GENERAL CONDITIONS AND RULES OF USE OF THE CAR PARK ARTICLE 1 General prvisins and respnsibilities 1.1 - In the absence f a prir written agreement with PARKING, upn entering these premises the USER uncnditinally accepts the General Cnditins and use f the car park set ut belw. 1.2 - The service prvided by PARKING is limited slely t the prvisin f parking spaces fr mtr vehicles t USERS. PARKING is nt a depsitry, and s is nt bliged in any way t guard r supervise the vehicles, nr is PARKING in any way respnsible fr the actins f third parties. 1.3 - PARKING shall nt be liable fr any damage suffered by USER r dne t his prperty, hwever that damage ccurs, and in particular shall nt be liable fr damage resulting frm accidents, thefts r vandalism ccurring n these premises. 1.4 - Apart frm the authrized vehicle, n ther bjects (such as tyres, cntainers, etc.) may be left n the premises. The cleaning, maintenance r repair f vehicles is prhibited n the premises. 1.5 - While the vehicle is parked : - N persn r animal may stay inside the vehicle; - N bject may be left inside the vehicle; - The entrance ticket r card shall nt be left in the vehicle; - The vehicle must be lcked and the windws shut. 1

ARTICLE 2 Entry t and exit frm the car park 2.1 - Access t the car park is abslutely prhibited t anyne wh is nt emplyed there r wh des nt have an entrance ticket r card. In the interest f the security f its custmers, PARKING may ask anyne entering r already within the premises t shw his identity papers and the dcuments relating t the vehicles brught int the premises. 2.2 - USERS nt in pssessin f a card that pens the autmatic barriers, must take a ticket at the entrance f the premises. 2.3 - USERS may nly access these premises during pening hurs, unless agreed therwise between PARKING and USER. The hurs f pening are determined slely by PARKING. Ntices displayed n the premises infrm USERS f the pening hurs. 2.4 - Outside pening hurs vehicles may be remved frm these premises nly where an attendant f PARKING can be made available and the USER agrees t make a prir payment as fixed by PARKING, in additin t the nrmal charge shwn n the price list. 2.5 - N vehicle may be parked n the premises fr mre than 45 cnsecutive days withut the prir written cnsent f PARKING. PARKING may remve any vehicle nt meeting this bligatin, at the expense and risk f the user. 2.6 - Access may be refused fr any vehicle which cannt be parked in a nrmal parking space because f its size r because it is pulling a trailer. PARKING may permit access n cnditin that the USER agrees t pay a charge increased in prprtin t the number f parking spaces whlly r partially ccupied by the vehicle. T prevent the autmatic barrier clsing t sn, the driver f a vehicle pulling a trailer shuld ask an attendant fr assistance bth when entering and leaving the car park. 2

2.7 - Access is prhibited fr vehicles equipped with snw chains. Any damage caused by bringing such a vehicle int the car park in breach f this regulatin shall be the respnsibility f the USER. 2.8 - If an entrance ticket is lst; the vehicle may nly leave the car park after: - Payment f the charge calculated in de manner described belw; - Presentatin f the vehicle s lgbk and ignitin key; - Presentatin f the USERS identity card r passprt; - The USER has signed the relevant frm, duly filled in. ARTICLE 3 Prices and charges 3.1 - The charges fr using the car park are fixed slely by PARKING, in accrdance with the legal an cntractual prvisins. Charges are t be paid in cash. PARKING reserves the right t refuse payment in anything ther than cash. Hwever, if it accepts ther frms f payment, it may require the payment f an additinal fixed sum t cver any csts f btaining the cash payment. 3.2 - Charges are calculated accrding t the length f time the vehicle spends in the car park, each hur begun being cunted as a whle hur. 3.3 - The charges payable are thse displayed n ntices in the car park at the time when the vehicle leaves the premises. 3.4 - USERS wh are exempt frm paying all r part f the charge must cmply with the frmalities necessary t earn their right t an exemptin. 3

3.5 - When an entrance ticket is lst USER will pay fr the time which he claims the vehicle stayed in these premises with as a minimum the amunt due in the event f the lss f a ticket, shwn n the price list displayed. If the user can prvide prf f the length f stay f his vehicle in the car park, then the user need nly pay the charge fr a stay f that length. PARKING reserves the right t make a final but reasnable assessment f any prf ffered. ARTICLE 4 Traffic regulatins utside and inside the car park 4.1 - Traffic regulatins are valid in the car park. USERS driving inside the car park d s at their wn risk and need t bserve these rules. 4.2 - USER must bey the signals and signs inside the car park and the verbal instructins given by the attendants f PARKING. 4.3 - The speed limit in these premises is 10 km/h. 4.4 - Inside the premises USERS shall drive with dipped headlights. 4.5 - USERS must switch ff their engines as sn as they have parked r when waiting in a queue and as sn as the signal "STOP MOTOR" is switched n. 4

ARTICLE 5 Withhlding, immbilising, mving r remving vehicles 5.1 - In the event f an accident r breakdwn f a vehicle USERS shall immediately take the necessary measures t statin their vehicles s that they d nt in any way bstruct nrmal traffic in the premises. 5.2 - USERS frmally authrise PARKING t mve their vehicles r t have them mved, within these premises, at the USERS expense and risk, where: - Vehicles are nt prperly parked in the marked parking spaces; - Vehicles are parked in a reserved parking space; - Vehicles bstruct traffic; - Vehicles are left fr mre than 45 cnsecutive days in the car park withut prir written cnsent f PARKING; - The needs r prper running f the car park s require it. In such cases, PARKING has the right t immbilise vehicles, fr example by means f wheel clamps Denver, befre r after mving them. The cst f mving vehicles within these premises and r immbilisatin is fixed at 90 VAT included. 5.3 - USERS frmally authrise PARKING t mve their vehicles r t have them mved, utside these premises, at the expense and risk f the USERS r, when the identity f the USER is nt knwn, f the wners f the vehicles where: - Vehicles are left fr mre than 45 cnsecutive days in the car park withut prir written cnsent f PARKING; - Vehicles are nt fitted with a registratin plate enabling the USERS r the wner t be identified and cntacted; 5

- In the reasnable pinin f PARKING, vehicles cnstitute a danger t peple r prperty. 5.4 - USERS frmally authrise PARKING t withhld their vehicles within these premises, at USERS expense and risk, where: - Vehicles have been invlved in an accident, fr the purpse f the accident reprt and fr the perid f time necessary fr that purpse; - USER refuses, fr whatever reasn, t pay the charges r fees due. ARTICLE 6 Interest in arrears and penalty clause 6.1 - Fr any invice unpaid n the due date, interest in arrears will be charged withut any ther demand, at the rate applied by the natinal Bank f Belgium fr advances in current accunt, increased by three pints. 6.2 - Withut prejudice t the interest in arrears mentined abve, invices which are nt paid n the due date and which remain unpaid 15 days after sending a request fr payment by a letter sent by rdinary pst, will be increased by 15 %, withut any ther warning, with a minimum f 50 as a fixed sum payment, nt including legal csts. 6

ARTICLE 7 Applicable law and disputes 7.1 - Belgian law alne is applicable t cntractual relatins. 7.2 - The curts f the judicial district f the head ffice f PARKING shall have jurisdictin in respect f any dispute under these cnditins. In any dispute within the jurisdictin f the Justice f the Peace in the judicial district f Brussels, the Justice f the Peace f the 6th cantn shall have jurisdictin. 7.3 - The English translatin f these General Cnditins and Rules are fr infrmatin nly and in the event f any dispute, regard shall be had nly t the Dutch r French versins 7
