7 CONDITIONS OF SALE The highest bidder to be the purchaser but with the Auc oneers reserving the right to refuse the bidding of any person without giving reason and if a dispute should arise as to the iden ty of the highest bidder, the Lot in dispute shall be immediately put up again and resold. The Auc oneers reserve the right to arbitrate solely any disputed ma er connected with the offering of Lots at the Sale and their decision shall be binding on all par es. No person shall be allowed to retract any bidding once made. The Auc oneers reserve the right to bid on behalf of both vendors and purchasers but shall not be liable for errors or omissions in execu ng instruc ons to bid. Commissions to purchase Lots are accepted only at the purchasers' risk. All Lots offered for sale are exhibited with any faults or errors of descrip on whether they be related to quality, quan ty, weight, number, addi onal informa on or the like. The Auc oneers act as agents only and do not have personal knowledge as to the accuracy or correctness or otherwise of the descrip on of any Lots offered for sale and give no warranty whatsoever. All warran es, either expresses or implied by sec ons inclusive of the Sale of Goods Act 1979 or at commonlaw are expressly excluded from this Sale. At the fall of the hammer each Lot shall be considered as delivered and at the purchaser's risk thereon. All purchasers are required to leave their full name and address at the Auc oneer's Office. No Lots shall be removed un l paid for. The purchaser shall be responsible for and shall duly iden fy the Auc oneers and the owners of the property on which the sale is conducted, against any damage caused to buildings or property or any other Lot at the Sale any damage occasioned and consequen al loss shall be made good by and at the expense of the purchaser. The Auc oneer shall be under no liability whatsoever for any damage to the property of the purchaser at any me. Any person entering onto the premises / sale ground at any me prior, during or a er the Sale shall do so en rely at their own risk. The contract of sale is to be deemed in all cases as being made exclusively with the Auc oneers as Agents for the vendors and payment shall be made to them only. Health & Safety at Work Act 1974 and all other Acts and Regula ons applicable to Farm Safety and Electrical Equipment The purchaser is responsible for complying with all the legal requirements as to the safe use of any Lot purchased at the Sale and shall ensure compliance with all relevant legisla on rela ng to the safe use of such Lots. The auc oneers shall not be liable for any expense, loss, claim or proceedings in respect of personal injury to or death of any person arising out of or in the course of or caused by the Sale. Compliance with the Road Traffic Acts The purchaser of any vehicle or trailer is responsible for complying with all legal requirements as to the construc on and use of such vehicle or trailer, and for obtaining all cer ficates, permits or other authorisa ons necessary before such vehicle or trailer can be used on the road. The Auc oneers reserve the right to vary the order of sale, to combine two or more lots and to withdraw any lots and generally to conduct the sale in the manner in which they so decide at the me of sale. VAT & Commission Lots will have VAT (at 20%) payable on them. It will be indicated in the Lo ed Catalogue (available on the viewing & Sale days) whether VAT is chargeable on a par cular Lot (marked with a * ). Commission at the rate of 5% plus VAT will be payable on all Lots. Payment All items purchased shall be paid for on the day of the sale immediately at the conclusion of the auc on. Purchasers wishing to pay by cheque who are unknown to the Auc oneers must produce the relevant reference from their Bank indica ng a maximum amount that will be honoured. We will be taking card payments on the day. In order to comply with the 2003 money laundering regula ons, no cash payment for sums in excess of 7,500 can be accepted.
