2 Background At the 2014 Annual Meeting [TAD/CA/T/M(2014)1], the Secretariat provided a draft synthesis of the Energy Efficiency Questionnaire [TAD/CA/T(2014)3]. The questionnaire collected information regarding several topics related to Energy Efficiency in Member countries. In particular, the questionnaire covered current regulations on energy efficiency and emissions; the technology being used or available within Member countries to improve energy efficiency; the number of operating tractors and their potential market; particular studies or research conducted at national level in the energy efficiency area and the use of alternative fuels and engines (e.g. biofuels, hydrogen and electric tractors). All surveyed countries recognized the importance of energy efficiency and tend to encourage this either through regulation or incentives/subsides to promote the use and the development of more energy efficient equipment in all sectors of the economy, including agriculture. Most countries monitor emission controls and regulations applied to vehicles and industry. Few countries extend emissions and energy legislation to agriculture. Only China, Korea, and Spain have specific official tractor energy efficiency legislation. An additional finding is that the exact number of tractors in use in Member Countries is rather difficult to assess. Official statistics vary from country to country and not all tractors are registered in the same way. In most cases the data refers to official estimates, rather than to actual data. In light of the above findings, Delegates requested further analysis of key issues and to present a new report to the next Annual Meeting. One topic is to identify a definition of a tractor and the different type of uses that tractors can have. It is clear that there is no common definition in member countries and, there is no clear indication of the numbers of tractors in use in member countries. The various definitions of a tractor were discussed at the Technical Working Group (TWG) Meeting in Ankara (June 2014) [TAD/CA/T/M(2014)2] and it was agreed that the Secretariat circulate a short draft questionnaire to Member Countries to analyse the degree of tractor definition discrepancies. If possible, a unique harmonised definition would be developed for all OECD Tractor Codes Member countries. Additionally, at the TWG Meeting in Ankara [TAD/CA/T/M(2014)2] it was agreed that the Secretariat would also ask Member countries about High-Clearance Tractors. The TWG agreed that the Secretariat prepare a questionnaire to ask delegates if they have these types of tractors in their countries and if it is worth developing an ad-hoc code. 2

4 Table 1 provides a brief overview of the tractor definitions used by various international organisations. Although the definitions are similar, there are subtle differences that can lead to different classifications or registrations of tractors. One example is the inclusion of passengers in the definition of tractors ( may be equipped to carry a load and passengers). Including the word passengers widens the scope of machines that can be classified as tractors. The definitions applied at national level may also differ. Therefore, the Secretariat will circulate a short draft questionnaire to analyse the degree of this discrepancies and afterwards suggest a unique harmonised definition that should be applied by Tractor Codes Member countries. The draft questionnaire can be found in the ANNEX. HOW TO FILL THE QUESTIONNAIRE Each National Designated Authority is requested to answer the questionnaire. NDAs can coordinate or delegate the answers of a particular question to relevant Ministries, departments or organizations within their country. The Questionnaire consists of 5 broad questions. Each question has a subset of topics/areas that should also be addressed when answering. After each question a blank space is provided, however, if necessary, additional pages can be added. Please keep in mind that the answers need to reflect the current Government position, if any, of each Member Country. 5 DEFINITIONS DRAFT QUESTIONNAIRE ON TRACTOR DEFINITIONS 1. How does your country define an agricultural and forestry Tractor? o Explain the different types of agriculture uses for tractors in your country? o Specify if tractors are allowed to carry passengers in your country o Additional information/comments In France we have exactly the same definition as in the EU regulation for tractors. In fact the first article of or decree of transposition into our national law of the directive 2003/37/EC states that all the definitions of directive 2003/37/EC article 2 shall be applied. It means that both for safety at work (Labour Code) and safety on road (road traffic act) we have and use the same definition. But on fringe vehicles we could have some little discrepancy. Especially when people focus only on technical requirements and forgot the definition. For the French ministry of agriculture we try to firstly look at definition. The main function lies in its tractive power: The vehicle shall have at least one linkage device (drawbar, yoke, hook, Piton) to transmit its tractive power and this linkage device shall be in accordance with a standard dedicated to agricultural vehicle And Specially designed to tow, push, carry or power certain tools, machinery or trailers intended for agricultural or forestry use: The vehicle shall have at least another device to tow, push, carry or power agricultural equipment. This device could be a PTO or a three points linkage. The device shall be in accordance with a standard dedicated to agricultural vehicles. A tractor is allowed to carry passengers provided that it has been foreseen in the type approval. It means that all the seats for passengers shall fulfil the technical requirements that apply. This define the number of passengers that could be carried. 5

In your opinion, what is the best definition of a tractor? o Explain which are the main criteria that should be considered in the definition o Additional information/comments The best definition is a definition based on design criteria and not on use. The one we have in the EU is not so bad even we have some fringe vehicles that could be considered both as a multipurpose machine or dedicated tractor. If the level of safety is equivalent this is not a problem. 7

NDA s are requested to share their views on the role of OECD in developing ROPS for High-Clearance Tractors o Should OECD develop an ad-hoc Code for High-Clearance Tractors? o Additional information/comments If high-clearance tractors are not only a French concern why not. Furthermore it should be useful in a near future to fully implement the EU regulation 167/2013 for T4.1 tractors. 9
