Purpse f Reprt The purpse f this reprt, is t prvide Members with an verview f the wrk Licensing Enfrcement Officers have undertaken t date. 2. Backgrund Members are minded t nte, that since the last enfrcement update, Licensing Enfrcement Officers have cntinued t practively embark n a number f taxi licensing enfrcement peratins. A summary f enfrcement peratins undertaken are detailed belw. 3. Current Psitin Taxi Licensing On 5 July 2017, Licensing Enfrcement Officers alngside Vehicle Examiners frm the Smithies Lane Dept, tk part in a day time peratin fcusing their attentin at Springwell Schl. During the day a sizable percentage f vehicles and drivers were inspected. In ttal 38 licensed vehicles were inspected, the results f which are detailed as fllws: 38 vehicles fund t be cmpliant and 5 vehicles were issued with immediate suspensin ntices fr: Rear tyre misshapen inperative side lights inperative and damaged brake lights Inperative number plate lights Tyre belw limit
Other vehicles received advice in relatin t: Cleanliness Dim side light Bulb psitined the wrng way Plates ineffectively adhered t vehicles Tyres clse t legal limit During the same inspectin and in additin t the abve, 1 driver als received a written warning: fr falsifying the required daily check sheet On 15 September 2017, Licensing Enfrcement Officers alngside Vehicle Examiners frm the Smithies Lane Dept, tk part in a mrning peratin fcusing their attentin again n ur smaller licensed Operatrs. Again, it is imprtant sufficient time is taken t inspect each and every business t ensure cmpliancy. During the mrning nly a small prprtin f vehicles were available fr inspectin. In ttal 8 licensed vehicles were inspected, the results f which are detailed as fllws: 4 vehicles were fund t be cmpliant and 4 vehicles were issued with immediate suspensin ntices fr defects including: Inperative number plate lights Inperative side lights Inperative brake lights Tyres being under the limit (2mm) Inperative wing mirrr repeater In additin t the abve advice was als given in relatin t: Trip Hazards
During the peratin 1 driver was als issued with a written warning fr failing t cmplete their daily vehicle inspectin bk. Taking the abve int accunt, Members will nte that 50% f vehicles inspected during this peratin were fund t be nn-cmpliant and as a result, suspended with immediate effect. Vehicle nn-cmpliance is an issue that Officers are cncerned with during the undertaking f each and every enfrcement peratin. Defective vehicles are nt acceptable and cannt be excused, cupled with failing t cmplete basic vehicle inspectin sheets, an inspectin sheet that nt nly the Trade requested t cmplete, but a tl that ensures the very safety f a licensed vehicle, is nt acceptable. 4. Prpsal Practive enfrcement peratins like these will cntinue t take place n a quarterly basis and Officers are in the prcess f arranging enfrcement peratins with the Driver and Vehicle Standers Agency, Suth Yrkshire Plice and Custms and Excise. Whilst vehicle failure rates remain at an unacceptable level this cntinues t harbur great cncerns amngst thse driven t cmbat such ill failings and cnvey the message that peratrs, vehicle prprietrs and drivers must begin t accept respnsibility fr their failures and make a change. Failure t d s, will nly cntinue t put the safety f the public at risk when using a hackney carriage r private hire vehicle in Barnsley. After all, the principal cnsideratin here must be ne f public safety. 5. In additin t actively checking fr driver and vehicle cmpliance as part f radside checks, Enfrcement Officers als carry ut investigatins int allegatins f illegal drivers perating in the brugh.
6. Current Psitin Licensing Act 2003 ARGUS Training In light f recent tragic events thrugh the cuntry Licensing Officers surced cunter terrrism training fr all licensed premises in the twn centre. 34 twn centre licensees all successfully cmpleted the ARGUS training at Barnsley Twn Hall. The training was delivered by Cunter Terrrism Security Advisers wh used multimedia simulatin and psed questins and dilemmas t participants t raise the awareness f the threat f terrrism and prvided practical advice n preventing, handling and recvering frm an attack. 7. Reduce The Strength Initiative Officers are currently wrking with licensed premises in the twn centre t reduce the availability f high strength cans f beer and lager. A verbal update f the results f this wrk will be presented at the General Licensing Bard as Officers have insufficient time t prvide the relevant statistics fr circulatin prir t the meeting. 8. Best Bar Nne Best Bar Nne is an Accreditatin Scheme with Natinal Awards supprted by the Hme Office and the drinks industry which is aimed primarily at prmting respnsible management and peratin f alchl licensed premises. The scheme is being launched in Barnsley n the 14 th Nvember and will cnclude in June 2018 with an award ceremny fr all invlved. Officers have been trained and passed exams t becme qualified assessrs under the Best Bar Nne Scheme. 9. Immigratin checks in licensed premises On the 12 th Octber Licensing Officers accmpanied by Immigratin Enfrcement Officers inspected 3 licensed premises in the twn centre t ensure cmpliance under the Licensing Act 2003.
