Review/Approve Asphalt Plant Propane Tank Lease Proposal The Ozaukee County Highway Department was approached by Boehlke Bottled Gas Corporation with an offer to utilize the Asphalt Plant s propane tank during the construction off-season. Boehlke Bottled Gas Corporation is interested in utilizing the tank as a remote storage and distribution location to assist serving northwest Ozaukee County customers. After a meeting with Chairperson Geracie, Public Works Director Dreblow and Chad Kroening of Boehlke Bottled Gas Corporation, a proposal was submitted. Mr. Dreblow noted in the proposal the guaranteed minimum savings of $10,000 for the county. Upgrades are not needed by the county, but Boehlke will upgrade for its own purpose at an estimated cost to them of $40,000. Discussion on the proposed 10-year term of the agreement. Motion to approve the proposal from Boehlke Bottled Gas Corporation for a 10-year lease for the use of the Asphalt Plant s propane tank. Review/Approve Justice Center Roof Change Order The Ozaukee County Facilities Department sought bids to replace the Justice Center s Roof due to deterioration and water damage due to leaking. Funding is through a General Fund transfer approved by the Ozaukee County Board of Supervisors on March 5, 2014. After submittal of the bids, it was determined that the roof design didn t match the existing conditions, and a section should be revised to show a radius panel design. David Velcheck of Velcheck & Finger Roof Consulting Service, estimated that a change order for the radial design would be approximately $10,000. The Public Works Committee, at their May 22, 2014 meeting, approved the construction bid and authorized the Public Works Director to request a change order with Cudahy Roofing for up to $10,000. Upon start-up of the Justice Center Roofing project, Mr. Dreblow had David Velcheck request a change order for the radial design, and Cudahy Roofing submitted a change order for $15,800. Discussion on the impacts of the radial design and the committee action previously to approve up to $10,000. The project is currently under budget. Motion to approve the change order for the radial design for the amount of $15,800. Review/Approve Cedarburg Shop's Cold Storage Building Bids The Ozaukee County Highway Department sought bids to construct a Cold Storage building at the Cedarburg Shop. The project is being funded through the Highway Department s Building Capital Improvement Program (CIP), and has an approved budget of $125,000. The Ozaukee County Highway Department received one bid from JH Hassinger Construction Services despite contacting numerous other construction companies. JH Hassinger s total bid was $322,700, which was $267,000 for labor and equipment and $55,000 for owner purchased materials. Based upon the lack of bids and the higher than budget cost, Highway Staff recommends rejecting all bids. The bid documents should be modified and the project re-bid over winter for Spring 2015 construction. Discussion on the lack of bid response and high cost. Motion to reject all bids and modify bid documents to re-bid for Spring 2015. Review/Approve CTH T (Lakefield Road) & Green Bay Road Engineering Contract The intersection of CTH T (Lakefield Road) & Green Bay Road is a busy, four-way stop intersection that is a consistent maintenance issue. Mr. Edgren explained the condition of the road and the impact from the truck traffic. Minutes Acceptance: Minutes of Sep 18, 2014 8:00 AM (Approval of Minutes ) Highway staff applied for Local Road Improvement Program (LRIP) funds towards reconstructing the intersection in concrete. Then the project can be bid in late winter to give the County the most advantageous bids. Based upon a long standing relationship with the County, their ability to design projects efficiently and effectively, and having completed a near identical project at CTH D & CTH LL for the County, Highway Staff requested an Engineering Proposal from Gremmer & Associates. An explanation on how and when road closure would occur was given. Motion to approve the Engineering Contract with Gremmer & Associates for a cost of $27,000. Review/Approve CTH W (Meijer Project) Invoice Ozaukee County partnered with the Village of Grafton, through a Memorandum of Understanding (MOU), to cost-share for the reconstruction of CTH W (Port Washington Road) as a part of the Meijer Development project. The agreement called for Ozaukee County to be responsible for 10% of the construction costs, which were estimated to be $90,000. The $90,000 was originally budgeted in 2013, and rolled over into 2014. Several months ago, Mr. Dreblow reported that the cost would exceed the projected $90,000, estimated at that time to be $110,000. Following completion of the project, the Village of Grafton analyzed the construction costs, and determined that the total construction was more than estimated. Therefore, the Village has billed the County for $115,761.85. The Village of Grafton s invoice appears reasonable, and the Highway Department has cost savings from other projects to cover the $25,761.85 shortage. City of Port Washington's Request to Acquire Surplus County Owned Property Mr. Dreblow stated that a request was received by Mr. Meaux from the City of Port Washington expressing an interest in acquiring county-owned property in the city. The property is located on the eastside of CTH LL south of STH 33. The primary storm detention pond for the STH 33 reconstruction was built on this parcel with some land lying adjacent to Second Avenue to be left for future residential development. The city maintains the pond on the county-owned property. The city is requesting that the county sell the entire property to their Community Development Authority; whereby, the city would sell the portion along Second Avenue to a developer. Discussion on the different options available to the county. Mr. Meaux suggested, as an alternative for the committee to consider, that staff engage in further discussion with the city before the committee makes a decision. The committee agreed that further discussion with the city was warranted. 2. Opitz Gravel Pit Reclamation Plan: Status Update The Ozaukee County Highway Department has been working through a Reclamation Plan process with the Town of Saukville for the proposed Opitz Gravel Pit since January. On August 25 th, Ozaukee County received a denial of our proposed plan from the Town of Saukville. Ozaukee County Corporation Counsel contacted the Wisconsin Department of Natural Resources (WDNR), believing the denial to be improper, and received correspondence from the WDNR on September 9 th confirming that the Town of Saukville s denial wasn t valid. Corporation Counsel has sent out a letter requesting an administrative review from the Town of Saukville. A meeting with the Town of Saukville has been scheduled for September 23 at 11:00AM. The remainder, Outlot 1, was utilized by WisDOT for the construction of a stormwater pond for the benefit of WisDOT and City of Port Washington. As WisDOT is in process of designing the reconstruction of I-43, they also reviewed the overpass bridges contained within the project area. As WisDOT reviewed the CTH C bridge and surrounding area, they found that the interchange doesn t meet minimum design standards at a 45 MPH Speed Limit. If WisDOT reconstructed the entire interchange to meet design standards, the CTH C & CTH W Intersection would need to be raised and would subsequently necessitate the raising and replacement of box culverts for Ulao Creek. However, if the Speed Limit is reduced to 35 MPH, then the surrounding area can mostly stay as currently constructed. (See the attached Speed Study for additional information.) ANALYSIS: Based upon the Speed Study and desire to minimize reconstruction of the CTH C/I- 43 Interchange area, we believe the Speed Limit reduction is warranted from CTH W to east of the CTH C Park & Ride. CTH C runs over I-43, and its existing vertical curve is substandard for the existing posted and design speed (45 mph / 50 mph). We have received a number of complaints from local motorists about the poor sight distance from the off ramps to CTH C, and officials from Ozaukee County recognize this as a problem area as well. In addition to the existing issue on CTH C, as we ve gotten further into our proposed design for this interchange, we ve found that the impacts of meeting even minimum design standards for a 50 mph vertical curve on CTH C would be great. Ulao Creek crosses CTH C about 600 west of the CTH C / Port Washington Rd., and then again about 350 north of the intersection (it runs on an angle to the northeast). Designing to 50 mph would raise this intersection significantly, which would then require the replacement of both of these Ulao Creek box culverts. As a high-quality waterway, we re required to avoid impacts to it whenever possible. Since we have an alternative that effectively avoids impacts, the Army Corps of Engineers and the DNR might be reluctant to approve a design that does not do so. If we establish the speed limit at 35 mph with a 40 mph design speed, we won t impact the box culverts at all, and there s an outside possibility we can avoid reconstructing the CTH C / Port Washington Rd. intersection as well. If that turns out to be the case, our project staging at this interchange will be greatly simplified. Attachment: CTH C - WisDOT 35 MPH Speed Study (2511 : CTH C Speed Limit) As we ve studied this corridor over the past two years, we ve met with developers and other local officials that have discussed this CTH C interchange area as more of an urban location, rather than rural. There is currently a gas station and a storage facility along the north side of CTH C west of I-43, and a park and ride lot on the north side east of I-43. Developers have various plans in the works for the south side of CTH C. Given this existing land use, motorists on CTH C drive well under the existing speed limit in the vicinity of I-43. This was confirmed by our recent speed study. Packet Pg. 27

The Ozaukee County officials are in favor of lowering the speed limit on CTH C, primarily to address the existing safety issues out there now, and to provide a better fit for the more urban nature of the area. They ve indicated it won t be difficult to convince the Ozaukee County Board to adopt this change. We re still in the corridor study phase of this project, so we don t have a let schedule for it yet. The most likely scenario seems to be construction in the 2020 2023 timeframe. With that being several years out yet, Ozaukee Co. would prefer to lower the speed limit ahead of our project (this year if possible). We re in favor of that as well, as it would address the existing safety concerns. BACKGROUND Listed below are the limits for the CTH C corridor and general information about the roadway. Highway: CTH C @ I 43 Ramps Project Limits: 900 E. of I 43 to 1800 W of I-43 Project Length: County: Municipality: AADT: Cross Section: Lane Width: Shoulder Width: METHODOLOGY Approximately 0.50 mile Ozaukee City of Mequon/City of Grafton 10,670 on CTH C at the northbound ramps, 18,360 on CTH C at the southbound ramps (Year 2011) 2-Lane Un-Divided Rural/ 4 lane Divided Rural 12 foot wide lanes 3 foot wide shoulders east of northbound ramps and 4 foot wide shoulder west of the northbound ramps The laser gun method was used to obtain the speed, recorded in miles per hour (MPH), of the approaching vehicles. The handheld device emits a laser beam that reflects off of moving vehicles. The device collects the returning beams and converts the amount of time for the beam to emit and return into an instantaneous speed measurement. A minimum sample size (number of observations) of no less than 100 vehicles per lane per direction was taken at each location. Additionally, the samples were taken during non-peak traffic hours within the weekdays of Tuesday through Thursday. These guidelines are followed to provide an accurate representation of the vehicle speeds within the study area. The intersection of CTH C and CTH W and the intersection of CTH C and I 43 northbound ramps are signalized. The intersection of CTH C and I 43 southbound ramps is a one way stop condition. All observations on the overpass and east of I 43 were taken during green signal conditions. Observations were taken on free flow conditions, when traffic was not accelerating or decelerating. 8.a.1.a The speed counts along CTH C were taken during the hours of 10:00 am to 2:00 pm on Tuesday, May 6, 2014. Speed counts were also taken Wednesday and Thursday, May 14 and 15, 2014 as well. There were sunny skies on May 6, 2014 and cloudy skies the rest of the study. There was no precipitation occurring throughout the study period. ACCESS POINTS/FUNCTIONAL CLASSIFICATION There are a total of six access points along CTH C where the speed study was conducted. One of those access points is a park and ride. Others include: two field entrances, two residential driveways and a business driveway. See figure 1 for locations. CTH C is classified Minor Arterial east of the I 43 northbound ramps and classified Principal Arterial from the northbound ramps of I 43 west past the study limits. A percentile speed is important in determining the appropriate speed that should be posted on a given roadway. The definition of a percentile speed is the speed at or below which a certain percentage of observed traffic travels. The 85 th percentile speed is an important benchmark in setting the speed limit for a given roadway. The Wisconsin Statewide Speed Management Guidelines considers the 85 th percentile speed to best represent the reasonable and proper speed perceived by motorists and is a key characteristic of traffic conforming to a safe and reasonable speed limit. A speed limit within 5 miles per hour of the 85 th percentile speed is a good starting point for a speed limit proposal, but the analyst should consider a full range of factors when developing a recommendation. The 50 th percentile speed, or median speed, may also be of interest when reviewing speed studies. Finally, the pace speed is a range of speeds that covers the highest number of observations from a given set of data. The pace speed is generated using a ten-mile per hour range. Last June, we bid the project, but due to complications with the Utility portion of the bid, the Public Works Committee agreed to reject all bids and re-bid the project. The Village of Fredonia has moved forward on their utility portion of CTH A/H, and is nearly complete with the water main replacement and will complete the sanitary sewer relining over the winter. Therefore, it will be appropriate to re-bid the CTH A/H Reconstruction in early 2015. In order to revise the plans and specifications to match the revised scope and timeline of the project, Ayres Associates has submitted the attached Amendment. The Amendment also covers several permits that need to be re-submitted due to the project delay. An additional amendment from Ayres Associates will be presented at a later date for the construction management of the project. However, this amendment should be addressed immediately due to the timeframe to allow bidding in early 2015. The cost of the Amendment will be split equally between the County and Village. ANALYSIS: Ayre s Associates Amendment is reasonable, and will allow the project to be bid during early 2015, which typically draws very good bid prices. 8.a.2.a AMENDMENT TO AGREEMENT Amendment dated November 4, 2014 The Agreement for Professional Services made as of September 27, 2013 between Ozaukee County Highway Department, 410 S. Spring Street, P.O. Box 994, Port Washington, WI 53074 (OWNER) and Ayres Associates Inc, N17 W24222 Riverwood Drive, Suite 310, Waukesha, WI 53188 (CONSULTANT) is hereby amended as set forth below. The CTH A Fredonia Avenue Reconstruction project was originally bid by Ozaukee County in May of 2014. At that time the project also included sewer and water reconstruction work owned by the Village of Fredonia. Upon review of the bids for the sewer and water work, the Village of Fredonia requested to remove part of the work associated with these items. Due to the costs associated with the removed items, Ozaukee County decided to rejected all bids for the reconstruction project. In August of 2014 the Village of Fredonia bid the sewer and water work separately. This work will be completed by November 30, 2014. This amendment is associated with the scope of services listed below to allow Ozaukee County to rebid the roadway reconstruction project in January/February 2015. Bidding Phase ATTACHMENT A - SCOPE OF SERVICES Ayres Associates will provide the following services related to the plan and specification preparation related to rebidding services: Re-kickoff Meeting with Ozaukee County and Village of Fredonia Modify, update, and revise Bid Documents to remove all associated water and sewer utility information and highlight the road and storm sewer work. Update benchmark information. Make revisions to sidewalk layout as per Village of Fredonia DPW. Resubmit WisDOT detour application. Resubmit/Update WDNR WRAPP (formerly known as NOI) application. Continue coordination with WDNR for Chapter 30 permit for the culvert. Coordinate/update with Wisconsin Southern Railroad for culvert replacement and roadway work (separate permits). Update construction specifications. Assist OWNER in advertising for and obtaining bids for a single prime contract for construction, materials, equipment and services; and, where applicable, maintain a record of prospective bidders to whom Bidding Documents have been issued, and receive and process deposits for Bidding Documents. This will be completed using the Quest website for bidding. Answer questions during bidding and issue addenda as appropriate to interpret, clarify or expand the Bidding Documents. Consult with and advise OWNER as to the acceptability of subcontractors, suppliers and other persons and organizations proposed by the prime contractor(s) (herein called "Contractor(s)") for those portions of the work as to which such acceptability is required by the Bidding Documents. The proposed purchase would replace a 1979 L8000 Distributor truck which has significant maintenance costs and 150,000 Miles. The search for a Distributor Truck has been difficult as new trucks cost over $180,000 and used trucks tend to be very deteriorated. In October, the Shop Manager located a 2006 Etnyre Centennial Distributor Truck from an asphalt firm in North Carolina. However, due to quick turnaround requirements to purchase the equipment, the Public Works Director informed the Public Works Committee of the equipment purchase at the November 5th meeting, and moved forward with the purchase. The Distributor Truck was purchased for $72,500, which was determined as follows: Agreed Upon Price: $82,000 Trade-In Value: - $8,000 Negotiated Reduction: - $1,500* FINAL PRICE: $72,500 *Upon inspection of the equipment, Highway Staff felt there was greater interior wear and tear than shown, so $1,500 was reduced from the price. ANALYSIS: The Distributor Truck has been inspected and delivered to Ozaukee County, but Highway Staff felt that the Public Works Committee should still be on the record of supporting the purchase, if appropriate. Additionally, due to the final cost ($72,500) being $12,500 over the budget cost ($60,000), Highway Staff proposes to utilize a portion of the $21,000 in proceeds from the sale of Highway Department equipment at the annual auction that occurred in October. Assistant Public Works Director Phone 262-238-8335 Fax 262-238-8343 8.b.1.a METHODOLOGY: In order to compare the actual Snow & Ice Control costs with estimated costs for the Town of Port Washington and Town of Saukville, two methods were considered: 1) Compare the Townships s 2013 & 2014 Year-to-Date costs to their previous 4-year average. 2) Compare the Town of Port Washington & Saukville s Snow & Ice Control costs to the other Townships served by Ozaukee County. Method #1 has a significant flaw, because each year is different based on the amount and timing of precipitation, and variation of temperatures. As an example, the Town of Port Washington varied between 146 Tons and 176 Tons of salt used annually, and between $28,000 and $39,000 of Winter Maintenance costs annually during the stretch from 2009 to 2012. However, Method #2 accounts for variation in year-to-year weather by comparing the Townships with other Ozaukee Townships. While each Township certainly has different expectations and variations of weather, I believe a consistent trend is shown, and therefore the analysis is sound. Comparing the winter maintenance costs and salt usage for the Towns of Port Washington & Saukville to the Towns of Belgium, Fredonia & Grafton ( Three-Town Total ) shows that regardless of annual weather variations, the Level of Service stability between the Townships is consistent. ANALYSIS: In line with my chosen Methodology, I focused my analysis on the comparison of the Towns of Belgium, Fredonia & Grafton to the individual Towns of Port Washington & Saukville. As salt costs are expected to jump in the private sector this year, the estimated cost differential would only increase. Due to the ability of the Highway Department to deploy a number of different pieces of equipment, such as Single-Axle & Tri-Axle Plow Trucks, V-Plow Trucks, Loaders, Graders, Snow Blowers attachment for the Loader, etc, we are able to reduce salt usage by applying mechanical methods to remove hard-pack snow on the roadway. Typically, private snow plows are required to use higher salt totals to burn the hard-pack snow off of the roadway. Assistant Public Works Director Phone 262-238-8335 Fax 262-238-8343 8.b.1.a The Town of Saukville recognized a 38% reduction in salt usage compared to the estimate due to a salt shortage during 2014. During the 2014 winter months, salt became scarce in a number of parts of the country which led to private snow plowing firms being cut off from salt supplies. Without salt, private snow plowers, including those in Saukville, were forced to mix salt with sand to extend their remaining salt supplies. Sand is significantly cheaper than salt, but does very little to maintain safe roads. Sand doesn t melt snow at all, but simply adds friction. However, after a very short period, the sand is compacted into the snow, and any friction value is lost. Additionally, communities that use sand create long term maintenance issues with sand filling up roadside ditches, and requests for road sweeping from bicyclists and motorcyclists due to loose sand on roadways. Therefore, based upon the statistics and other information, I believe that the Ozaukee County Highway Department continues to display effectiveness and value to the County, State and Towns of Belgium, Fredonia and Grafton through our Snow & Ice Control Operations.
