these specifications. The District reserves the right to reject any and all bids, or alternate bids, as the best interest of the District may require. Consideration will be given in comparing proposals and in awarding a contract, not only to the amount of the proposal, but also the kind and quality of the equipment offered, its suitability for delivery is important and may influence the award. 3
These specifications are written with intent to meet all applicable documents but the final certification to comply shall rest with the vendor and not the Carmichael Water District. Should requirements as specified not comply, the manufacturer is required to refigure and revise the specifications to meet all laws, rules and regulations where it applies to items such as the ratings of axles, tires, rims, brakes, etc., and the District is to be notified immediately thereof. APPLICABLE DOCUMENTS AND CERTIFICATIONS: All laws, rules and regulations shall include but not be limited to the following: Federal Motor Vehicle Safety Standard, Department of Transportation. State of California Motor Vehicle Code. State of California Health and Safety Code, Motor Vehicle Pollution Control. California Occupational Safety and Health Act (O.S.H.A.). Division of Industrial Safety. One certified weight ticket. SUBSTITUTION FOR SPECIFIED EQUIPMENT: Whenever in the specifications any material or process is indicated or specified by patent of proprietary name of a manufacturer, such specifications shall be deemed to be used for the purpose of facilitating descriptions of the material and/or process desired and shall be deemed to be followed by the words or equivalent. The vendor may offer any material or process which shall be equal in every respect to that so indicated or specified, provided however, that if the material, process or article offered by the vendor is not, in the opinion of the District, equal in every respect to the specified, then the vendor must furnish the material, process or article specified or one that in the opinion of the District is the equal thereof in every respect. E.g. special wrenches, tool kits, jack - adequate to safely lift the vehicle when loaded to rate capacity, etc. Complete specifications, published literature and photos or illustrations of the unit proposed shall be furnished with the bid. Prior to delivery, the new vehicle must be completely serviced by the successful bidder or his authorized agent. Also the crankcase, differential, cooling system and transmission must be filled to manufacturers recommended capacity when vehicle arrives at delivery destination. Only new models, which are cataloged by the manufacturer and for which printed literature and specifications are available, will be acceptable. A copy of the line set ticket showing equipment installed on vehicle shall be made available at the time of delivery. Price to be exclusive of federal excise tax. Exemption certificate will be furnished. 7
Dealer to license all vehicles: Vehicle Registration and Ownership Records shall indicate: Carmichael Water District, 7837 Fair Oaks Boulevard, Carmichael, CA 95608. Vehicle Manuals - one (1) operator s manual for each vehicle furnished shall be delivered to the District at the time of vehicle delivery. DELIVERY: Caravan or drive-away deliveries from points of manufacture or assembly will not be accepted. The vehicle shall be delivered serviced and operable to: Carmichael Water District, 7837 Fair Oaks Boulevard, Carmichael, California 95608. The original dealer s Report of Sale and Certified Weight Certificate shall be furnished to the consignee at the time of delivery of the vehicle. INSPECTION: The vehicle will be inspected by an authorized representative of the District before acceptance for: proper functioning of all equipment and systems, workmanship, appearance and conformance to all other requirements of this specification. If deficiencies are found, it shall be the responsibility of the dealer to pick up the vehicle, make necessary correction and re-deliver the vehicle for re-inspection and acceptance. Payment and/or the commencement of a discount period, if applicable, will not be made until corrective action is made. GUARANTEE: A manufacturer or vendor delivering any vehicle against this specification shall guarantee that the vehicle meets the minimum requirements set forth herein. If any vehicle delivered does not meet the minimum requirements of this specification, the manufacturer or vendor will be required to correct the same at his expense. WARRANTY: The vehicle and components shall be guaranteed under the standard factory and/or dealer warranty for a minimum of three (3) years. 8
