Learner s Permit and Driver s Licensing Requirements You may get your learner's permit when you reach 15 years and 6 months of age. It allows you to operate a motor vehicle when a licensed driver at least 21 years of age is seated beside you. The driver accompanying you may be 18 years of age if he or she is your legal guardian, brother, sister, halfbrother, half-sister, step-brother or step-sister. The driver accompanying you must hold a valid driver's license, be alert and able to assist you and be legally permitted to drive. When you apply for a learner's permit, you will also complete the application process for your driver's license and pay the fees for both the permit and license. You will be required to pass a vision screening and the two-part knowledge exam. If you are under age 19, you must provide proof of successful completion of a state-approved driver education program and you must hold a learner's permit at least nine months before you can receive a driver's license.

Age requirement for Driver Education Every applicant for a driver's license who is under 18 years of age (PREVIOUS LAW was under 19) shall furnish the DMV with satisfactory proof of their successful completion of a driver education program approved by the State Department of Education.

Applicants age 18 and older are not required to present proof of successful completion of a stateapproved driver education program.

Virginia s Legal Presence Law Introduction Legal presence means that a person is either a U.S. citizen or is legally authorized to be in the United States. Virginia law requires anyone applying for an original Virginia driver's license or for a DMV-issued identification card to show proof of their legal presence. Persons who are authorized by the federal government to be present in the U.S. temporarily are issued limited duration driver's licenses or identification cards. Customers can make their driver's license or ID card transactions a success if they plan ahead and know what to bring to DMV. Come prepared!

New Law Starting in 2010 As a part of classroom driver education instruction each student and their parent/guardian are required to attend a 90-minute traffic safety program. This compulsory attendance at the traffic safety program is the result of a new Commonwealth of Virginia law (22.1-205) that took effect academic year 2010-2011. This requirement must be met before a student can receive a Driver Education Certificate of Completion which is commonly known as a (DEC-1 card).

New Law 2010/ More information Thomas Jefferson High School for Science and Technology (TJHSST) will be offering 4 evening traffic safety programs throughout the school year to help accommodate schedules. Our goal is to offer one presentation per quarter with the expectation that you will attend at a time that your son or daughter is enrolled in Driver Education.

New Law 2010 Student must attend with his/her parent or guardian Attendance for the full 90-minute presentation is required Those arriving late Will Not be admitted Those leaving early Will Not receive a Certificate of Attendance or DEC-1 card. Proper completion of a Registration form is required at the conclusion of the 90-minute presentation.

Behind the Wheel The state requires 14 hours of BTW instruction. 7 days/ 2 hours per day You must have completed at least 10 hours of classroom time before you will be allowed to start your BTW class through FCPS.

45-Hour Parent Teen Driving Guide/ Complete Sessions 1-7 Prior to BTW. Sessions 1-7 are recommendations made by the Commonwealth of Virginia prior to taking BTW. Just Google it!!

Licensing Ceremony/ Held within 180 days of receiving your paper provisional license or TDL. All licensing ceremonies are held at the Juvenile and Domestic court in Fairfax City. Students are notified by the court (with a post card in the mail) as to when they are to appear before the judge with a parent, to receive their permanent license. Paper provisional licenses are valid for 180 days (6 months).

Juvenile Restrictions For persons under 18: Cellular Telephone/Wireless Telecommunications Device Restrictions Virginia's cellular telephone law prohibits the use of cell phones while driving, regardless of whether such device is or is not hand-held. You can only use a cell phone or any other telecommunications device for a driver emergency and the vehicle must be lawfully parked or stopped.

New Law 2016 Provides that the holder of a provisional driver's license under age 18 is not authorized to operate a motor vehicle with more than one Non- Family member who is younger than 21 years old if the provisional license is issued for less than a year. For either the first year of the provisional license or the period after the first year, the passenger limit does NOT apply to members of the driver's FAMILY or household.

New Law 2016 continued After the first year of the provisional license, if the driver is under 18, there are three restricted options: 1. You may carry up to 3 NON-FAMILY members under 21 if you are driving only to or from a school-sponsored activity. 2. You may carry up to 3 NON- FAMILY members under 21 when you have a passenger, at least 21 years old, occupying the seat next to you. 3. You may carry up to 3 NON- FAMILY members under 21 in cases of emergency.

Curfew Restrictions If you are under age 18 and you turn age 17 after July 1, 2013, Virginia law prohibits you from driving midnight to 4 A.M. except when driving: to or from a place of business where you are employed; to or from an activity that is supervised by an adult and is sponsored by a school or by a civic, religious, or public organization; with a licensed spouse age 18 or older, parent or other adult acting in loco parentis who is occupying the front passenger seat, in case of an emergency, including responding to emergency calls as a volunteer firefighter or rescue squad personnel.

Violations Of either the Curfew or Passenger restrictions can result in the suspension of your driver's license.

Do not ignore any tickets you may receive from a Police Officer!!! You must go to court for any violation that has demerit points. Your parent must be with you!!!!! Do not hide your ticket!!!

18 years of age or younger Any violation which demerit points are received. 1 st offense- Saturday school 2 nd offense- License suspension up to 90 days 3 rd offense- Loss of License for up to 1 year or until you turn 18, whichever is longer.

The new process for receiving your new Virginia s Secure License and ID Card. You will not receive your new driver's license or ID card during your DMV visit. Driver's license applicants will be given temporary driving permits that cannot be used for identification purposes. ID card applicants will be given a receipt. You will receive your new driver's license or ID card in the mail. Customers renewing Virginia driver's licenses or ID cards can keep your old license or ID card to carry with the temporary driving permit or receipt, until you receive your new license or ID card in the mail. Your new driver's license or ID card will be produced within three days and mailed to you. Mail delivery times vary. Please allow up to 15 days to receive your new credential.

Images of Driver's Licenses and Identification Cards In 2009, Virginia began issuing newly designed, secure driver's licenses made of laser engraved polycarbonate. Driver's licenses and ID cards issued prior to implementation of the new format remain valid until expiration. All primary photographs are grayscale, full faced and displayed on the left side of the cards. Secondary photographs are grayscale, full faced and displayed in a clear window, visible from the front and back of the cards. The formats of licenses and ID cards are oriented as follows: Adults age 21 and over - Horizontal Minors age 15 to 21 - Vertical Minors under age 15 - Horizontal

Obtaining an Identification Card You must be a resident of Virginia to obtain an ID card. An ID card has no age restriction and is available for an adult or child who does not hold a learner's permit or driver's license. An adult ID card expires at the end of the month in which you were born when you reach an age divisible by five; e.g. 20, 25, 30 etc. A child ID card expires on the child's 16th birthday.
