APPLICABILIY his rate schedule is available to all Customers for lighting, power, and heating service with a highest measured demand as defined by the Determination of Billing Demand. Service under this rate schedule shall be limited to Customers who otherwise do not qualify for service under the Company's other rate schedules and whose highest measured demand, during the current month and previous eleven (11) month period, was (i) greater than fifteen (15) kilowatts (kw) in any month and (ii) did not exceed six hundred (600) kw, in any two (2) consecutive months. he Standard Monthly Rates provision is closed to new customers whose projected demand is 400 kw or greater. he Alternate ime-of-use Monthly Rate provision is available to current customers and is mandatory for new service applications with a projected demand greater than 400 kw; however, customers choosing or required to take the Alternate ime-of-use Monthly Rate may take service under the Standard Monthly Rate after 12 months on the Alternate ime-of-use Monthly Rate as provided below. All service will be taken at one point of delivery designated by the Company and at one of the Company's standard types of service. shall be all other hours not covered in the on-peak period. Customers under the Standard Service rate (Existing Customers), and new customers that are not required to take service under the Alternate OU rate, may elect service under the Alternate OU rate. he Customer that elects or that is required to take service under the Alternate OU rate, must do so for a minimum of twelve (12) months. If, at the conclusion of the initial twelve (12) month period of service under the Alternate OU rate, the total billings for the 12-month period exceed billings for the same period under the Standard Service rate, the Customer may opt to revert to the Standard Service rate. In this event, the Company will reset the Customer's account to the Standard Service rate and credit the Customer for the difference in billings under the Alternate OU rate and the Standard Service rate for the 12-month review period. MONHLY MINIMUM CHARGE he monthly minimum charge is the Customer Charge plus the applicable Demand Charge. DEERMINA ION OF BILLING DEMAND Maximum demand is defined as the highest measured thirty (30) minute average kw load. he billing demand will be the highest of: A. 15 kw; or, B. he maximum demand; or, C. 60% of the highest measured demand established during the billing months of June through September in the twelve (12) month period ending with the current month. he Company may refuse service to another Customer at the same address when service is terminated to avoid or evade payment of the minimum demand charges as set forth in this rate schedule. he Company will reset the demand ratchet for customers installing Distributed Generation (DG) and/or storage following interconnection of the DG and/or storage, restarting the historical demand used for purposes of applying the tariffed demand ratchet. POWER FACOR ADJUSMEN If the measured power factor at the time of the highest measured thirty (30) minute interval kw demand for the entire plant is below 90% lagging, a power factor adjustment shall be calculated as follows: ADJ = ((kw x.95/ PF) - kw) x DC, where ADJ = Increase to applicable Demand Charge, kw = Monthly Measured Demand, PF = Monthly measured Power Factor, and DC = Demand Charge. MEER VOL AGE ADJUSMEN If electric service is delivered on the high voltage side of a Customer-supplied transformer but metered on the low voltage side of the transformer, the following meter adjustments shall be made: Adjusted Maximum kw Demand = Metered Maximum kilowatts multiplied by 1.014 Billing kilowatt-hours = Metered kilowatt-hours multiplied by 1.020 If electric service is delivered on the low voltage side of a Company-owned transformer but metered on the high voltage side of the transformer, the following meter adjustments shall be made: Adjusted Maximum kw Demand = Metered Maximum kilowatts divided by 1.014 Billing kilowatt-hours = Metered kilowatt-hours divided by 1.020 HERMAL ENERGY SORAGE RIDER his rider is closed to all new service applications. Monday through Friday. he off-peak period shall be all other hours not covered in the on-peak period. No other options or riders are applicable to consumption covered under this rider. Both separately metered ES systems and total building loads must be served under this rate schedule. FIXED FUEL FACOR his rate schedule is subject to the provisions of the Company's Rate Schedule No. 98 (Fixed Fuel Factor). ENERGY EFFICIENCY COS RECOVERY FACOR his rate schedule is subject to the provisions of the Company's Rate Schedule No. 97 (Energy Efficiency Cost Recovery Factor). MILIARY BASE DISCOUN RECOVERY FACOR his rate schedule is subject to the provisions of the Company's Rate Schedule No. 96 (Military Base Discount Recovery Factor). ERMS OF PAYMEN he due da te of the bill for utility service shall not be less than sixteen (16) days after issuance. A bill becomes delinquent if not received at the Company by the due date. If the due date falls on a holiday or weekend, the next Company business shall apply. ERMS AND CONDIIONS Service supplied under this rate schedule is subject to the Company's Rules and Regulations on file with the Public Utility Commission of exas and available for inspection a t Company offices. If a Customer's highest measured thirty (30) minute average kw load exceeds 600 kw for two (2) consecutive months, the Customer shall be placed on the Large Power Service Rate Schedule No. 25 for a minimum of twelve (12) months. Upon completion of the minimum twelve (12) month period, a determination will be made by the Company for the Customer's applicable rate schedule. If a Customer's highest measured thirty (30) minute average kw load has not exceeded 15 kw for two (2) consecutive months during the current month and previous eleven (11) month period, at the Company's sale option, that Customer shall be placed on Rate Schedule No. 02, Small General Service Rate. Any new Customer that has not established a prior service history with the Company shall be classified under the appropriate rate schedule in accordance with a demand estimate performed by the Company.
