Box 358 Scarborough, ME RE: Application for Driveway/Entrance Permit 1400 US Route 1, York Dear Tony, On behalf of 1400 Group LLC, Colby Company Engineering and Kimball Survey & Design are pleased to submit applicable materials for a Driveway Entrance Permit.The proposed project will eliminate two existing buildings that have been razed and 210 feet of open paved access onto Route 1. The proposed project will include a single 22foot wide driveway to access 2 multiuse buildings (office/residential) and a singlefamily residence. Bill Bray has completed a Traffic Assessment that is included for your review. In addition, since this section of Route 1 is classified as a mobility corridor the sight distance and driveway separation are more stringent. Since the construction of the new driveway does not meet these criteria (sight distance is close) we have requested waivers for both. The enclosed materials include: 1. Cover Letter 2. 9 WAIVER REQUEST 1400 Group, LLC requests a waiver from the Mobility Arterial Standards for 2.3A Sight Distance and 2.3B Driveway Spacing. The MaineDOT Standards are shown below followed the request for waiver. 2.3 Mobility Arterial Standards In addition to the applicable standards in Sections 2.1 and 2.2, entrances onto Mobility Arterials must also comply with the increased or additional standards in this Section 2.3. A. Mobility Sight Distance. The sight distance for entrances onto Mobility Arterials must meet or exceed the distance listed in Table 2, unless a waiver is granted pursuant to Section 3.3(D). Sight distance is measured in accordance with its definition. Unless a waiver is granted pursuant to Section 3.3(D), new entrances onto Mobility Arterials must be separated from other existing or proposed driveways or entrances including those located across the highway and those serving the same lot, in accordance with the minimum spacing standards set forth in Table 3. Entrance spacing is measured from edge of driveway/entrance to edge of driveway/entrance, excluding radii. Driveways or entrances located directly across the highway from the proposed entrance will not be counted in applying the spacing standard. 10 The proposed project is located at 1400 Route 1 in York. Route 1 in this area is considered a mobility corridor with a speed limit of 50 mph. The project will remove 210 linear feet (140 feet and 70 feet) of open pavement that accesses directly onto Route 1 and replace it with a single 22foot wide driveway. The driveway location was selected to fit the proposed development between 2 proposed multiuse (commercial office on the first floor and residential on the second floor) buildings with central access to a singlefamily home at the rear of the site. The driveway was moved as far as north as possible due to lot geometry and 75foot stream setback. A retaining wall was also constructed to keep the driveway as far as possible to the north. The proposed driveway location results in 860 feet of sight distance to the north and 830 feet of sight distance to the south. For a Mobility Corridor minimum sight distance is 840 feet. Additionally, the driveway location results in a separation to the existing driveways to the north and south of 335 feet and 190 feet respectively. The applicant, 1400 Group, LLC, respectively requests a waiver from the Mobility Arterial Standards for 2.3A Sight Distance. As indicated above the minimum sight distance for a 50mph zone is 840 feet, which is met to the north but is 10 feet short to the south. The waiver should be granted because: 1. the speed limit increases from 35 mph to 50 mph only 650 feet from the driveway 2. the construction of this driveway will increase safety by eliminating the existing wideopen pavement that currently accesses to the lot. 3. The existing buildings that were constructed on this property have been razed, eliminating multiple driveway access points Group, LLC requests a waiver from the Mobility Arterial Standards for 2.3B Driveway Spacing. The minimum driveway separation is 350 feet in a Mobility Corridor. The waiver should be granted because: 1. the speed limit increases from 35 mph to 50 mph only 650 feet from the driveway 2. the existing driveway separation is 95 feet to the south and 170 feet to the north. The new driveway would increase the separation to the south by 95 feet to the south and 165 feet to the north. 3. remove wide open pavement access to single driveway access therefore improving safety.
