VILLAGES AND SETTLEMENT AREAS Aranos Village Council Gibeon Village Council Gochas Village Council Kalkrand Village Council Maltahohe Village Council Stampriet Village Council No. 263 IMPOSITION OF ENTRY FEES ON FOREIGN VEHICLES: ACT, 1999 Under section 18(1)(b) of the Road Fund Administration Act, 1999 (Act No. 18 of1999), the Road Fund Administration after consulting the Minister, imposes, with effect from 1st December, in respect of motor vehicles which are not registered in Namibia that temporarily enter Namibia, the entry fees as set out in the Schedule. 3 No Government Gazette 21 November 3 Definitions SCHEDULE 1. In this notice, a word or expression to which a meaning has been given in the Act has that meaning, and unless the context otherwise indicates - "agent" means any person to whom the Administration has, under section 15(3 )(b) of the Act, delegated its power to collect entry fees and includes an employee of the Administration who performs the same function; "the Act" means the Road Fund Administration Act, 1999 (Act No. 18 of 1999); "entry fee" means the fee payable under paragraph 2; "entry fee certificate" means the certificate issued under paragraph 3(4); "foreign vehicle" means a motor vehicle which is not registered under the Road Traffic Ordinance, 1967 (Ordinance No. 30 of 1967); and "operator" means the person who brings a motor vehicle at any entry point to Namibia for the purpose of bringing that motor vehicle into Namibia. Rate of entry fee 2. The entry fees payable to the Administration by operators of foreign vehicles are set out in the Annexure. Payment of entry fee 3. ( 1) The entry fee is payable to the Administration on or before each occasion that a foreign vehicle enters Namibia. (2) On entering Namibia, the operc~tor of a foreign vehicle shall complete a written application in the form determined by the Administration and that form shall contain particulars of the vehicle, the owner of the vehicle and any other information which is relevant to the application. (3) An operator who has completed an application form as contemplated in subparagraph (2) shall submit to an agent - (a) the completed application form together with- (i) (ii) (iii) the r~gistration certificate relating to the vehicle or a certified copy ofthe same; a police clearance certificate issued in the country where the vehicle is registered or a certified copy of the same; or some other documentation which contains information on the engine number, chassis number, the registration number of the vehicle in question, if available, and particulars of the owner of the vehicle or certified copies of that documentation; and (b) the appropriate entry fee. ( 4) On receipt of the entry fee and documents referred to in subparagraph (3), an agent shall, if he or she is satisfied that the application is in order, issue out to the operator of the relevant foreign vehicle, an entry free certificate relating to that vehicle. (5) An operator to whom an entry certificate has been issued shall, when departing from Namibia, submit the certificate to an agent at the point of departure from Namibia.
4 4 Government Gazette 21 November No ( 6) On receipt of an entry fee certificate as contemplated in subparagraph (5), the agent shall cancel the certificate. Exemption 4. A foreign vehicle which is entering Namibia whilst being carried in or on another motor vehicle is exempt from the requirements of this notice. Refund of entry fee 5. (1) Where a foreign vehicle in respect of which an entry fee certificate was issued is subsequently registered under the Road Traffic Ordinance, 1967 (Ordinance No. 30 of 1967), the operator of that foreign vehicle is, subject to subparagraph (3), entitled to a refund of the entry fee which was paid in respect of that vehicle if that operator has, in writing and within 3 months of the date of issue of that entry fee certificate, made a request for the refund to the Administration. (2) The request referred to in subparagraph ( 1) shall be accompanied by the relevant entry fee certificate or a certified copy of the same and proof of the registration ofthe vehicle as contemplated in subparagraph (1). (3) Notwithstanding subparagraph (1), the Administration shall, from the refund referred to in that subparagraph, deduct the amount of administrative costs as set out in the Annexure. Offences and penalties 6. ( 1) Subject to paragraph 4, no person shall - (a) (b) bring a foreign vehicle into Namibia; or drive a foreign vehicle on any road in Namibia, unless that person is in possession of an entry fee certificate issued in respect of that foreign vehicle. (2) A person referred to in subparagraph (1) shall, whilst in Namibia, keep the relevant entry fee certificate in the foreign vehicle in respect to which it was issued and shall, on being requested, produce that certificate to an authorised officer referred to in the Road Traffic Ordinance, 1967 (Ordinance No. 30 of 1967). (3) A person who contravenes subparagraph (1) or fails to comply with subparagraph (2) commits an offence and is liable on conviction to a fine not exceeding N$2 000 or to be imprisoned for a period not exceeding 1 year. ( 4) Subject to a paragraph 4, no agent shall allow a foreign vehicle to enter Namibia unless the operator of that vehicle is in possession of an entry fee certificate issued in respect of that vehicle. ( 5) A person who has been convicted and sentenced under this paragraph still remains liable to pay to the Administration, the entry fee in respect of the incident from which the offence arose if he or she has not paid the entry fee.
