APPORTIONABLE VEHICLE Definition of an Apportionable Vehicles Article II of the Plan Any Power Unit that is used or intended for use in two or more member jurisdictions and that is used for the transportation of persons for hire or designed, used or maintained primarily for the transportation of property, and: APPORTIONABLE VEHICLE (i) has two axles and a gross vehicle weight or registered gross vehicle weight in excess of 26,000 lbs (11,793.401) 2

APPORTIONABLE VEHICLE or (ii) has three or more axles, regardless of weight, APPORTIONABLE VEHICLE or (iii) is use in combination, when the gross vehicle weight of such combination exceeds 26,000 pounds (11,793.401 kilograms) 3

APPORTIONABLE VEHICLE A recreational vehicle, a vehicle displaying restricted plates, a bus used in the transportation of chartered parties or a government-owned vehicle, is not an apportionable vehicle; EXEMPT VEHICLES: Recreational vehicle Vehicles displaying restricted plates City pick-up and delivery vehicles Charter buses Government-owned vehicles Vehicles having a gvw of 26,000 lbs (11,793.401 kilograms or less APPORTIONABLE VEHICLE RESTRICTED PLATE: Time (less than a registration year), geographic area, distance or commodity restrictions. Because a jurisdiction declares a plate restricted, it may not be honored by all jurisdictions. 4

APPORTIONABLE VEHICLE Except that a truck or truck tractor, or the power unit in a combination of vehicles having a gross vehicle weight of 26,000 pounds (11,793.401), or less, and a bus used in the transportation of chartered parties, nevertheless may be registered under the Plan at the option of the registrant. 5

APPORTIONABLE VEHICLE So what does this mean Sam-I-am? I would not, could not apportion a city truck. I would not, could not apportion a pick-up truck. But I would and could issue a Long Haul Carriers an apportioned plate. But I would and could apportion a pick-up truck if Sam-I-Am wanted to. Apportioned Vehicles 6

Apportion Registration Forms How do I register an apportioned vehicle? All jurisdictions have an IRP form, as required by the Plan, under Section 315. Each jurisdiction decides the total content and look of their form. Apportion Registration Forms The Plan requires certain data elements to be transmitted to fellow jurisdictions under Section 1215, and are common to all IRP applications. This includes the vehicle, the account number, the jurisdictions traveled in, and weight of the vehicles. These factors are necessary and will be used to calculate the fees for that vehicle for its apportioned registration. 7

Apportion Registration Forms ORIGINAL AND RENEWAL APPLICATIONS If a registrant is filing an original application, Schedules A and B must be submitted, processed and verified. For renewals, a computer generated renewal or schedule A and B must be submitted, processed and verified. (A modified Schedule A is used as additional pages for large carriers. Only the vehicle information is included on the continued pages.) If the registrant is filing a supplemental application to a currently registered fleet, Schedule C needs to be verified. Apportion Registration Credentials Section 600 of the Plan begins: 600 CREDENTIALS FOR APPORTIONED REGISTRATION (a) Upon the registration of an Apportionable Vehicle under the Plan, the Base Jurisdiction shall issue a Cab Card and a Plate for the Vehicle, and these shall be the sole registration Credentials issued for the Vehicle. The Plate shall be identified by having the word apportioned, APP, or PRP and the name of the Base Jurisdiction. The numbering system and color of the Plate shall be determined by the Base Jurisdiction. 10

Apportion Registration Credentials b) A Base Jurisdiction shall require that the Cab Card be carried in the Vehicle for which it is issued. A Base Jurisdiction may issue a Cab Card by electronic means and may permit Registrants to use photocopies of Cab Cards. Member Jurisdictions must accept a Cab Card that has been issued in accordance with the law of the Base Jurisdiction. Apportion Registration Credentials (Examples) 11

Apportion Registration Credentials (Examples) Apportion Registration Credentials What has to be on the cab card? Section 610 of the Plan states the various pieces of data that have to be on the cab card. Such elements include the make, model, and VIN of the vehicle, along with the jurisdictions that the vehicle can travel through and the registered weights for those jurisdictions 12

Law Enforcement Use of Credentials At roadside, Law Enforcement will use the cab card to determine whether the vehicle is a properly registered vehicle under both the laws of that jurisdiction and International Registration Plan Section 610 contains commentary that gives some direction on the use of the credential by roadside enforcement, and gives the jurisdictions some direction as to what else the document may or may not contain Law Enforcement Use of Credentials Official Commentary (Section 610) The weight or number of combined Axles for which the Apportioned Vehicle is registered must appear on the face of the Cab Card so that enforcement personnel can know whether an Apportioned Vehicle is operating in excess of its registered weight or number of combined Axles. An Apportioned Vehicle must not only be properly registered in its Base Jurisdiction with regard to declared gross weight, it must also comply with existing weight laws or regulations in other Member Jurisdictions into or through which it operates. 13

Law Enforcement Use of Credentials (Cont) For example, the payment of Apportionable Fees in Member Jurisdiction X at a declared gross combined weight of 80,000 pounds does not of itself authorize the operation of that Vehicle at 80,000 pounds in Member Jurisdiction Y, where the legal weight limit may be lower. The term other necessary information refers to information required by Member Jurisdiction registration statutes and is not to be construed to require unrelated information, such as fuel use tax account numbers, operating authority numbers, weight-distance tax account numbers, etc. Law Enforcement Use of Credentials What happens if the officer finds the vehicles not properly registered under the Plan? If law enforcement determines that a carrier is improperly registered or not registered at all, the officer may write a citation for an improperly registered or unregistered vehicle, depending on the laws of your jurisdiction. In additional, if found in violation of weight laws, the carrier may be issued a citation for being overweight, which in most cases carries a heavy fine. 14

Law Enforcement Use of Credentials How does Law Enforcement Access Information? Most jurisdictions have electronic access to their information. Some have telephone systems for law enforcement to verify credentials. In each case, the jurisdictions is required as part of Section 600 (c) to have a means by which law enforcement can verify the validity of that cab card.
