1 English version of Executive Order on vehicles' technical compatibility with the rail network (Bekendtgørelse nr af 30. november 2012) Preface Please note that the English version is for informational purposes only. Where the wording in the Danish and English versions may conflict, the Danish version prevails.

2 Order No.1127 of 30 November 2012 Order on vehicles' technical compatibility with the rail network 1) In pursuance of Article 21h (1.1), Article 21k (5-6), and Article 26 (1.1) of the Rail Act cf. Consolidation Act No of 11 November 2010, the following is set by authorisation in accordance with Article 24 (1): Scope of application Article 1. The Order lays down provisions on the technical compatibility requirements for vehicles which must be approved for use on the section of the Danish rail network covered by European Parliament and Council Directive 2008/57/EC of 17 June 2008 on the interoperability of the rail system within the Community, with subsequent amendments (hereinafter referred to as the Interoperability Directive). Article 2. The following definitions apply to this Order: Definitions 1) A-regulation: Other countries' regulations or international standards which are equivalent to equivalent Danish requirements and which are categorized as an A-regulation in the national reference document published on the European Railway Agency's web site. 2) Notified bodies: The bodies tasked with assessing conformity or suitability for use of interoperability constituents and with conducting the EC verification procedure for the subsystems. 1 The draft Order has been notified in accordance with Directive 98/34/EC of the European Parliament and of the Council (the information directive) as amended by Directive 98/48/EC.

3 3) Existing vehicle: A vehicle which is, or has been, in operation in Denmark or in other countries. 4) Compatibility certificate: The certificate which is prepared by the designated body as documentation that the vehicle type is compatible with the network. 5) Vehicle: A railway vehicle with or without motive power, which runs on its own wheels on a railway section. A vehicle consists of one or more structurally or functionally defined subsystems or parts of such subsystems. 6) National technical regulations: The national, technical regulations which Denmark, in pursuance of the Interoperability Directive's Article 17.3, has notified The EU Commission (also called notified national technical regulations). 7) Technical compatibility: A vehicle's technical compatibility with the infrastructure at the network level. Route specific conditions are not included in the verification of technical compatibility. 8) TSI LOC&PAS: Commission Decision of 26 April 2011 concerning a technical specification for interoperability relating to the rolling stock subsystem Locomotives and passenger rolling stock of the trans-european conventional rail system (Official Journal 2011 No. L 139, pgs ) implemented by Order No of 12 December 2011 on locomotives and passenger cars, which are used on the Danish railway network. 9) TSI WAG: Commission Decision of 28 July 2006 concerning the technical specification of interoperability relating to the subsystem rolling stock freight of the trans-european conventional rail system (2006/861/EC) with later amendments. 10) Open points: Points that relate to topics that are identified as important, but are not included in a TSI. This can be due to a lack of agreement on a joint solution, that the topic is considered to be handled in another TSI. 11) Designated bodies: The bodies that are responsible for evaluating whether a vehicle is in accordance with notified national technical regulations. Approvals procedure and technical requirements Article 3. A compatibility certificate can only be issued where a designated body, cf. paragraph 2, no. 11, has verified that a vehicle type conforms with the requirements in Annex 1. The designated body uses the following columns in Annex 1: 1) If a vehicle is verified in accordance with TSI LOC&PAS cf. paragraph 2, no. 8, by a notified body, then column 1 is used.

4 2) If a vehicle is verified in accordance with TSI WAG cf. paragraph 2, no. 9, by a notified body, then column 2 is used. 3) If a vehicle is verified in accordance with Order No. 542 of 12 June 2012 on technical requirements for on-track machines by a designated body, cf. paragraph 2, no. 11, with the authority to do this, then column 3 is used. 4) In other situations, including the approval of existing vehicles, then column 4 is used. Paragraph 2 No additional controls of the relevant parameter are to be carried out where an approval issued in another country documents compliance with A-regulations for the given Annex 1 parameter. Paragraph 3 The compatibility certificate is to be prepared in accordance with module SB cf. Commission Decision 2010/713/EU of 9 November 2010 on modules for the procedures for assessment of conformity, suitability for use and EC verification which are to be used in the technical specifications for interoperability adopted under Directive 2008/57/EC of the European Parliament and of the Council. Paragraph 4 Documentation of technical compatibility, cf. Annex 1, which is to be verified for serie vehicles, is to be included in the vehicle's technical dossier. It is to be stated separately on the verification certificate which requirements have been controlled in relation to technical compatibility. Closing of open points in TSI LOC&PAS Article 4. The Order closes the following open points in TSI LOC&PAS, cf. Annex 1: 1) Point (monitoring of shaft bearing condition). 2) Point (dynamic properties when in motion) and point (wheel set equivalent conicity). 3) Point (brake system, which is independent of adhesion conditions). 4) Point (contact piece material). 5) Point (lowering of pantograph). Closing of open points in TSI WAG Article 5. The Order closes the following open points in TSI WAG, cf. Annex 1: 1) Point (sensor for overheated shaft bearing). 2) Point (crosswinds).

6 Annex 1 Regulations for Technical compatibility between vehicles and the rail network Relevant compatibility points specified and numbered in accordance with the parameter list in Commission Decision 2009/965/EC 1. General documentation 1.1 General documentation National regulations for passenger trains and locomotives (cf. Order No of 12 December 2011) TSI LOC&PAS section 4.8. National regulations for freight (cf. TSI WAG, 2006/861/EC) section National regulations for on track machines (cf. Order No. 542 of 12. June 2012) A filled in parameter list is to be available cf. Track interaction and gauging Vehicle gauge TSI WAG section EN section 5.1 The vehicle gauge must not exceed DSB ref. line 1992 calculated in accordance with UIC or EN , 2 and 3, and is to be unambiguously identified Running safety and dynamics TSI WAG section EN section 8 The prevention of derailment when running across distorted track and dynamic properties in motion are to be verified. The following standards are accepted: EN or UIC 518.

8 3.2.2 Equivalent conicity, wheel profile and limits A) Equivalent conicity: The equivalent conicity is to at maximum increase by 0.05 in operational situations in relation to the equivalent conicity derived in test runs associated with type approval, as specified in section in EN The equivalent conicity is to be calculated in the same way and under the same track conditions as operational situations and as used in the test runs associated with type approval. 11 4.4.1 Emergency braking command Not relevant for machines Vehicles for use in tunnels are to be fitted with a locomotive driver operated override for all emergency brake release switches in passenger areas (NBO) Magnetic track brake Eddy current track brake 5. Passenger-related items Eddy current rail brakes must not be used in Denmark. It is to be documented that the system is deactivated. Swedish and German signalling (position and function) are accepted.
