ORDINANCE NO. 2015-1 O AN ORDINANCE AMENDING SECTIONS 10.04.010AND10.04.150 OF THE GENERAL ORDINANCE CODE OF THE COUNTY OF ALAMEDA TO PROHIBIT SKATEBOARDING ON DESIGNATED COUNTY PROPERTY The Board of Supervisors of the County of Alameda ordains as follows: SECTION I Section 10.04.010 of the General Code of Alameda County is hereby amended to read as follows: 10.04.010 Construction of chapter-definitions. The general provisions and definitions contained in this chapter shall govern the construction of this chapter, unless the context otherwise requires. "Bus stop" means that space adjacent to a curb reserved exclusively for the loading and unloading of passengers of a bus and marked and designated as provided in this chapter. "County property" means real property. including any buildings thereon. in the unincorporated and incorporated areas of the county that is owned. leased. or controlled by the county and includes. without limitation. public buildings and facilities and their surrounding grounds and improvements. walkways. footpaths. stairs. planters. access ramps. railings. monuments. fountains. plazas. driveways. parking lots. or other paved areas. For the purposes of this chapter. "county property" shall not include county roads. streets. highways, sidewalks. lanes or alleys, as defined by the California Vehicle Code. "Crosswalk" means any portion of a roadway distinctly indicated for pedestrian crossing by lines or other markings on the surface. "Disabled person and veterans parking zone" means that space adjacent to a curb reserved exclusively for the use of disabled persons and veterans and marked and designated as pro'vided in this chapter. "Loading zone" means that space adjacent to a curb reserved exclusively for the loading or unloading of passengers or freight and marked and designated as provided in this chapter. "One way highway" means a highway or part thereof on which vehicular traffic, including bicycles, and driven animals shall move only in that direction indicated by signing erected and maintained at every intersection and where movement in the opposite direction is prohibited. "Park" or "parking" means the standing of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers. "Parking zone" means that portion of a street or highway whereon an operator may be authorized to park any vehicle, during such time and in the manner authorized by this chapter. Each provision in this title regulating parking shall be subject to later provisions regulating parking which may include areas already regulated.

"Skateboard" means any vehicle. device, or contrivance with any number of wheels. with a riding surface of any design. upon which a person may place one or both feet, and which is designed to be. or can be. propelled by human power. and which is not defined as a bicycle by the California Vehicle Code. The term "skateboard" also includes motorized skateboards. "Taxi stand" means that space adjacent to a curb reserved exclusively for the use of operators of taxicabs in the business of transporting passengers for fares while engaged in loading and unloading passengers of, or while waiting for employment by passengers for, such taxicab, marked and designated as provided in this chapter. SECTION II Section 10.04.150 of the General Code of Alameda County is hereby amended to read as follows: 10.04.150 Skateboards. A. Prudent Operation. No person shall ride or propel a skateboard upon a roadway at a speed greater than is, or in a manner other than is, reasonable or prudent having due regard for weather, visibility, the traffic on, and the grade, surface and width of, the roadway, and in no event at a speed or in a manner which endangers his safety or the safety of other persons or property. B. Heavily Traveled Roads. No person shall ride or propel a skateboard on any roadway which has been divided into two or more clearly marked lanes for traffic in each direction. C. Attachment to Vehicles. No person riding or propelling a skateboard on a roadway shall attach the same or himself to any vehicle, animal or bicycle. D. Intersections. No person shall ride or propel a skateboard within one hundred (100) feet of his approach to or departure from any intersection of highways or within any such intersections. E. Interference with Vehicles. No person shall ride or propel a skateboard on or across any roadway in such a manner as to interfere with the movement of vehicles thereon. F. Business District. No person shall ride or propel a skateboard in the streets, sidewalks, or public parking areas of any business district in the county. G. Hours of Darkness. No person shall ride or propel a skateboard on a roadway during the hours of darkness. H. Packages. No person riding or propelling a skateboard on a roadway shall carry any package, bundle or article in his hands. I. Bicycle Lanes. No person shall ride or propel a skateboard in the bicycle lane described in Section 10.24.080 J. Safe Operation. Any person riding or propelling a skateboard on a roadway shall do so in a standing position, with at least one foot resting on the skateboard at all times, and in no event

shall the rider kneel, sit or lay on a skateboard, or allow his hands to contact the skateboard while riding. K. Skateboarding prohibited. No person shall ride or propel a skateboard on county property at or on the following locations: 1... County of Alameda Administration Building at 1221 Oak Street, Oakland. California 94612; 2. Rene C. Davidson Court House at 1225 Fallon Street. Oakland. California 94612; or 3. Any other county property. provided that the property is clearly and conspicuously posted with signs stating that skateboarding is prohibited. SECTION Ill This ordinance shall take effect and be in force thirty (30) days from and after the date of passage and before the expiration of fifteen (15) days after its passage it shall be published once with the names of the members voting for and against the same in the Inter-City Express, a newspaper published in the County of Alameda.
