1 Records for Professional Personnel Incomplete Records Records for Support Personnel Driving Requirements for Drivers of District Vehicles Driving Record Evaluation The following records are required to be on file in Human Capital Management prior to employment: 1. A valid official electronic record from the Texas Education Agency (TEA) indicating eligibility for certification in appropriate content area. Information regarding certification requirements 1 can be found on TEA s website. 2. An official transcript bearing the seal of the college or university, signature of the registrar, and the date a degree was awarded or an official letter signed by the registrar confirming the applicant is a registered intern enrolled in an SBECapproved university internship program. 3. For experienced teachers, letters of recommendation or evaluations from former or current principals. Employee personnel files are maintained electronically. Since salary payments are based on certain credentials reflecting educational and experience attainments, the absence of records of such credentials from the personnel file may jeopardize continued employment with the District. All official records must be on file in Human Capital Management 30 calendar days following the first day of employment. Failure to provide the required documents in a timely manner may subject the employee to disciplinary measures up to and including termination of employment, in accordance with appropriate policies. Individuals applying for secretarial, clerical, or teacher aide positions must provide a high school diploma or GED certificate from a public, public charter, or private school accredited through the Texas Private School Accreditation Commission (TEPSAC). Out-of-state private schools must be accredited by their home state. All employees who operate District vehicles will be subject to the following provisions: A driver s license check is required for all employees before they are authorized to drive a District vehicle, even if it is not required in their job description. Risk Management Services will obtain the driving record for an applicant that includes all convictions resulting in mandatory suspension of a driver s license for the past seven years from the state or states having such a record. To curtail repeat offender problems, applicants having more than 3 points on DATE ISSUED: 9/13/ of 5

2 their driving record within 12 months will not be considered for employment that requires driving District-owned vehicles. Nor will those with more than 6 points in the last three years be allowed to drive. Points will be assessed according to the standards prescribed by the Texas Department of Public Safety. In accordance with law, an applicant must be at least 18 years old and have a valid Texas driver s license with the appropriate class for the vehicle being operated. Any applicant, either a new or current driver, who has or receives a DWI/DUI on his or her driving record cannot drive for the District for seven years from the date the DWI/ DUI was received. (A new driver is one who has not been previously approved to drive a District vehicle.) Each employee s driving record will be evaluated quarterly. Any driver who accumulates 10 or more points on his or her driving record during a three-year period shall be disqualified from driving until he or she becomes eligible again. The determination by the vehicle insurance carrier or selfinsurance administrator of the District that a driver employed by the District is non-insurable will be deemed good cause for disqualifying the employee from driving immediately. If a position is available that the uninsurable employee is qualified to fill, such position may be offered to the employee. If a position is not available for which the employee qualifies, the employee will be subject to termination. Driver Requirements The following will apply to District drivers: 1. All employees who are required to drive a District vehicle must complete driver safety orientation prior to driving a District vehicle. 2. Drivers will not use cellular telephones while driving a District vehicle. 3. All drivers will complete an inspection twice daily, at the beginning and at the end of their shifts, on their assigned vehicles and will report any damage noticed to the supervisor no later than the end of their shifts. 4. All drivers will report to Risk Management Services any vehicle accident immediately after the accident and in no case more than 24 hours after the accident occurred. Accidents that occur on a weekend or a holiday must be reported on the next business day. DATE ISSUED: 9/13/ of 5

3 5. Safety cones will be used during emergency conditions and while parked. 6. Drivers will observe applicable speed limits at all times. 7. Drivers will obey all traffic rules and regulations. 8. Drivers will not carry any guest passengers in their vehicle unless they are District employees and have supervisor approval. 9. Drivers and passengers will wear seat belts at all times. 10. Drivers are to report to their supervisor and Risk Management Services any driver s license suspensions immediately upon returning to work and in no case shall operate a Districtowned motor vehicle until suspension has been removed. 11. Drivers who are involved in a vehicle accident will submit to a drug and alcohol test. 12. Drivers will not use a District-owned vehicle for personal use without prior approval from the Superintendent of Schools or a designee. Disciplinary Actions Drivers who receive three complaint calls may be subject to mandatory training and/or disciplinary action up to and including a recommendation Disciplinary actions are as follows: First complaint call Supervisor will discuss complaint call with employee and provide feedback to Risk Management Services. Second complaint call Supervisor will discuss complaint call with employee, provide employee with a written warning and provide feedback to Risk Management Services. Driver will need to complete mandatory driver training provided by Risk Management Services. Third complaint call Driver will need to complete mandatory driver training provided by Risk Management Services and may receive additional disciplinary action up to and including a recommendation At no time will aggressive driving be tolerated by any employee who is driving a District vehicle. If it is determined that a driver is exhibiting unsafe driving behavior that includes, but is not limited to, rude gestures, verbal insults, deliberately driving in an unsafe or threatening manner, or making threats, he or she will be removed from driving status and may receive DATE ISSUED: 9/13/ of 5

4 additional disciplinary action up to and including a recommendation Drivers are subject to disciplinary actions for being involved in three preventable vehicle accidents within a five-year period. (After five years, one accident will be removed.) Disciplinary actions are as follows: First incident Driver will receive a written warning from his or her supervisor, must attend defensive driving class, and may receive additional disciplinary action up to and including a recommendation Second incident Driver will be placed on an intervention plan, must attend defensive driving class, and may receive additional disciplinary action up to and including a recommendation Third incident Driver will be removed from driving status and may receive additional disciplinary action up to and including a recommendation Any driver who has a preventable accident and violates state law and/or causes serious injury, death, or major property damage will be removed from driving status and may receive additional disciplinary action up to and including a recommendation Any driver who does not adhere to the driver requirements will be subject to disciplinary actions up to and including a recommendation Defensive Driving Class Requirements Exceptions All District drivers involved in a preventable accident (as determined by the District s insurance carrier or self-insurance administrator) while driving a District vehicle will be required to take a state-certified defensive driving class within 30 days of notification by Risk Management Services. The defensive driving class will be completed after work hours and at the expense of the driver. If a certificate of completion is not forwarded to Risk Management Services within 30 days of notification, the driver may not be allowed to drive until the class is completed. If the driver has not forwarded the certificate of completion within 30 days, the employee will be removed from driving status and may be subject to termination. Exceptions may be made to this regulation by the Superintendent of Schools or designee. DATE ISSUED: 9/13/ of 5
