Modify the existing preferential parking permit zones on the 100 blocks of Spalding, Linden, South Roxbury, South Bedford, South Peck, and South Camden Drives, and the north side of Charleville Boulevard between Spalding and South Rodeo Drives, with a regulation of No Parking, 8 am. to 2:30 a.m., Daily, Permit AD Exempt. For City Council consideration, staff proposed a No Parking Anytime regulation in lieu of a No Parking, 8 am. to 2:30 a.m., Daily regulation to simplify signage language. INTRODUCTION This agenda report transmits a Traffic & Parking Commission (TPC) recommendation to establish the first area to test consolidating Preferential Parking Permit (PPP) Zones in the City. This area includes the multiple-family residential street sections on the 100 blocks south of Wilshire Boulevard between Spalding and Camden Drives (Test Area 1) with the following regulations: 100 South Bedford, Camden, Peck and Linden Drives: No Parking, 8 a.m. to 2:30 a.m., Daily, Permit AD Exempt 100 Spalding Drive: No Parking, 8 a.m. to 6 p.m., Monday to Saturday, Permit 5 Exempt 100 South Roxbury Drive: No Parking Anytime, Daily, Permit AA Exempt North side of Charleville Blvd between Linden and Rodeo Drives: 2-Hour Parking, 8 a.m. to 6 p.m., Monday to Saturday, Permit AA Exempt North side of Charleville Blvd between Spalding and Linden Drives: No Parking, 8 a.m. to 6 p.m., Monday to Saturday, Permit C Exempt 100 McCarty Drive (no PPP zone): 1-Hour Parking, 8 a.m. to 6 p.m., Monday to Saturday on east side of street and 2-Hour Parking, 8 a.m. to 6 p.m., Monday to Saturday on west side of street This area was prioritized as the first test district as the seven blocks are adjacent to each other and experience parking impacts from the adjacent Wilshire Boulevard businesses yet have differing parking regulations and permit zone designations. BACKGROUND In 2016, the City Council prioritized evaluating possible consolidation of PPP zones into districts as part of the Fiscal Year 2016-201 7 City Council Priorities. The goal for creating PPP districts is to provide one uniform parking regulation with the same letter/number designation on residential streets with common characteristics. A uniform regulation would simplify signage, streamline parking enforcement and permit issuance. In multiple family areas, a larger district provides more parking options. The TPC and staff developed a process for PPP districting in the City. The TPC also worked with staff in developing a comprehensive Frequently Asked Questions (FAQ) sheet to inform residents of the intent and benefits for consolidation of permit parking zones. The TPC prioritized implementation of the districts as follows: Page 2 of 6 10/3/2018

Camden Drives Phase 1 Consolidate multiple-family street blocks with similar parking characteristics via a City-initiated process. Phase 2: Pursue non-permit zone single-family street blocks north of Santa Monica Boulevard. Phase 3: Evaluate existing PPP zones on single-family street blocks south of Santa Monica Boulevard and group zones with similar permit regulations or characteristics. On August 22, 2017, City Council reviewed the TPC s proposed process to create PPP districts with uniform parking regulations and authorized staff to proceed with testing the following three multiple-family areas for parking permit districting: Test Area 1: 100 blocks south of Wilshire Boulevard between Spalding and South Camden Drives Test Area 2: Multiple-family zones bordered by Civic Center Drive, Doheny Drive, Burton Way, and North Maple Drive Test Area 3: Multiple-family zones bordered by North Almont Drive, Burton Way, North Clark Drive, and Wilshire Boulevard Upon completion of the first three test areas, staff would return to City Council with an evaluation and consideration of next steps. Staff anticipates initiating Test areas 2 and 3 in 2019. DISCUSSION In collaboration with the City Attorney s Office, staff developed two resolutions to address the TPC s recommendations to district Test Area 1. Resolution A establishes a PPP zone on the 100 block of McCarty Drive. Resolution B modifies the existing PPP regulations in Test Area 1 to have one consistent regulation and zone designation. Resolution A: Establish a PPP zone on the 100 block of McCarty Drive The 100 block of McCarty Drive is the only street block in Test Area 1 that does not have an existing PPP Zone. It has a non-ppp regulation of 1-Hour Parking, 8 a.m. to 6 p.m., Except Sunday on the east side of the street, and 2-Hour Parking, 8 a.m. to 6 p.m., Except Sunday on the west side of the street. There is a no parking street cleaning regulation from 9a.m. to 12p.m. on Wednesdays on the east side of the street. Staff followed the current City-initiated process in the Beverly Hills Municipal Code (BHMC 7-3-206) to establish a zone on the 100 block of McCarty Drive. This process includes sending a notice and survey card to each dwelling unit in the proposed district area. If not more than 40% of the households in a proposed district return a survey form objecting to the creation of the district, staff will proceed with conducting parking occupancy studies and provide a recommendation to the TPC. Staff mailed a resident survey and FAQ sheet on June 22, 2018 to approximately 87 multiple-family units on the 100 block of McCarty Drive. The survey asked residents whether or not they support the consolidation of PPP zones in Test Area 1 with a regulation of No Parking, 8 AM to 2:30 AM, Daily with one (the same) district/letter Page 3 of 6 10/3/2018

Commuter Meeting Date: October 9, 2018 PPP Zones Consolidation: 100 Blocks South of Wilshire between Spalding and S. Camden Drives designation. Surveys were submitted via standard post mail or online; only one survey response per dwelling unit was allowed. For 100 South McCarty Drive, staff received a total of 11 survey responses; three (3) residents supported and eight (8) residents opposed the consolidation of PPP zones in Test Area 1. I Street (100 Block South) Total Dwelling Units Yes No McCarty 87 3 8 As the survey results met BHMC requirements to establish a zone, staff conducted a parking occupancy survey on the 100 block of McCarty Drive from 8 am, to 8 p.m. on April 12, 2018. On average, 16 of 26 (62%) on-street parking spaces were occupied during the 12-hour survey period, with peak-hour occupancy of 96% recorded at 1 p.m. Of the occupied spaces, commuter vehicles occupied an average of 15 of 16 spaces (94%). A total of 106 vehicles, including 7 commuter and 1 resident vehicles with disabled placards, were recorded during the survey period. At the August 9, 2018 TPC Special Meeting, two residents on the 100 block of McCarty Drive spoke against establishing a PPP zone on McCarty Drive. Both residents stated that they did not want any changes on their street block. The residents expressed preference for the existing regulation as they do not need to obtain permits for their guests. They also had concerns that permit holders on adjacent streets would occupy parking spaces for long periods of time on their block. Resolution B: Modify the existing PPP regulations in Test Area 1 to No Parking, 8 am to 2:30 am, Daily, Except by Permit with Zone AD designation 1. Modify the existing PPP regulations in Test Area 1: The TPC recommended a regulation of No Parking, 8 am. to 2:30 am., Daily for Test Area 1 to match the regulation on the majority of the street blocks. Certain street blocks, such as 100 Spalding Drive, currently have PPP zone regulations that require modification. The 100 block of Spalding Drive currently provides open parking on Sundays and weekdays after 6 p.m. The PPP regulation on 100 Spalding Drive was modified via a Page 4 of 6 10/3/2018

Camden Drives city-initiated process in February 2016 from No Parking, 8 am. to 6 p.m., Monday through Friday to No Parking, 8 am. to 6 p.m., Monday through Saturday. The following areas in Test Area 1 have existing PPP regulations that require modification: 100 Spalding Drive: No Parking, 8 a.m. to 6 p.m., Monday to Saturday, Permit 5 Exempt 100 South Roxbury Drive: No Parking Anytime, Daily, Permit AA Exempt North side of Charleville Blvd between Linden and Rodeo Drives: 2-Hour Parking, 8 a.m. to 6 p.m., Monday to Saturday, Permit AA Exempt North side of Charleville Blvd between Spalding and Linden Drives: No Parking, 8 a.m. to 6 p.m., Monday to Saturday, Permit C Exempt 2. Establish one zone designation ( AD ) for the entire Test Area 1: The TPC recommended the PPP Zone AD designation for the whole Test Area 1 since majority of the street blocks (4 of 7) in Test Area 1 are currently designated as Zone AD. Below is a summary of the existing zone designations in Test Area 1. Staff surveyed the residents on the 100 blocks of Spalding, South Linden, South Roxbury, South Bedford, Peck, and South Camden Drives to gather input on the consolidation of PPP zones in Test Area 1. No public comment was received from the aforementioned street blocks at the August 9, 2018 TPC meeting. Page 5 of 6 10/3/2018

Camden Drives Public Notice Public notices advising of City Council review at the October 9, 2018 Formal Meeting were mailed on September 20, 2018 to all businesses and households located in the area bordered by Wilshire Boulevard, Lasky Drive, Olympic Boulevard, and Beverly Drive. Staff also mailed and faxed a notice to Good Shepherd Catholic School. Staff mailed a second notice to the businesses on the 100 blocks of Lasky and Spalding Drives to clarify that the consolidation of PPP zones will only apply to multiple-family residential street sections of Test Area 1. As of October 1, 2018, staff received one correspondence from a resident supporting a No Parking Anytime regulation and the inclusion of the Zone AA sections of Charleville Boulevard to the test district. RESOLUTION NO. 18-R- RESOLUTION OF THE COUNCIL OF THE CITY Of BEVERLY HILLS ESTABLISHING PREfERENTIAL PARKING PERMIT ZONE AD ON THE 100 BLOCK OF MCCARTY DRIVE BETWEEN CHARLEVILLE BOULEVARD AND THE ALLEY SOUTH OF WILSHIRE BOULEVARD WHEREAS, there is a non-permit parking regulation of 1-Hour Parking, 8 a.m. to 6 p.m., Except Sunday on the east side and 2-Hour Parking, 8 am. to 6 p.m., Except Sunday on the west side of the 100 block of McCarty Drive between Charleville Boulevard and the alley south of Wilshire Boulevard; WHEREAS, on September 7, 2017, the Traffic & Parking Commission recommended the consolidation of preferential parking permit regulations in the multiple-family zones on the 100 blocks south of Wilshire Boulevard between Spalding and South Camden Drives; WHEREAS, in accordance with Beverly Hills Municipal Code Section 7-3-206, Transportation Planning conducted a City-initiated review process to establish a preferential parking permit zone for the 100 block of McCarty Drive between Charleville Boulevard and the alley south of Wilshire Boulevard; WHEREAS, on August 9, 2018, after investigating the need to establish stich preferential parking zone, the Traffic & Parking Commission recommends that the City Council establish Preferential Parking Permit Zone AD with a regulation of No Parking, 8 a.m. to 2:30 a.m., Daily, Permit AD Exempt on the 100 block of McCarty Drive between Charleville Boulevard and the alley south of Wilshire Boulevard; NOW THEREFORE, the Council of the City of Beverly Hills does hereby resolve as follows: Section 1. Based upon the evidence and testimony presented to the City Council, including the information set forth in the Agenda Report, the findings required by BHMC Section 7-3-206(d) to B0785-0001\2221559v1.doc

justify establishing Preferential Parking Pennit Zone AD on the 100 block of McCarty Drive between Charleville Boulevard and the alley south of Wilshire Boulevard, can be made. Section 2. The Council finds that the following designated preferential permit zone is required due to commuter vehicles regularly interfering with available public street parking adjacent to residential property within the zone; such vehicles are the cause of unreasonable noise and pollution in the residential environment; and there is no reasonable alternative which is feasible or practical to redtice the identified street parking problem to acceptable levels. Section 3. I 11$ The City of Beverly Hills Traffic & Parking Commission (TPC) evaluated consolidating existing preferential permit parking (PPP) zones to allow for easier and more efficient parking for residents, and provide more options for resident permit holders to park. The TPC has identified the multi-family zones in the 100 blocks south of Wilshire Boulevard, between Spalding and Camden Drives, as the first test district since this area has similar parking regulations yet different PPP parking designations. The first step of the process is to survey residents in the test district to determine if there is interest from the community in consolidating PPP zones. Test District Map Per Beverly Hills Municipal Code (Section 7-3-206, Standard Criteria for Establishment of Preferential Parking Zones), a resident survey is required prior to initiating a review process for establishing a preferential parking zone. If not more than 40% of residents in a proposed project area oppose the creation of a zone, the evaluation process moves forward. For this test district, the 100 block of McCarty Drive is the only street block that does not have a permit parking regulation. The survey forms for McCarty Drive will be counted separately and, if not more than 40% of block residents oppose a permit parking regulation, staff will proceed with including it in the overall district. City of Beverly Hills Preferential Parking Permit fppp) Districting Frequently Asked Questions Who will benefit from PPP districting? All residents within the proposed district will benefit due to more efficient enforcement and permit issuance. With consistent regulations throughout the district, officers would be able to efficiently keep track of vehicles parked and cite potential violators. There would also be less signage clutter making signs easier to understand for residents and visitors. Residents could be allowed a wider parking area within a multiple-family district if an amendment to the Municipal Code is approved by the City Council. Currently, a resident who holds a valid preferential parking permit may use the permit for the purpose of parking on the street block adjacent to the dwelling unit of such resident or adjacent to the dwelling unit of another resident who resides in the same preferential parking zone while they are visiting such resident (BHMC 7-3- 21;). What is the problem the City is trying to solve by creating Districts? Currently, Beverly Hills has 73 PPP zones, many of which affect only one or two blocks. This system is difficult to administer and enforce and creates confusion for visitors and residents. Although many zones were created to address specific issues, the system has no criteria or thresholds other than a request from residents. The Traffic and Parking Commission and Transportation Planning staff try to be considerate and equitable regarding petitions but address each block individually, and petitioners cannot predict what the outcome is likely to be. Parking districts will allow fair access to parking, the preservation of the character of residential blocks, increase the rate and effectiveness of parking enforcement, and allow the Traffic and Parking Commission and Transportation Division to devote time and resources to broader issues of traffic and parking across Beverly Hills. Why is the City considering creating PPP districts? Consolidating PPP zones to create districts would address parking enforcement challenges; allow for timely establishment or modification of zone(s) and streamline the Traffic & Parking Commission and City Council review process. With consistent regulations throughout the district, officers will have a more simplified set of permits to enforce. PPP districting would also reduce signage confusion, making parking signs easier to understand. How will districts help with enforcement? We already have restrictions but they never seem to be enforced. One of the challenges for parking enforcement is the difference in parking restrictions from block-to block. If parking regulations were to be made consistent via the districting process, officers will be able to patrol districts more rapidly and efficiently, citing violators more efficiently. Why do you believe that districts will work as intended? Beverly Hills already has many blocks with identical restrictions, essentially creating de facto districts already. This leads us to believe that districts already work and that block-by-block parking restrictions are not in the best interest of the residents or the City. Preferential What changes would occur? Will the parking restriction(s) on my block change? There might or might not be changes. In many cases the current parking restrictions will continue as they are now. In other cases there will be changes. One way to estimate potential for change is to observe parking regulations on adjacent residential blocks. If there are different restrictions block-byblock, then there is a greater likelihood that a district will change some or all regulations to a common set of regulations. See example below: EXAMPLE (This is for illustration purposes only; the proposed regulation and district designation below has not been reviewed nor approved): The majority of the 100 blocks south of Wilshire Boulevard between Spalding Drive and South Camden Drive have a PPP zone regulation of No Parking with varying time periods and days. If a proposed regulation of No Parking, 8 a.m. to 2:30 a.m., Daily is recommended, then the regulations on the 100 blocks of South Roxbury and South Spalding Drives would be modified to match the district s proposed regulation. The 100 block of South McCarty Drive, which does not have a permit zone regulation, would be included with the district and would have the district s regulation. Preferential parking districts seem to strongly favor residents and are unfriendly to businesses, especially small businesses. Where will my business customers park? Beverly Hills strongly supports its businesses. But parking restrictions for residents are important to maintain the residential feel of our neighborhoods. Off-street and metered parking will continue to support most businesses in the city, even if it means that customers may need to pay instead of parking in front of homes. A discussion of parking alternatives with the Transportation Planning Division is welcome. Will every block in the City be part of a district? No. Large parts of the residential areas north of Santa Monica Blvd. will remain undistricted. These are generally unaffected by visitor and commercial parking pressures. Will districting allow overnight parking? No, unless your block already allows overnight parking. Although I have permit parking on my block, many spots are taken by cars with disabled parking placards. Will being part of a district change this? No. Disabled parking regulations will remain as they are. Will all districts have the same parking restrictions? No. Districts will be responsive to the nature of the parking pressures in the area. It would not be appropriate for multi-family zones to have the same restrictions as single family homes. The fine isn t deterring people gotten so bad that the neighbors know the employees names who park here and walk over to the businesses. And the area has many limo/car service drivers who park in these areas and the meters without paying since the premier hotels provide free service within a 3 mile radius. I shouldn t have to wait until 2:30am in the morning to find a parking spot on the street need it available when we come home from work. My first preference would be the No Parking Anytime except by permit because enforcement isn t working and the resident s of BH live here so we must have access to parking. If you have no parking from 8-23Opm, then when I drive to work and come home the parking still won t be available because the surrounding businesses close after 5pm. There are many parking garages, free 2 hour parking areas and meters available Beverly Hills parking for residents is a nightmare. in our small area of Additionally, the area in the pilot is where many apartments/condos/townhomes are located so parking is a necessity for residents in comparison to the neighboring areas with single family homes who have driveways and garages. **For this specific reason, can you please also include the AA permit parking on Charleville in the pilot? ** The surrounding area needs to be considered otherwise our parking issue will go from bad to even worse (non existent).
