31 Why all these regulations!?! Trucking school owner helped students cheat on CDL knowledge tests and provided false certification documents to satisfy Florida CDL residency requirements. School s third party contractor passed drivers even with known automatic failures on skills tests. Also passed drivers who were known to not be proficient in English. Approximately drivers obtained fraudulent CDL s. FLORIDA

33 Why all these regulations!?! Three truck driving school owners and three California DMV employees conspired to issue CDL s to drivers without passing the tests. Approximately 100 CDL s were issued at $5,000 per license, the money going to the driving school owners. Driving school owners bribed DMV employees to access the DMV computer database and modify/falsify the state database. Up to 23 crashes attributed to drivers issued the fraudulent CDL s. CALIFORNIA

35 Why all these regulations!?! Third party skills test examiner falsified CDL test results. Accepted cash payments in exchange for a skills testing certificate. Drivers never tested and used the false certificates to obtain a CDL. A compliance review discovered the examiner had tested a large number of CDL candidates with no failures. The examiner admitted to issuing certificates to 250 drivers and 320 were eventually re-tested. LOUISIANA

37 Why all these regulations!?! Third Party Skills Test Examiner was certified by the state to test for a fire department s employees only. While employed by the fire department the examiner started testing non-department drivers. Examiner did not require pre-trip, skills or road tests. He also used unapproved testing locations. Investigation conducted by the US DOT, the Federal Motor Carrier Administration and the South Carolina DMV. SOUTH CAROLINA

39 Why all these regulations!?! Two third party testers in Missouri were charged with not properly testing drivers. Drivers were coming to these two testers from long distances, which caught the attention of authorities. Auditors realized some CDL tests were completed in 10 minutes with some instances of no tests conducted at all. Missouri issued re-test letters to 2,000 drivers and had to stagger the test schedules because of the high number of re-tests. MISSOURI
40 Future: ELDT - Entry Level Driver Training Discussed since 1980 s; Negotiated Rulemaking made it finally happen. The ELDT rule will be implemented on February 7, Recommended ELDT elements: Certified trainers, set curricula based on theory (knowledge) and behind-the-wheel segments. Training provider registry similar to Medical registry. No set hours of behind the wheel training.
41 Other potential Federal rule changes: All-electronic medical reporting Changes to Diabetes exemption program. More focus on obstructive sleep apnea. Rules on coercion / harassment. Drug and alcohol clearinghouse.
