SECTION I Legislative and legal framework for brokering of arms, military equipment and dual-use products The adoption of the Law on Export and Import of Arms and Military Equipment and Control of Export and Import of Dual-Use Products ( Official Gazette of Bosnia and Herzegovina no. 05/03, 09/03, 14/05, 33/03, 14/05, 56/05 and 75/05) and its implementation established unified state principles related to the issuance of permits for import, export, brokering and transit of arms and military equipment. The process of harmonization of regulations in this area with the EU legislation has been completed, together with the promulgation of an updated Common List of Military Equipment covered by EU Code of Conduct on Arms Export ( Official Gazette of Bosnia and Herzegovina no. 75/05), Law on Implementation of the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on their Destruction ( Official Gazette of Bosnia and Herzegovina no. 15/06) and the List of Dual-Use Products and Technologies, whereby a control system over dual-use goods is established and their misuse in illicit military and terrorist purposes prevented, in compliance with EU Regulation 1334/2000 and 149/2003 ( Official Gazette of Bosnia and Herzegovina no. 75/05). Therefore, we have completely harmonized our export/import control for all goods with international standards, particularly with those of the EU, and we have made a major breakthrough in terms of arms export contril at the state level. Pursuant to this Law, related by-laws were adopted and published to regulate all the steps of the licence issuing procedure. The essence of the above mentioned regulations is to ensure that, in Bosnia and Herzegovina, export, import, transit or brokering licences are only issued to those legal and private entities registered at the Ministry of Foreign Trade and Economic Relations of BiH, while requiring each licence the previous consent from the Ministry of Foreign Affairs of BiH, the Ministry of Security of BiH and the Ministry of Defense of BiH. When issuing their approvals, the Ministry of Foreign Affairs takes into account the following: UN Security Council bans and sanctions, International committments, Foreign policy interests and other specific BiH interests with respect to strategic foreign policy partners, EU Code of Conduct on Arms Exports and the principle of combating the proliferation of weapons of mass destruction. The approval issued by the Ministry of Security of BiH guarantees that the issuance of a licence will not endanger public security inside BiH. The approval issued by the Ministry of Defense of BiH confirms that the issuance of a licence will not endanger BiH's defence capabilities. In order to ensure more efficient control, the Ministry of Foreign Trade and Economic Relations shall, after the licence has been issued, and in compliance with Change 24 of the Instructions to Parties, inform JC EUFOR about the licence issued, EUFOR's prior consent is necessary for the transport of this type of goods. We wish to emphasize that, in the framework of arms, military equipment and dual-use products import and export control efforts, the institutions of the BiH State Border Service and BiH Indirect Taxation Directorate (customs authorities) have been actively engaged with enforcing laws and regulations. Pursuant to the obligations prescribed in the Law on Export and Import of Arms and Military Equipment and Control of Export and Import of Dual-Use Products ( Official Gazette of Bosnia and Herzegovina no. 05/03,

09/03, 14/05, 33/03, 14/05, 56/05 and 75/05), the Ministry of Foreign Trade and Economic Relations of BiH is establishing a database on all licences issued and will submit a report to the Parliamentary Assembly of Bosnia and Herzegovina thereof, which ensures the continuous reporting to competent civil bodies and institutions of Bosnia and Herzegovina. In this way transparency has been ensured in performing these transactions, which contributes to the increased international reputation of Bosnia and Herzegovina and enables more extensive international cooperation in the field. The Ministry of Foreign Trade and Economic Relations of BiH installed the TRACKER system, which enables the issuance of arms, military equipment and dual-use products trade licences. The system enabled linking all the ministries at state level which participate in approving licences in the sphere of arms, military equipment and dual-use products export. Assistance in annual report drafting (Information on issued permits for trade in arms, military equipment and duel-use products for 2007) in compliance with EU requirements, i.e. EU Code of Conduct, has been obtained from SEESAC (Southeastern Europe Small Arms Clearing House), which approved funds to UNDP to provide support to the Ministry of Foreign Trade and Economic Relations of BaH in process of report drafting through software support. Report drafting in this format is one of the activities and conditions which should be fulfilled by BaH in order to be able to sign Stabilization Agreement with EU. SEESAC (Southeastern Europe Small Arms Clearing House) assisted the drafting in accordance with EU requirements (i.e. the EU Code of Conduct) of the Annual Report (Information on arms, military equipment and dual-use products brokering in 2007) by approving UNDP funds for the Ministry of Foreign Trade and Ekonomic Relations of BiH for software support in report drafting. Drafting a report in this format is one of the activities and conditions BiH has to meet as a prerequisite for signing the Stabilization and Assocciation Agreement with the EU. 2

SECTION II Overview of licences issued for brokering of arms, military equipment and dual-use products In compliance with the obligations prescribed under the Law on arms and military equipment export and import and dual-use products export control ( Official Gazette of BiH No. 05/03, 09/03, 14/03, 33/03, 14/05, 56/05 i 75/05 ), Common list of military equipment given in EU Rules of Conduct on arms import ( Official Gazette of BiH No. 09/03), and enforcing by-laws ( Official Gazette of BiH No. 56/05), all dealers involved in arms and military equipment brokering have to be registered in the special Register kept with the BiH Ministry of Trade and Economic Relations. In 2007, 31 legal and natural persons were registered for foreign-trade operations in arms and military equipment brokering, with 10 permanent and 21 temporary registrations. During 2007, a total of 387 licences were issued, of which: 180 arms and military equipment export licences, 7 arms and military equipment temporary export licences 1 arms and military equipment brokering licence, 138 arms and military equipment import licences 5 arms and military equipment temporary export licences, 2 arms and military equipment re-export licences, 23 dual-use products export licences, 1 dual-use products temporary export licence, 29 dual-use products import licences, 1 dual-use products temporary import licence The total value of goods brokered against licences issued for arms, military equipment and dual-use arms export, import, temporary import and export, based on pro-forma invoices attached to the licence applications, amounted to 60,385,103.00 EURO. It is not possible to offer a realistic overview of the number of issued import and export licences until the moment that the validity of the issued licences expires (licences are issued for a period of one-year validity). One application for an arms and military equipment export licence to Georgia was rejected. The reason for the refusal of the licence was the application of the EU Code of Conduct on Export of Arms and Military Equipment (Annex H). 5

Arms and military equipment import The total value of temporary import of arms and military equipment according to the licences issued in 2007, and on the basis of pro-forma invoices submitted with licence applications, was 7,802,216.00 EURO (Annex B). 138 import licences for 22 countries were issued, namely: Austria Italy Germany Czech Republic Israel Poland England Canada Slovenia Greece Cyprus Ukraine Denmark Lichtenstein Serbia Malaysia Hungary Switzerland Croatia Norway Turkey According to the value of all import licences, about 85% of the value of the goods was imported from the following ten countries: USA Slovenia 1.398.191,00 Serbia 1.355.376,00 Austria 974.665,00 Hungary 646.475,00 Czech Republic 632.660,00 Germany 617.096,00 Ukraine 438.020,00 Croatia 341.010,00 Greece 315.883,00 6

The total value of arms and military equipment temporary imports in 2007, and on the basis of the pro-forma invoices submitted with the licence applications, was 183,418.00 EURO (Annex D). 2 re-export of arms and military equipment licences were issued (Serbia Turkey and Serbia Saudi Arabia), and, on the basis of the pro-forma invoices submitted with the licence applications, the value was 176,584.00 EURO (Annex G). Dual-use products export The total value of exports as per export of dual-use products licences issued in 2007, and on the basis of proforma invoices submitted with licence applications, was 3,152,720.00 EURO (Annex I). 23 export licence for 5 countries (Bulgaria, Croatia, Macedonia, Montenegro and Serbia) were issued, while the structure of exported included products from 2 tariff numbers. 1 temporary export licence was issued (Germany), with a declared value, based on the pro-forma invoice submitted with the licence application, of 5,000.00 EURO (Annex K). Overview of the brokered values as per licences issued, compared to licenses issued in 2006 Taking into account the brokered value as per licences issued, based on pro-forma invoices submitted, one may conclude that there have been no major changes in arms and military trade compared to the previous year.
