3 FMCSA Challenges Only 12,000 out of 750,000 carriers are contacted by FMCSA annually Presently, the only formal contact is a Compliance Review SafeStat is used to locate carriers for auditing CSA 2010 Uses seven BASICs (Behavior Analysis and Safety Improvement Categories) to analyze carriers Unsafe driving Fatigued driving/hours of service Driver fitness Controlled substance and alcohol Vehicle maintenance Improper loading/cargo securement Crash indicator CSA 2010 Safety Fitness Determination (SFD)/Evaluation 1. Continue to Operate (no contact) 2. Marginal (progressive interventions) 3. Unfit (correct or cease operations) (unable to enforce until regs are passed) 3
4 CSA 2010 Safety Fitness Determination (SFD) Each BASIC has two thresholds: Intervention required Failing (unfit) Any BASIC above threshold = Intervention If unfit in a stand alone BASIC, carrier declared unfit If unfit in more than 1 non-stand alone BASIC, carrier declared unfit (1 stand alone is marginal ) CSA 2010 How do BASICs work? 4

Driver Fitness Gym Membership Driver Fitness = Driver Qualifications Fines $500 - $11,000 depending on the violation Acute Violations Allowing a driver to drive while having a suspended or revoked license Allowing a driver to drive while disqualified Using a physically unqualified driver no medical card False entries on a medical exam or certificate 5
6 Critical Violations Inquiries into previous employment Failure to maintain qualifications on a driver Driver not having a valid medical card for one reason or another Roadside Violations 4 Medical certificate not in driver s possession 5 Unable to communicate with officials or the public 11 Expired medical exam certificate 14 Operating a CMV requiring a CDL without the CDL 15 Driver lacking a valid license 18 Driving a CMV while disqualified 20 Driver lacks physical qualifications DQ Requirements DQ File Contents The following documents are to be included in a DQ file for each regularly employed driver: Application for employment ( ), Motor vehicle record (MVR) from states ( ), Previous employer information ( ), Road test form and certificate ( (g)), or license or certificate accepted in lieu of road test ( ), Medical exam certificate, original or a copy ( (g)), Any letter granting a waiver of a physical disqualification, Annual motor vehicle record ( ), Annual review of driving record ( ), and Annual list of violations ( ) 6
