Meeting Date: February 16, 2016 200 El Camino Drive DISCUSSION Background information is provided in the February 4, 2016 Traffic & Parking Commission staff report. Four residents from the 200 block of El Camino Drive spoke in support of a Sunday parking regulation at the February Traffic & Parking Commission meeting. Five letters in support of the permit modification were also received. The Traffic & Parking Commission noted their concern that no feedback was received from the businesses on South Beverly Drive. Public Notices advising of City Council review at the February 16, 2016 formal meeting were mailed February 5, 2016 to the same mailing list used for the Traffic & Parking Commission. Notices were mailed to residents on the 100, 200 and 300 blocks of El Camino Drive; the 200 blocks of South Rodeo Drive and South Beverly Drive; and residences and businesses of the 100 and 300 blocks of South Rodeo Drive and South Beverly Drive within a 500 radius of the project area. City-Initiated Review Per Beverly Hills Municipal Code Chapter 7, Article 2, Section 7-3-207 Modification of an Existing Zone, modifying an existing permit zone may be initiated (A) at the request of the Traffic & Parking Commission or City Council, or (B) a resident-initiated petition signed by a minimum of 60% of the residents on the affected street block(s). In February 2015, the single-family residents from the 200 block of El Camino Drive initiated a petition letter to add a Sunday permit parking restriction on the street block to address displaced resident parking generated by South Beverly Drive employee and commuter intrusion. The petition letter was signed by 21 of the 28 single-family homes and submitted to the City in March 2015. The petitioners were challenged with accessing apartment/condominium security buildings, but were able to obtain 10 of 54 signatures from the multiple-family dwelling units. The request for a City-initiated permit modification in lieu of a qualifying petition was reviewed by the City Council/Traffic & Parking Commission Liaison Committee on September 2, 2015 and referred to the Traffic & Parking Commission for consideration. On December 3, 2015, the Traffic & Parking Commission reviewed and supported a City-initiated process in lieu of a qualifying resident petition requiring a minimum of 60% (49/82) signatures. The Traffic & Parking Commission acknowledged the petition letter and attempts to secure signatures from the multiple-family buildings. RESOLUTION NO.1 6-R- RESOLUTION OF THE COUNCIL OF THE CITY OF BEVERLY HILLS MODIFYING PREFERENTIAL PARKING PERMIT ZONE D ON THE 200 BLOCK OF EL CAMINO DRIVE BETWEEN CHARLEVILLE BOULEVARD AND GREGORY WAY WHEREAS, pursuant to Beverly Hills Municipal Code Section 7-3-207(a), modifying an existing permit zone may be initiated at the request of the Traffic & Parking Commission or City Council; WHEREAS, there is an existing permit parking regulation of No Parking Anytime, Monday through Saturday, Permit D Exempt on the 200 block of El Camino Drive between Charleville Boulevard and Gregory Way; WHEREAS, on September 2, 2015, the City Council and Traffic & Parking Commission Liaison Committee concurred that the Traffic & Parking Commission review a resident request for a City-initiated review process to modify the existing permit regulation on the 200 block of El Camino Drive in lieu of a qualify resident-initiated petition signed by 60% of the residents on the affected street block(s); WHEREAS, on December 3, 2015, the Traffic & Parking Commission reviewed and supported a request for a City-initiated review process for the 200 block of El Camino Drive between Charleville Boulevard and Gregory Way; WHEREAS, the City-initiated permit modification requested adding a Sunday parking permit regulation to address commuter parking; WHEREAS, on February 4, 2016, the Traffic & Parking Commission investigated the need to modify the Preferential Parking Permit Zone on the 200 block of El Camino Drive between Charleville Boulevard and Gregory Way; B0785-0001\1924029v1.doc -1-

WHEREAS, on February 4, 2016, the Traffic & Parking Commission recommended modifying the regulation to No Parking Anytime, Monday through Saturday, Permit D Exempt on the 200 block of El Camino Drive between Charleville Boulevard and Gregory Way to add a Sunday regulation; and WHEREAS, following parking occupancy studies and field checks, Transportation Planning staff supported a No Parking Anytime, Permit D Exempt to address commuter parking on the 200 block of El Camino Drive between Charleville Boulevard and Gregory Way; WHEREAS, Transportation Planning has reviewed the proposed project and has determined that the project is not subject to the California Environmental Quality Act and has issued a Categorical Exemption; follows: NOW AND THEREFORE, the Council of the City of Beverly Hills does hereby resolve as Section 1. Based upon the evidence and testimony presented to the City Council, including the information set forth in the Agenda Report, the findings required by BHMC Section 7-3-206(d) to justify modifying Preferential Parking Permit Zone D on the 200 block of El Camino Drive between Charleville Boulevard and Gregory Way can be made. Section 2. The Council finds that the following designated preferential permit zone is required due to commuter vehicles regularly interfering with available public parking adjacent to residential property zone; or that such vehicles are the cause of unreasonable noise and pollution in the residential environment; or that there is no reasonable alternative which is feasible or practical to reduce the identified street parking problem to acceptable levels. Section 3. The City Council hereby approves modifying Preferential Parking Permit Zone D on the 200 block of El Camino Drive between Charleville Boulevard and Gregory Way B0785-0001\1924029v1.doc -2-

subject to the provisions of the Beverly HillsMunicipal Code Section 7-3-206(d), with a regulation of: No Parking Anytime, Permit D Exempt Section 4. Correspondence Minutes (Excerpt) This report outlines a City-initiated review to modify of the existing preferential parking permit regulation on the 200 block of El Camino Drive. Staff recommends modifying the existing No Parking Anytime, Monday through Saturday parking regulation to add a Sunday restriction as follows: Background No Parking Anytime, Permit D Exempt The 200 block of El Camino Drive is composed of 28 single-family homes and six multiplefamily buildings with 54 dwelling units. There is no intersecting alleyway between the single and multiple-family buildings. The existing permit regulation of No Parking Anytime, Monday through Saturday, Permit D Exempt was established in February 1979 (79-0-1725) to address resident parking displacement generated by employees and patrons visiting the adjacent Wilshire Boulevard and Beverly Drive commercial corridors. Archive records include a petition signed by 79% (22 of 28) of the single family homes on the 200 block of El Camino Drive. In February 2015, the single-family residents from the 200 block of El Camino Drive submitted a letter to add a Sunday permit parking restriction on the street block to address South Beverly Drive employee and commuter intrusion. Discussion Staff conducted a parking occupancy survey on Sunday, January 10, 2016 from 10 a.m. to 4 p.m. In addition to the parking occupancy survey data collected by the Traffic Engineering

On average, 91% (51 of 56 spaces) of the residential parking spaces were occupied during the 6-hour survey period, with peak-hour occupancy of 96% recorded at the 2 p.m. hour. On average, 76% (39/51) of the spaces were occupied by commuter vehicles. The adjacent sections of Charleville Boulevard and Gregory Way have four parking spaces east of El Camino Drive; all eight spaces were occupied throughout the survey period. Based on high commuter occupancy and long-term parking, and the lack of an enforcement tool to regulate vehicle turn-over on Sunday, staff recommends modifying the existing permit regulation to add a Sunday restriction, except by resident permit. Noticing Notices advising of the February 4, 2016 Traffic & Parking Commission meeting were mailed on January 25, 2016 to residents on the 100, 200 and 300 blocks of El Camino Drive; the 200 blocks of South Rodeo Drive and South Beverly Drive; and residences and businesses of the 100 and 300 blocks of South Rodeo Drive and South Beverly Drive within a 500 radius of the project area. During the week, it is often impossible to find a space, in overnight and daytime zones, and when anyone parks in our zone on Sunday I never get a parking space. Therefore I approve of the no parking regulation except for Permit D to include Sunday as well. Permit D users have so little space in comparison to people like Permit C holders therefore, it is unfair that on days like Sunday our little bit of space can be used by people who do not even reside in our area. We pay high rent and taxes to live here therefore the least you could do is make sure we can park on our street no matter what day it is. And there are still plenty of 2 hour parking except Sunday zones near the heart of Beverly Hills for people to park freely on Sundays. Also do not allow livery and limo and car service drivers to take up our parking spaces while they wait for their passengers. It is noisy when I am trying to sleep with their engines running and they unfairly hog our spaces and make it hard to park during the day when I come home. On a whole OTHER IS SUE, the majority of people in our parking zone have terrible parking etiquette in terms of taking up empty space from doing sioppy parking jobs. There should be a pasted set of rules for proper parking etiquette so spaces are not wasted and there should some penalties like tickets or being towed if people do not follow the proper parking rules. There are often limited spaces available because of sloppy parking jobs. Also more importantly, if you could fix it, Permit D users need MORE overnight parking space and should able to park ANYWHERE overnight in the Permit D zone with the overnight permit rather than the small fraction of the block you let Permit D users park overnight in. In all, your parking situation is flawed and nonsensical, and it needs to be fixed. It makes my life so stressful and miserable living here at times because I often have to stress over not getting a parking space to leave my car during the day or at night when I come home. Currently, there is no permit requirement for Sundays and that makes it very difficult for us residents to find street parking on El Camino. Furthermore, on weekdays there are a number of people who borrow permit tags from residents and park their cars on El Camino all day while they go to work on adjacent streets. I have observed a black Chevrolet arriving daily at 5:00 am and not leaving until 12-14 hours later. While I am not certain, it appears that this person is coming from another community and using up our parking privileges. This type of behavior makes the parking availability increasingly difficult on street sweeping days. Finally, there are those who use handicap tags unlawfully to park in our valuable spaces. This is especially difficult for us when they take up our spaces overnight. However, in this case, I do understand that there may be little or nothing that can be done. As residents, we support this modification request, as it would enhance residents ability to utilize street parking for theft own needs, and for visiting family and friends. Due to our proximity to the businesses of S. Beverly Drive, parking on our street is challenging most days (We have never seen so many able-bodied drivers with handicap permits!). But parking is particularly difficult on Sundays. Currently, street parking is filled up very early every Sunday morning. Furthermore, unlike the turnover in street parking that occurs Monday-Saturday, Sunday parkers, for the most part, are in place for the majority of the day, leaving residents little or no street parking access. The long hours suggest these cars are not being parked to access Beverly Drive, so a change should not present a negative impact to businesses there. The residents of El Camino are not opposed to sharing our street for short-term parking needs of other area residents and visitors. However, we are not really sharing on Sundays, as our street s parking is taken first thing, and by all-day parkers. We respectfully ask that you align restrictions for all seven days of the week, so we have some opportunity to utilize our street on Sundays. Thanks again for your review of this issue.
