NOTICE OF PUBLIC HEARING REGARDING CONSIDERATION OF AN INCREASE TO SOLID WASTE FEES PLEASE TAKE NOTICE THAT the City Council of the City of Lynwood will conduct a public hearing on January 2, 2018 commencing at 6:00 p.m. in the City of Lynwood Council Chambers, 11350 Bullis Road, Lynwood, California to consider proposed increases to the City s solid waste fees to be effective January 3, 2018. In addition, notice is hereby given of the intent to impose fees and increase fees, not covered in the monthly base rate, such as for additional waste carts. See specific rate information below and in the attached rate sheet. If approved, the residential rate increases will be effective January 3, 2018, January 1, 2019, and January 1, 2020. In addition, a rate adjustment may be approved on January 20, 2020, January 1, 2021 and January 1, 2022 based on the Consumer Price Index. The maximum rate increase will be three percent (3%). If approved, the commercial rate increase will be a 10% increase. The commercial Rate Adjustment may be approved on January 2, 2018, January 1, 2019, January, 1 2020, January 1, 2021 and January 1, 2022 based on the Consumer Price Index. The maximum rate increase will be three percent (3%). At the hearing, the City Council will consider all oral and written testimony regarding the proposed solid waste rate increase. You may also submit a formal written protest against the rate increase proposal (which includes the automatic adjustments). Written Protest Procedure: A property owner or tenant may file a written protest to the proposed increases in one of the following ways: 1. Through the United States mail. 2. Hand delivery/deposit with the City Clerk s office at City Hall, 7:00 am to 6:00pm, Monday- Thursday. 3. Hand delivery to the City Clerk at the date and time of the public hearing on January 2, 2017. Each written protest must include the name of the parcel owner or tenant, service address or assessor's parcel number for the parcel served, and the parcel owner's or tenant's signature. Protests must also clearly indicate whether the sender objects to the proposed Rate or methodology for future adjustments. No more than one protest per parcel will be counted. In the event of a majority protest, the proposed rate adjustment shall not be adopted. A majority protest shall exist only in the event that a majority of owners or tenants of the identified parcels submit written protests against the proposed rate adjustment to the City of Lynwood. The City sets solid waste rates that are charged to residents and businesses in order to meet the contractual requirements with Waste Resources, Inc. ( WRI s ) under the City s Solid Waste Handling Service and Franchise Agreement. The revenue required includes solid waste processing and disposal fees, the cost of diversion programs and other applicable fees. The City Council will also consider increasing fees for supplemental services provided by WRI that are not covered in the monthly base rate, including fee for additional carts, and after three warnings, repossession of green waste carts from customers who routinely place trash in green waste carts.
