1 City of Texarkana, Texas Personnel Policy Manual Computers, Phones, and other Electronic Devices Effective Date Amended Date Review Date Pages January 1, 2010 January 1, COMPUTERS, PHONES, AND OTHER ELECTRONIC DEVICES This directive is for the City of Texarkana, Texas internal use only and does not enhance an employee s civil or criminal liability in any way. It should not be construed as the creation of a higher standard of safety or care in an evidentiary sense, with respect to third party claims. Violations of this operations directive, if proven, may only form the basis for a complaint by the City of Texarkana, Texas in a non-judicial, administrative setting. A. Definitions 1. Computer Information Services (CIS) is the Computer Information Services Division of Texarkana Water Utilities is currently charged with the duty of operation and maintenance of the City of Texarkana, Texas computer network. In addition CIS is responsible for administering the information security functions within the City s network. The CIS Division is the City s sole point of contact for information regarding the security of City information resources, and the primary advisor regarding technology solutions for the City of Texarkana, Texas. 2. The Computer Information Services Manager (CIS Manager) is responsible to the City of Texarkana, Texas through the Executive Director of Texarkana Water Utilities for management of the city s information resources. The information resources manager is responsible for advising the City Manager and Department Heads on issues of technology and network security, providing for effective coordination of the City s information and technology activities, and ensuring the efficient application of technology and exchange of electronic information between City departments and others with whom the City transacts business. 3. The electronic mail system is any computer software application that allows electronic mail to be communicated from one computing system to another. 4. Electronic mail ( ) is any message, image, form, attachment, data, or other communication sent, received, or stored within an electronic mail system. 5. Information Resources are any and all computer printouts, online display devices, magnetic storage media, and all computer-related activities involving any device capable of receiving , browsing Web sites, or otherwise capable of receiving, storing, CITY OF TEXARKANA, TEXAS PERSONNEL POLICY MANUAL 1 of 9
2 managing, or transmitting electronic data including, but not limited to, mainframes, servers, personal computers, notebook computers, hand-held computers, personal digital assistants (PDA), pagers, distributed processing systems, network attached and computer controlled medical and laboratory equipment (i.e. embedded technology), telecommunication resources, network environments, telephones, fax machines, printers and service bureaus. Additionally, it is the procedures, equipment, facilities, software, and data that are designed, built, operated, and maintained to create, collect, record, process, store, retrieve, display, and transmit information. 6. Internet is a global system interconnecting computers and computer networks. The computers and networks are owned separately by a host of organizations, government agencies, companies, and colleges. 7. Intranet is a private network for communications and sharing of information that, like the Internet, is based on TCP/IP, but is accessible only to authorized users within an organization. It is a closed network of computers across a local area network that work together to share information in a secured environment. 8. User is an individual or automated application or process that is authorized access to the resource by the owner, in accordance with the owner s procedures and rules. 9. Vendor is someone who exchanges goods or services for money. 10. World Wide Web is a system of Internet hosts that supports documents formatted in HTML (HyperText Markup Language) which contains links to other documents (hyperlinks) and to audio, video, and graphic images. Users can access the Web with special applications called browsers, such as Netscape, Navigator, and Microsoft Internet Explorer. B. General Policy Statement Information resources are the property of the City of Texarkana, Texas, and those resources must be managed in a manner that protects the interest of the City of Texarkana, Texas. The purpose of this policy is: 1. To ensure compliance with applicable statutes, regulations, and mandates regarding the management of information resources. 2. To establish procedures regarding the use of all information resources, including but not limited to , instant messaging, and the Internet. 3. To educate employees who in the course and scope of their work may use information resources, , the Internet, or the Intranet. 4. To ensure the security of the City s computer network. 3 5. To ensure that all information resources are used in a manner that promotes efficiency in our City government. C. Ownership Electronic files created, sent, received, or stored on information resources owned, leased administered, or otherwise under the custody and control of the City of Texarkana, Texas are the property of the City of Texarkana, Texas. D. Privacy Electronic files created, sent, received, or stored on Information Resources owned, leased, administered, or otherwise under the custody and control of the City of Texarkana, Texas are not private and may be accessed with the City Manager s authorization by CIS employees at any time without knowledge of the employee. Department Heads may access and view any electronic files within their respective departments. E. Responsibility The Department Heads, supervisors and all other employees have the responsibility for assuring full compliance with the provisions of this policy. and Internet users each have the responsibility to stay informed regarding City information that is disseminated electronically. This includes understanding and keeping current on issues regarding system operations. F. Disciplinary Actions Violation of this policy may result in disciplinary action up to and including termination. Users outside the City Any entity using the Texarkana, Texas computer network outside the City of Texarkana, Texas shall adopt and enforce these policies as a condition of continued use. H. Information Resources Acceptable Use Policy 1. All employees shall abide by the security instructions, rules, directives or other security communications as contained in this document and that may from time to time be proposed by the CIS Manager and approved by the City Manager. 2. No user, employee or Department Head shall take any action that may affect the security, efficiency or use of the entire network or the portion of the network within their own department. 4 3. Users shall report any weaknesses in the City of Texarkana, Texas computer security, any incidents of possible misuse, or violation of this policy to their Department Head. The Department Head shall forward such information to the CIS Manager and other appropriate authorities. 4. Users shall not attempt to access any data or programs contained on the City of Texarkana, Texas system or any other entity s system for which they do not have authorization or explicit consent. The prohibition extends to CIS employees who shall not access electronic files that are password protected and/or files without the specific request or approval of the user or authorization from the City Manager. 5. Users shall not divulge remote access connection information including but not limited to dial-up modem phone numbers, VPN addresses, etc. 6. Users shall not divulge dialup modem phone numbers to anyone. 7. Users shall not share their City of Texarkana, Texas account(s), passwords, personal Identification numbers (PIN), security tokens (i.e. Smartcard), or similar information or devices used for identification and authorization purposes. 8. Users shall not make unauthorized copies of copyrighted software. 9. Users shall not use non-standard shareware or freeware software without the approval of the CIS Manager. 10. The CIS Manager has the option, with approval of the City Manager, to disable remove or stop the usage of any software that is in his opinion inappropriate or detrimental to the City including any software that uses excessive system resources. 11. Users shall not purposely engage in activity that may: harass, threaten or abuse others, degrade the performance of Information Resources, deprive an authorized City of Texarkana, Texas user access to a City of Texarkana, Texas resource, obtain extra resources beyond those allocated, or circumvent the City of Texarkana, Texas computer security measures. 12. Users shall not download, install or run security programs or utilities that reveal or exploit weaknesses in the security of a system. For example, the City of Texarkana, Texas users shall not run password cracking programs, packet sniffers, or port scanners or any other non-approved programs on the City of Texarkana, Texas Information Resources. 13. The City of Texarkana, Texas information resources shall not be used for personal benefit. 14. Users shall not intentionally access, create, store or transmit material which the City of Texarkana, Texas may deem to be offensive, indecent, illegal or obscene (except when in the course of academic research where this aspect of the research has the explicit CITY OF TEXARKANA, TEXAS 4 of 9
5 approval of the City of Texarkana, Texas official processes for dealing with academic ethical issues or is part of a law enforcement investigation. Such subjects include but are not limited to those dealing with sex, drugs, pornographic material, explosive devices or any illegal activity. Users with proper approval for these types of files shall not copy or disseminate such files except as approved by their Department Head. 15. Access to the Internet from a City of Texarkana, Texas owned, home based, computer shall adhere to all the same policies that apply to use from within the City of Texarkana, Texas facilities. Employees shall not allow family members or other non-employees to access the City of Texarkana, Texas computer systems. Access to the Texarkana, Texas computer network including Internet access from a privately owned computer device shall be limited to those with written approval from the City Manager. Anti-virus software must be loaded on all of these types of devices as a condition of system connection and usage. 16. Privilege for use of private devices or dial up access may be withdrawn or curtailed without notice with the approval of the City Manager or the Department Head. 17. Users shall not otherwise engage in acts against the aims and purposes of the City of Texarkana, Texas as specified in its governing documents or in rules, regulations and procedures adopted from time to time. 18. Frequency and method of all password changes should be at the discretion of the CIS Manager. Seven characters and/or numbers shall be the minimum password size. I. Incidental Use 1. As a convenience to the City of Texarkana, Texas user community, incidental use of Information Resources is permissible with reasonable limits and if consistent with restrictions defined in this policy. 2. Incidental personal use of electronic mail, Internet access, fax machines, printers, copiers, and so on, is restricted to the City of Texarkana, Texas approved users. The right of use does not extend to family members or other acquaintances. 3. Incidental use shall not result in direct costs to the City of Texarkana, Texas. 4. Incidental use shall not interfere with the normal performance of an employee s work duties. 5. No files or documents may be sent or received that may cause legal action against, or embarrassment to, the City of Texarkana, Texas. 6. Storage of personal messages, voice messages, files and documents within the City of Texarkana, Texas Information Resources must be nominal. CITY OF TEXARKANA, TEXAS 5 of 9
6 7. All files and documents including personal files, messages and documents, are owned by City of Texarkana, may be subject to open records requests, and may be accessed in accordance with this policy. 8. All messages, files and documents, including personal messages, files and documents, located on the City of Texarkana, Texas Information Resources are owned by the City of Texarkana, Texas may be subject to open records requests, and may be accessed in accordance with this policy. 9. Incidental use is not appropriate during regular working hours. After hours, lunch and breaks are acceptable times subject to the approval of the Department Head. Department Heads are responsible for determining the reasonable application of this policy and enforcing the incidental use policy in their respective departments. J. and Instant Messaging Policy 1. The following activities will be regulated by policy: a. The authorized system will be Microsoft Exchange. b. Users will access thru Microsoft Outlook or by web mail access. c. User will be limited to a size of 800MB for their mailbox. d. Users will delete unnecessary s. e. Deleted s will be stored in an archive folder on the server. The deleted folder will be maintained in accordance with the City s records retention policy as prescribed by the Texas Library Archives Commission. e. Prior to logging off at the end of the day, users should save any s in the deleted items folder that may be needed later. The deleted items folder is subject to be automatically purged of items older than 90 days. f. Users shall not allow other persons to use their service. g. All requests for service must be submitted to CIS after approval by the user s Department Head. h. usage shall not be used as a method of document retention. 2. The following activities are prohibited by policy: a. Sending s/instant messages that are intimidating, harassing, threatening or obscene (as defined by U.S. and local law). b. Anything which could be construed as sexually explicit, scandalous, defamatory, libelous, immoral or discriminatory, based on race, national origin, sex, sexual orientation, disability or religion or political beliefs is banned from the system. c. Sending a global except with express documented permission of the City Manager. Global s shall be limited to a single City unless specially approved in writing. d. Using /instant messaging for conducting personal business whether for profit or not. e. Using /instant messaging for purposes of political lobbying or campaigning. CITY OF TEXARKANA, TEXAS 6 of 9
7 f. Violating copyright laws by inappropriately distributing protected works. g. Posing as anyone other than oneself when sending , except when authorized to send messages for another when serving in an administrative support role. h. The use of unauthorized and/or instant messaging software. i. Sending or forwarding chain letters. j. Accessing a website or location on the Internet where a fee is charged is prohibited. Employees acquiring such charges bear sole responsibility for them unless accessing a fee based site has been approved by the respective Department Head. 3. The following activities are prohibited because they impede the functioning of network communications and the efficient operations of electronic mail systems: a. Using unauthorized add on features, such programs will impede the network by using a large amount of network s band width. b. Sending unsolicited messages to large groups except as required to conduct agency business. c. Sending excessively large messages and or attachments d. Sending or forwarding that is likely to contain computer viruses. 4. All sensitive City of Texarkana, Texas material transmitted over external network must be encrypted. 5. All user activity on the City of Texarkana, Texas information resources assets is subject to logging and review. 6. Electronic mail users must not give the impression that they are representing, giving opinions, or otherwise making statements on behalf of the City of Texarkana, Texas or any unit of the City of Texarkana, Texas unless appropriately authorized (explicitly or implicitly) to do so. Where appropriate, an explicit disclaimer will be included unless it is clear from the context that the author is not representing the City of Texarkana, Texas. An example of a simple disclaimer is: "the opinions expressed are my own, and not necessarily those of my employer." 7. Individuals shall not send, forward or receive confidential or sensitive City of Texarkana, Texas information through non-city of Texarkana, Texas accounts. Examples of non-city of Texarkana, Texas accounts include, but are not limited to, Hotmail, Yahoo mail, AOL mail, and provided by other Internet Service Providers (ISP). 8. Individuals shall not send, forward, receive or store confidential or sensitive City of Texarkana, Texas information utilizing non-city of Texarkana, Texas accredited mobile devices. Examples of mobile devices include, but are not limited to, Personal Data Assistants, two-way pagers and cellular telephones. 9. All s sent/received thru the network will be logged logs are subject to reporting audits with proper authorization. CITY OF TEXARKANA, TEXAS 7 of 9
8 K. Internet and Intranet Policy 1. Software for browsing the Internet is provided to authorized users for business and research use only. 2. Streaming video is only allowed for business usage, i.e. web training, this must be setup by the CIS Department prior to the event. 3. Known web sites that are not related to City business may be blocked with the City Manager s authorization. 4. All software used to access the Internet must be part of the City of Texarkana, Texas standard software suite or approved by the CIS DEPARTMENT. This software must have all vendor provided security patches applied. 5. All files downloaded from the Internet shall be scanned for viruses using the approved CIS distributed software suite and current virus detection software. 6. All sites accessed must comply with the City of Texarkana, Texas Computer Systems Policy. 7. All user Internet/Intranet activity on City of Texarkana, Texas information resources assets is subject to logging and review by the appropriate Department Head and or the City Manager. 8. Content on all City of Texarkana, Texas web sites must comply with the City of Texarkana, Texas acceptable use policies. 9. No offensive or harassing material may be made available via City of Texarkana, Texas web sites. 10. Occasional non-business related purchases made over the Internet made during incidental personal use are allowed subject to approval by the users Department Head. The City assumes no liability for such purchases or any problems that might arise from such purchases. Business related purchases are subject to City of Texarkana, Texas procurement rules. 11. No personal commercial advertising may be made available via City of Texarkana, Texas websites. 12. City of Texarkana, Texas internet access may not be used for personal gain or non-city of Texarkana, Texas personal solicitations. 13. No City of Texarkana, Texas data will be made available via City of Texarkana, Texas web sites without the appropriate Department Head and/or the City Manager ensuring that the material is available to only authorized individuals or groups. CITY OF TEXARKANA, TEXAS 8 of 9
9 14. All sensitive City of Texarkana, Texas material transmitted over external networks must be encrypted. 15. Electronic files are subject to the same records retention rules that apply to other documents and must be retained in accordance with departmental records retention schedules. See also Section J (1)(e) above. 16. The end user shall be held responsible for all Internet accesses logged with their username. It is not a defense that another person or employee knew or used a user password for inappropriate access. All users are responsible for the security of their PC, laptop or other similar device. L. Telephone Use and Cell Phone Use 1. The use of City telephones for personal business is a privilege which is granted to all employees, and employees must use these phones responsibly. Employees may make local calls from City telephones if necessary. If it is necessary for an employee to make a long distance phone call, the call must be charged to a personal calling card or the employee must call collect. Employees are responsible for reimbursing the City for any phone calls resulting in a fee. 2. The City provides cellular telephones to certain employees for the purpose of conducting City business. Cellular telephones are provided based on a written recommendation from the Department Head. The City acknowledges that an employee may occasionally use their City cellular telephone for personal business. Each Department Head shall be responsible for auditing the use of each cellular telephone assigned to their department and take corrective action as necessary. Employees must properly use, maintain and secure their cellular telephone. If an employee damages or loses their City cell phone, the employee must immediately report it to their supervisor. Improper use of any City cellular telephone may result in disciplinary action. The City may terminate any employee s use of a City cell phone at any time for any reason.
