1 MCCOOK PUBLIC POWER DISTRICT McCook, Nebraska BOARD POLICY NUMBER 488 SUBJECT Renewable Generator Net Metering Interconnect Policy OBJECTIVE To set forth a policy for the interconnection and net metering of renewable energy generation in accordance with Nebraska s Revised Statutes through , or as amended. Net metering is available to eligible customers whose electric service is supplied by McCook Public Power District (also referred to as the District). DEFINITION Customer-generator: The party that is in control of the qualified facility, as defined in Nebraska Statute (7) that is located on premises owned, leased or otherwise controlled by the party. Interconnection Application: Form to be used by the customer generator to submit a formal request for interconnection to the distribution system. Application must be received at least sixty (60) days prior to installation (reference Nebraska Revised Statutes (2)). Interconnection Agreement: The written agreement between the customer-generator and the District that outlines the requirements and obligations of both the customer-generator and the District. Net metering: The measured difference between the electricity supplied to a customer-generator by the District and the electricity generated by the customer-generator and delivered to the District at the same point of interconnection. Rated generationg capacity: The maximum continuous kilowatt (kw) AC generation capacity at the generation source as described by the manufacturer. If a maximum continuous kw AC generation capacity is not provided, a peak value will be used. CONTENT 1. This Policy shall be applicable to any retail customer of McCook Public Power District having a total installed aggregate name plate generating capacity from a single or multiple qualified customer generators of twenty-five kilowatts (25 kw) alternating current (AC) or less at a single site and be a Qualified Facility as described in Nebraska Statute (7).

2 a. The generator is intended to offset part or all of the customer-generator s requirements for electric energy (measured in kilowatt hours) at the same location and not at another location. b. If available, the District can provide historical usage and demand data to the customergenerator which may be used to properly size the generator(s). 2. The customer-generator must be in good standing with McCook Public Power District. 3. The customer-generator must complete, sign and return to the District an Interconnection Application no less than 60 days prior to installation. a. The customer-generator must meet all safety and performance requirements of the District and all applicable regulations, interconnection, and reliability standards established by the National Elecrical Code, the National Electrical Safety Code, the Institute of Elecrical and Electronics Engineers and the Underwriters Laboratories. These requirements include being equipped to automatically isolate the Quailified Facility from the electric system in the event of an electrical power outage or other conditions where line is de-energized. 4. The customer-generator shall enter into a written Interconnection Agreement with the District. 5. The customer-generator shall pay the District for all costs incurred by the District for equipment or services required for interconnection of the Qualified Facility unless otherwise provided for in statute. 6. Before the customer-generator becomes net metered they must meet with District personnel to complete the Verification Test Procedure. a. The Verification Test Procedure ensures that the customer generator and District personnel are familiar with the way the gererator will shut down if there is power loss on the District s grid. During testing, the District will verify the installation of the disconnect switch required by the District. 7. No seasonal loads will be eligible to apply for Net Metering. A single meter shall be employed to read the flow of energy in two directions. Energy use and excess energy generated will be recorded by the meter. They will be netted for billing purposes. Additional meters may be installed at the expense of the District and may be used to generate data on net metering and not for billing purposes. In months when the customer generates more electricity than is consumed, all excess energy is expressed as a monetary credit as calculated using McCook Public Power District s Net metering Service Rider Rate.

3 A customer receiving service under this policy will be subject to the same retail rate as those who are not generators. Customer-generators served under this rate remain responsible for all charges from their normal rate schedule including monthly minimum charges, distribution charges, customer charges, meter charges, facilities charges, demand charges or surcharges. At a time when the total generating capacity of all customer-generators using net metering is equal to or in excess of one percent (1%) of the rated capacity necessary to meet the District s average aggregate customer monthly peak demand forecast for the calendar year, the District may deny net metering service to additional customer-generators. Customer-generator usage and sales shall be reviewed at the end of the billing year. Net generation should not exceed load as measured in kilowatt hours. If generation is exceeding the load, a notice will be mailed to the customer stating that generation must be curtailed back to an offset status. If a customer owned generator creates power quality issues for the District and/or other electric consumers, the District reserves the right to disconnect the generator until customer-generator can take corrective measures. RESPONSIBILITY The General Manager and McCook Public Power District Board of Directors shall be responsible for the administration of this Policy. In addition to these standards, I understand that McCook PPD requires an AC disconnect with a visual open adjacent to or within 10 ft. of McCook PPD s meter for utility worker safety. The AC disconnect is defined in NEC to and must meet the requirements of NEC , lockable in the open position. The switch must be clearly labeled as a renewable generator disconnect switch. I also understand that this entire application form must be completed and returned before McCook PPD can approve the project. I will not proceed with the installation of equipment based upon parallel operation with McCook PPD until I have received written approval from an authorized McCook PPD representative. This application will be reviewed by McCook PPD s engineering department. A modeling study will be conducted to determine what, if any, changes will need to be made to McCook PPD s electrical system. If changes are required, the Customer Generator is responsible for those costs as outlined in Nebraska Statute Section 1 prior to bringing the generation on line. Net metering will not be activated until all documentation is completed and provided to McCook PPD. It is the Customer Generator s responsibility to submit all required documentation.

13 SMALL RENEWABLE ENERGY GENERATION INTERCONNECTION AND SERVICE AGREEMENT BETWEEN MCCOOK PUBLIC POWER DISTRICT AND (Customer Generator) This Small Renewable Energy Generation Interconnection and Service Agreement is entered into as of, 20 by and between McCook Public Power District, a public corporation and political subdivision of the State of Nebraska hereinafter referred to as MPPD and hereinafter referred to as Customer Generator, Customer or Owner as the context may require and each at times singularly called Party or collectively called Parties. SECTION ONE: GENERAL TERMS AND CONDITIONS MPPD owns and operates an electric sub-transmission and distribution system in the State of Nebraska and is engaged in the purchase, transmission, distribution and sale of electric power and energy and wishes to accommodate the Customer s desire to install small renewable energy generation facility with a capacity rating of 25kW or less at a single site and to qualify for and receive the benefits of a net metering treatment by MPPD The Customer s renewable energy generating facilities will be electrically interconnected with McCook Public Power District to allow the generating facilities to operate synchronous with MPPD s system and provide a path for the delivery of the energy from MPPD s system to a Customer s remaining load or in the event of surplus generation allow for the delivery of excess energy from the Customer s generating facilities to MPPD All transactions and service including payment to the customer for excess generation delivered to MPPD or provided to the Customer under this Agreement shall be conducted and provided as outlined by the Policies that are attached to and become a part of this Agreement. McCook Public Power District retains and reserves the right, power and authority to modify, revise, amend, replace or repeal said Policies and or rate schedules in whole or in part by resolution adopted by the MPPD Board of Directors In the event the interconnection causes or presents a risk to McCook Public Power District, its employees, its customers or the general public, MPPD shall have the right to require Customer to immediately disconnect the generation facility. Further, MPPD shall retain the right to disconnect the generation facility without advanced notice if it is determined by MPPD that the facility has caused or may cause interference with MPPD s facilities, equipment or distribution lines or other MPPD customers or if the facility presents a danger to MPPD employees, customers or the general public This Agreement and all rights, obligations and performances of the Parties hereunder are subject to all applicable federal, state and local laws, ordinances, rules and regulations and other duly authorized actions of any governmental authority having jurisdiction over the Parties and their respective facilities including but not limited to the National Electric Code, National Electric Safety Code, the Institute of Electrical and Electronics Engineers and qualified independent testing laboratories.

14 1.06. This Agreement shall become effective on the date first above written and shall continue in force for a period of no more than five (5) years unless terminated in a manner herein provided. Except as otherwise provided in Section 1.04 either Party may terminate this Agreement by providing at least one (1) year prior written notice which notice can be given at any time after the fourth year of this Agreement. Termination by MPPD shall be only for cause. SECTION TWO: FACILITIES AND METERING The Customer grants to McCook Public Power District the right to install, test, maintain, inspect, replace, connect, disconnect and repair equipment or facilities if any placed on the property of the Customer under the provisions of this Agreement during the term thereof, and also grants to the other Party the right to remove such equipment and facilities at the expiration of the term hereof or upon its earlier termination The Customer further grants to MPPD the right if ingress to and egress from the location of the Customer s generation facilities and the Customer grants the right to read and inspect all meters which are installed on the Customer s property to MPPD personnel Metering equipment will be installed by MPPD that will measure the amount of Customer generation output and the amount of the electrical power and energy delivered from MPPD to the Customer and the amount of the electrical power and energy delivered from the Customer to MPPD. Said meter shall be bidirectional and capable of accurately determining the net power delivered by MPPD to Customer and delivered by Customer to MPPD s system and said meter shall be installed in such a manner as to make the same easily readable by both parties Customer will promptly pay all invoices for electrical power and energy or any other invoices submitted to Customer by MPPD and shall be subject to all other requirements of MPPD with regard to payment of such invoices, including but not limited to the discontinuance of service for failure to pay said invoices Customer agrees to limit generation, to the extent requested by McCook PPD in order to facilitate requirements illustrated in State Statute to Customer agrees to install an AC disconnect with visual open within 10 ft of McCook PPD s customer meter for utility worker safety as defined in MPPD s Net Metering Application. SECTION THREE: LIABILITY AND INDEMNITY Each Party will be liable to the other for damages to property of the other by the negligent conduct of the damaging party. PROVIDED HOWEVER, MPPD shall not be liable for any damage to property of Customer resulting from an Act of God over which MPPD has no control. This mutual liability shall be for property damage only and shall not include incidental or consequential damages such as loss of profit or loss of revenue Power Quality. The Customer agrees to limit any harmonic voltage or current distortion, reactive current output or radio frequency output that would interfere with the District s load control operation, remote meter reading or SCADA operation. If the Customer s equipment causes said distortion or interference, the Customer will be required to eliminate or reduce the interference to such level as required to meet IEEE Standard 519 and IEEE Recommended Practice and Requirements for Harmonic Control in Electric Systems. If the problem cannot be reduced to an acceptable level or be eliminated, MPPD has a right to disconnect the Customer s equipment.

15 3.03. Energy Rate. The energy rate to be charged by MPPD to Customer shall conform to and be equal to that set forth on the Net Metering Service Rider Rate Schedule in effect upon the time of the execution of this Agreement and at such times thereafter as the same may be amended In the case of Customer generation, the power factor range will be maintained at unity +/_ 5%, or in other words 95% leading to 95% lagging Power Factor. Initially at installation of the project the inverters should be set at unity by the installer The execution of this Agreement and the provision to MPPD by Customer of one or more cellular telephone numbers shall constitute Customer s consent to calls from MPPD to said number including robo-calls regarding the service provided by MPPD pursuant to this Agreement. SECTION FOUR: APPROVAL The parties hereto have caused this Agreement to be executed by their authorized officers or the authorized individual as of the day and year first above written.
