Muscats Motors have provided 40 BMW 5 Series and 40 BMW 4 Series Gran Coupe cars for the Malta EU Presidency functions, a total of 80 BMWs. 10 AUCTION TERMS AND CONDITIONS. CONDITIONS OF AUCTION. Participation in the viewing or in the purchase of the Vehicles is tantamount to full acceptance of the following conditions: In his role as auctioneer of lots, the auctioneer acts solely for and in the interest of the seller. When the auctioneer or his representatives make statements about a lot, they are doing so on behalf of the seller of the lot and any statements are statements of opinion only. Bidders and buyers are strongly advised to seek and obtain independent advice on the lots, on their state and their value before bidding for them. 1. We reserve the right at our sole discretion to refuse admission to the premises for viewing or for the Auction without stating a reason. We have complete discretion as to whether the sale proceeds, whether any lot is included in the sale and the manner in which the sale is conducted. 2. We have complete discretion to refuse any bid. During the Auction increments on bids, will be of 200 per bid, to start. 3. All bidders must, prior to the auction, complete a registration form and show some means of identification (such as an identity card) to the auctioneer or his representatives. Once registration is complete, the bidder will be given identification in order for them to bid during the Auction. 4. The bidder who makes the highest bid acceptable to the auctioneer for any lot (subject to any applicable reserve being met) and to whom the lot is given by being knocked down by the auctioneer at the striking of the auctioneer s hammer, shall acquire the lot in question. Any dispute as to the higher acceptable bid will be settled by the auctioneer at his absolute discretion. 5. Each lot is sold tale quale, as is, and as viewed by the bidder with all faults and defects, (whether these are visible or otherwise), if any. 6. Once bidders have made the highest bid to the satisfaction of the auctioneer, they shall proceed to provide their name, address, identity card number, sign the purchase agreement and pay a non-refundable deposit of not less than 5,000. Only Banker s Drafts, Cash and Credit Cards are acceptable. Credit cards are subject to administration fees. 7. No purchase shall be claimed or removed until it has been paid for in full and the sale has been concluded. Full payment shall be settled before or upon delivery of the vehicle, which shall take place within 30 days from the Auction date. In the event that delivery does not take place within the said 30 days, storage charges may apply at the auctioneer s sole discretion. 8. Only upon the payment of the purchase price in full will title and ownership of the lot pass to the buyer. 9. Vehicles are subject to the attached terms set by Transport Malta (POL 49) 10. All vehicles sold during the auction are covered by manufacturer s warranty terms, provided that the term of warranty shall run from the first day that the vehicles were used. 11. Bidders give the auctioneer all rights to use and publish any photographs and images of lots sold at the auction at any time and at his absolute discretion. 12. The bidding amount is the final price to be paid for the vehicles. No bidding fees or charges will be applied. 13. Mileages shown within this booklet are estimates. Please verify mileage during viewing. TRANSPORT MALTA. POL 49 - Licensing Procedures for Vehicles acquired through Auction 1. Registration Tax will NOT be payable upon registration of the vehicle; 2. VAT will NOT be payable on any vehicle purchased during the Auction; 3. In the event that the successful bidder acquires the vehicle (the First Owner ) and transfers the said vehicle within 60 months from first registration ( Registration Tax Exemption Period ) to a third party (the Second Owner ), the Second Owner will be liable to pay registration tax which will be calculated by Transport Malta in accordance with Transport Malta s vehicle valuations as uploaded on its website. In such a case, the Second Owner will also be required to pay the applicable VAT which was not paid when the vehicle was bought on auction; Provided that if, during the Registration Tax Exemption Period, the vehicle acquired by the First Owner is transferred to a Second Owner where the Second Owner is a direct heir of the First Owner and has acquired the vehicle pursuant to an inheritance, no registration tax will be payable. If the Second Owner (in this case, the heir) transfers the vehicle to a third party during the Registration Tax Exemption Period, then registration tax will be payable as per the above. 4. If the vehicle is transferred to a commercial entity during the Registration Tax Exemption Period, VAT on such transfer must be paid; 5. In the event that the First Owner transfers the vehicle following the lapse of the Registration Tax Exemption Period, no registration tax and no VAT will be payable by either the First Owner or the Second Owner; 6. If, during the Registration Tax Exemption Period, the vehicle is involved in a traffic accident and is declared to be a total loss by the Insurance Company, registration tax will be payable in the event that the vehicle is sold or transferred to a third party. If during the said Registration Tax Exemption Period, the vehicle is scrapped in an approved end of life facility, then no registration tax and VAT are payable. 7.
