HISTORICAL PERSPECTIVE: The Planning Commission conducted a public hearing on May 18, 2016, to consider an amendment to the Development Code to reduce the minimum off-street parking requirements within the Creekside District of the Regional Center-Transit-Oriented (RC-TO) zone, similar to the previously adopted changes to the Regional Center-Old Town (RC-OT) zone. The proposed changes are specifically designed to fulfill Implementation Strategy #8.5 of the Creekside District Master Plan, which City Council adopted in November 2014. At the conclusion of the public hearing, the Planning Commission recommended approval of the proposed text amendment. EXHIBIT_1_ ORDINANCE NO. 4686 AN ORDINANCE AMENDING ORDINANCE NO. 2050, THE DEVELOPMENT CODE, TA2016-0001, CREEKSIDE DISTRICT PARKING TEXT AMENDMENT WHEREAS, on May 18, 2016, the Planning Commission conducted a public hearing to consider a City-initiated application to amend the Development Code to modify the minimum parking requirements for a portion of the Regional Center-Transit-Oriented (RC-TO) zone; and, WHEREAS, the proposed changes are listed as a specific implementation strategy in the Creekside District Master Plan, which was adopted by City Council in November 2014; and, WHEREAS, the Planning Commission received and considered the submitted staff report, exhibits, and staff-recommended approval of this text amendment; and, WHEREAS, the Planning Commission voted to recommend approval of the text amendment on May 18, 2016; and, WHEREAS, no appeal of the Planning Commission's decision was filed; and, WHEREAS, the Council adopts as to criteria applicable to this request and findings thereon the Planning Division Staff Report dated May 11, 2016, and Planning Commission Land Use Order No. 2474; now therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BEAVERTON, OREGON: Section 1: Ordinance No. 2050, the Development Code, is amended to read as set forth in Exhibit "A" to this Ordinance attached to and incorporated herein by this reference. Parking spaces shall be provided and satisfactorily maintained by the owner of the property for each building or use which is erected, enlarged, altered, or maintained in accordance with the requirements of Sections 60.30.05. to 60.30.20. 1. Availability. Required parking spaces shall be available for parking operable passenger automobiles and bicycles of residents, customers, patrons and employees and shall not be used for storage of vehicles or materials or for parking of trucks used in conducting the business or use. 2. Vehicle Parking. Vehicle parking shall be required for all development proposed for approval after November 6, 1996 unless otherwise exempted by this ordinance. The number of required vehicle parking spaces shall be provided according to Section 60.30.10.5. 3. Bicycle Parking. [ORD 3965; November 1996] Bicycle parking shall be required for all multi-family residential developments of four units or more, all retail, office and institution developments, and at all transit stations and park and ride lots which are proposed for approval after November 6, 1996. The number of required bicycle parking spaces shall be provided according to Section 60.30.1 0.5. All bike parking facilities shall meet the specifications, design and locational criteria as delineated in this section and the Engineering Design Manual. Except as otherwise provided under Section 60.30.1 0.11., off-street vehicle, bicycle, or both parking spaces shall be provided as follows: 1. Parking Calculation. Parking ratios are based on spaces per 1,000 square feet of gross floor area, unless otherwise noted. 2. Parking Categories. A. Vehicle Categories. Contained in the table at Section 60.30.1 0.5. are vehicle parking ratios for minimum required parking spaces and maximum permitted number of vehicle parking spaces to be provided for each land use, except for those uses which are located in the Regional Center RC OT zoning district which are governed by Section 60.30.1 0.6. Specifically exempted from this requirement are parcels located within the Regional Center-East zoning district. In the cases in the Regional Center-East zoning district where parcels are bisected by the boundary of Parking Zones A and B, the applicable maximum parking ratios may be averaged, and that average may be applied over the whole parcel. The required minimum number of shortterm and long-term bicycle parking spaces for each land use is listed in Section 60.30.1 0.5. 1. Short-Term parking. Short-term bicycle parking spaces accommodate persons that can be expected to depart within two hours. Short-term bicycle parking is encouraged to be located on site within 50 feet of a primary entrance, or if there are site, setback, building design, or other constraints, bicycle parking shall be located no more than 100 feet from a primary entrance in the closest available area to the primary entrance as determined by the decision-making authority. 2. Long-Term parking. Long-term bicycle parking spaces accommodate persons that can be expected to leave their bicycle parked longer than two hours. Cover or shelter for long-term bicycle parking shall be provided. School buildings are exempted from the requirement to cover long-term bicycle parking. 3. Bicycle parking shall be designed, covered, located, and lighted to the standards of the Engineering Design Manual and Standard Drawings. [ORD 4302, June 2004] 4. Bicycle parking in the Old Town Parking Zones 1 and 2 shall be governed by the bicycle parking requirements listed in Section 60.30.1 0.5. [ORD 4471; February 2008] 3. Ratios. In calculating the required number of vehicle and bicycle parking spaces, fractions equal to or more than 0.5 shall be rounded up to the nearest whole number. The City of Beaverton - Planning Division Development Code Section 40.85.15.1.C.1-7 (Text Amendment Approval Criteria) Staff recommend the Planning Commission review the proposal, take public testimony, deliberate on the proposal and make a recommendation of approval to City Council. 1. Summary of Proposed Text Amendment City staff have prepared a Text Amendment to the City of Beaverton's Development Code reduce the amount of required off-street parking spaces required for land uses within the Creekside District, which is bounded by SW Canyon Rd., SW Hall Blvd., and SW Cedar Hills Blvd. The proposed change creates three additional parking districts within the Regional Center-Transit-Oriented (RC-TO) and Regional Center-East (RC-E) zone districts to go along with the existing two districts in the Regional Center-Old Town (RC OT) zone. The proposed Parking District 3 will be the Creekside District. The proposed Parking District 4 will be the remaining portions of the RC-TO zone. The proposed Parking District 5 will be the RC-E zone. No changes are proposed for Parking Districts 4 and 5. The proposed reductions for the. Creekside District (Parking District 3) will match the reductions adopted in February, 2008 for the Regional Center-Old Town area. The maximum parking requirements are carried over from the existing table in Section 60.30.1 0.5.A, with no changes proposed. For Parking Districts 4 and 5, the minimum requirements are simply moved from the existing table to the modified table in Section 60.30.1 0.6, as proposed, without alteration. As noted by Luke Pelz, City Senior Transportation Planner, in the applicant materials, this proposed text amendment was specifically included in the 2014 Creekside District Master Plan and Implementation Strategy as a way of increasing the likelihood that the urban, multiple-use development envisioned by the community for the Creekside District of Downtown Beaverton will occur. 2. Public Comment Public notice was provided consistent with Section 50.50 of the Development Code. As of the date of issuance of the staff report and recommendation, no written comments from the public were received and/or submitted to the record. Staff has also not received any written comments from Metro, Washington County, or the Oregon Department of Land Conservation and Development (DLCD) staff. Staff also note that the Creekside Plan went through extensive public outreach before being adopted by the Planning Commission and City Council. While the prior comments are not a part of this land use action to amend the Development Code, the proposal is certainly in keeping with the results of the prior public input. 3. Facts and Findings Section 40.85.15.1.C of the Development Code specifies that in order to approve a Text Amendment application, the decision-making authority shall make findings of fact, based on evidence provided by the applicant, that all of the criteria specified in Section 40.85.15.1.C.1-7 are satisfied. The following are the findings of fact for TA2016-0001 (Creekside District Parking Requirements): Development Code Approval Criteria 1. The proposal satisfies the threshold requirements for a Text Amendment application. Section 40.85.15.1.A specifies that an application for a text amendment shall be required when there is any proposed change to the Development Code, excluding changes to the zoning map. TA2016-0002 proposes to make changes to Chapter 60 of the Development Code, as shown in the attached Exhibit 1.1. Therefore, staff find that the proposal meets the approval. 2. All City application fees related to the application under consideration by the decision-making authority have been submitted. Policy Number 470.001 of the City's Administrative Policies and Procedures manual states that fees for a City initiated application are not required where the application fee would be paid from the City's General Fund. The Planning Division, which is a General Fund program, initiated the application. Therefore, the payment of an application fee is not required. Staff find that the approval criterion is not applicable. 3. The proposed text amendment is consistent with the provisions of the Metro Urban Growth Management Functional Plan. Metro's Urban Growth Management Functional Plan (UGMFP) is the document that defines how local governments are to implement the Metro Regional Goals and Objectives. The UGMFP is comprised of the following titles: Title 1: Title 2: Title 3: Title 4: Title 5: Title 6: Title 7: Title 8: Title 9: Requirements for Housing and Employment Accommodations Regional Parking Policy (Repealed and moved to Title 4 of the Regional Transportation Functional Plan (RTFP)) Water Quality and Flood Management Industrial and Other Employment Areas Neighbor Cities and Rural Reserves Centers, Corridors, Station Communities and Main Streets Housing Choice Compliance Procedures Performance Measures (Repealed) Title 10: Functional Plan Definitions Title 11: Planning for New Urban Areas Title 12: Protection of Residential Neighborhoods Title 13: Nature in Neighborhoods Title 14: Urban Growth Boundary The City is required to bring its land use regulations into conformance with the UGMFP. This proposed text amendment does not conflict with any titles of the UGMFP. Although the Metro regulations governing parking regulations have been moved out of the UGMFP, the proposal is consistent with them. Metro does not set minimum parking requirements, just maximums, as part of an effort to limit the excessive provision of off- TA2016-0001 (Creekside District Parking -Requirements) May 11,2016 Page 3 of 8 23

street parking spaces and encourage higher densities of residents and employees, especially within the Regional Centers of the Metro 2040 Plan. The proposed changes are in conformance with the provisions of Title 6, as applicable to the Downtown Beaverton Regional Center. To the extent that the proposed changes will spur additional housing construction within the Creekside District, the proposal is in conformance with the provisions of Title 7. Therefore, staff find that the proposal meets the approval criterion. 4. The proposed text amendment is consistent with the City's Comprehensive Plan. Staff find that the following Comprehensive Plan Policies apply to this proposal: Chapter Three: Land Use Element Goal 3.5.1 Beaverton mixed use areas that develop in accordance with community vision and consistent with the 2040 Regional Growth Concept Cap. Policy 3. 5. 1. a: Regulate new development in Regional Centers, Town Centers, Station Communities and Main Streets (see Figure 111-1, Comprehensive Plan Land Use Map) to ensure compact urban development. The Comprehensive Plan specifically calls out the use of minimum and maximum parking ratios as an Action to implement Policy 3.5.1.a and staff find that the proposed reduction in minimum parking requirements for the Creekside District will support compact urban development by reducing the amount of lot area devoted to vehicle parking. Policy 3.5.1.c: Design streets and adjacent buildings within mixed use land use designations to ensure a setting that is attractive and accessible to multiple transportation modes, including pedestrians, bicyclists, transit riders and motor vehicles. To the extent that the proposed parking requirement reductions allow for more compact, urban development, the streets and buildings will create a setting that provides a better experience for users of active modes of transportation. Policy 3.5.1.e: Promote pedestrian safety by designing streets and pedestrian areas that encourage pedestrian use both day and night, reflect local access functions and use land efficiently. The proposed changes to the Development Code are designed to encourage land owners in the Creekside District to use their land more efficiently, by reducing the amount of surface parking provided with new development or infill development. Policy 3.5.1.f: Regulate the design and construction of streets, intersections, and parking facilities to ensure pedestrian safety and convenience. To the extent that the proposed changes reduce the number of vehicles using a given parking facility be potentially reducing its size, the result of the proposal will be enhanced pedestrian safety and improved convenience. Therefore, staff find that the proposal meets the goals and policies of Goal 3.5.1 of the Comprehensive Plan. Goal 3.6.1 Regional Centers that develop in accordance with community vision and consistent with the 204 Regional Growth Concept Map. Policy 3.6.1.a: Regulate new development in Regional Centers to ensure compact urban development and to maximize the public infrastructure investment in light rail. To the extent that the proposed changes achieve their purpose in encouraging new development within the Creekside District, the proposal will increase the number of residents, employees, and customers that can benefit from the Creekside District's proximity to the light rail system. Policy 3.6.1.d: Adopt Community Plans identifying Comprehensive Plan Policies applicable to each regional center to provide community vision. The proposal is a direct result of the recommendations contained within the Creekside District Plan, which provided policy guidance in response to the community's desire for the area to become more densely developed in an urban manner, as expressed through the Beaverton Community Vision. Therefore, staff find that the proposal meets the goals and policies of Goal 3.5.1 of the Comprehensive Plan. Finding that the proposal meets the applicable goals and policies of the Comprehensive Plan, staff therefore find that the proposal meets the approval criterion. 5. The proposed text amendment is consistent with other provisions within the City's Development Code. TA2016-0001 (Creekside District Parking Requirements) May11,2016 Page 5 of 8
