ADVANCED EMERGENCY BRAKING SYSTEM (AEBS) DISCLAIMER

OnGuardACTIVETM Disclaimer WABCO s advanced emergency braking system (AEBS) with active braking on moving, stopping and stationary vehicles OnGuardACTIVE is a Collision Safety System which includes Adaptive Cruise Control (ACC) and Autonomous Emergency Braking System (AEBS) functionality that assists the driver in maintaining a safe following distance. OnGuardACTIVE serves as Collision Mitigation System (CMS) that detects a potential rear-end collision developing ahead and responds by braking as needed to assist the driver in avoiding a collision. Mitigates imminent collisions with stationary vehicles: Alerts the driver via acoustic, visual and haptic signals Provides partial braking to reduce impact of unavoidable collision Long range radar enables early identification of imminent rear-end collisions Helps prevent imminent collisions with moving or stopping vehicles: Alerts the driver via acoustic, visual and haptic signals Provides up to full braking and can bring vehicle to a complete stop OnGuardACTIVE is designed to support the driver in his/her task to safely operate the vehicle. Although it is the aim of the system to prevent an imminent collision situation, it may not prevent or even mitigate an upcoming accident due it its limited sensing, perception and actuation capabilities. OnGuardACTIVE is not designed to drive the vehicle autonomously. For that reason OnGuardACTIVE does not relieve the driver from his/her responsibility to safely operate the vehicle at any time. Especially the driver has to adapt his/her driving behavior to his/her personal driving capabilities, legal requirements and the overall traffic and road conditions. Even with an active system, the driver is responsible to follow road speed limitations, ensure a safe following distance, comply to driving time regulations and obey overtake restrictions.

OnGuardACTIVE TM Disclaimer AEBS PERFORMANCE LIMITATION IN SPECIAL DRIVING SITUATIONS OnGuardACTIVE does contain two To better understand the functionality of main functions: OnGuardACTIVE typical use cases are Adaptive Cruise Control (ACC) and described on the following pages. Advanced Emergency Braking System (AEBS) OnGuardACTIVE may initiate forward collision warnings or in seldom cases Remark: unwanted or inappropriate acceleration or Specific human machine interface (HMI) deceleration. In such cases the driver has details for OnGuardACTIVE to be added by either to deactivate or to override the system respective OEM: as described above. Operation states To better understand the potential limitations Audio/visual instrumentation of OnGuardACTIVE exemplary scenarios Input devices are described afterwards. These examples Operation logics (enabling / disabling represent typical traffic situations but do not conditions / possibilities to override claim to be complete or exact. the system) Unless otherwise provided and to the maximum extent permitted by law, WABCO does not make any representation or warranty, expressed or implied, arising by operation of law or otherwise, including, without limitation, any warranty of merchantability or fitness for a particular purpose and/or warranty for hidden or latent defects, that would apply to the OnGuardACTIVE products. AEBS may limit its performance when confronted with special driving situations. The performance might be limited to mitigating the collision, warning on forward collision or even no reaction. Special driving situations include: At least first 10km after ignition on First kilometers after load changes Driving narrow curves Inappropriate speed Tunnels, bridges OnGuardACTIVE DOES ONLY REACT ON TRAFFIC RIDING INTO THE SAME DIRECTION OnGuardACTIVE (AEBS + ACC) does not react on oncoming traffic (overtaking vehicle on single lane road) WABCO and its affiliates exclude any liability whatsoever for direct, indirect, incidental, special, or consequential damages, costs or expenses of any kind howsoever arising, directly or indirectly, from any use of any OnGuardACTIVE products or otherwise arising in connection with any OnGuardACTIVE products. The foregoing limitation shall not apply to personal injury claims caused by WABCO s negligence, unless applicable law permits otherwise. The OnGuardACTIVE products being driver assistance devices only, in no event shall WABCO be liable for damages of any kind related to reliance on such products as safety devices. OnGuardACTIVE (AEBS + ACC) does not react on crossing traffic

DRIVING SITUATION: ACC SYSTEM ON DRIVING SITUATION: OnGuardACTIVE PERFORMANCE ON STATIONARY OBJECTS ACC may request the driver to take over control at any time. Typical situations include: Long downhill driving while following another vehicle (risk of overheating brakes) Strong deceleration of preceding vehicles Low engine speed AEBS does not prevent an accident with a stationary object on its own but only mitigates a crash. ACC does not react on stationary objects at all. Typical situations include but are not limited to: traffic jam, stationary road side objects.

DRIVING SITUATION: CORNERING, ENTERING AND EXITING BENDS DRIVING SITUATION: STATIONARY OBJECTS The ability of OnGuardACTIVE (AEBS + ACC) to detect vehicles on bends is limited. While cornering, entering or exiting the bends, the system may interpret traffic ahead in a wrong way. OnGuardACTIVE may unexpectedly issue warnings or brake your vehicle. OnGuardACTIVE may also accelerate the vehicle unexpectedly. Driver must exert extra caution while cornering the vehicle on bends. OnGuardACTIVE (AEBS + ACC) can unexpectedly issue warnings and brake the vehicle if it detects stationary objects, e.g. Lamp posts Traffic signs Bridges Roundabouts Traffic refuges Driver should pay extra attention to stationary objects beside the road to react on unexpected vehicle behavior.

DRIVING SITUATION: DIFFERENT LANES AND STATIONARY VEHICLES DRIVING SITUATION: VEHICLES TURNING OFF OnGuardACTIVE (AEBS + ACC) may experience difficulties at exits particularly when other vehicles are driving on hard shoulder or are pulling out. OnGuardACTIVE may unexpectedly issue warnings or slow down your vehicle. Drivers must take extra care at exits and take full control of the vehicle to avoid unexpected braking. On junctions or intersections, OnGuardACTIVE (AEBS + ACC) may unexpectedly issue warnings on vehicles that are turning-off in front of your vehicle. It may as well apply brakes in a manner which is different to drivers expectations. Driver must pay full attention hence on vehicles that turn-off on junctions and intersections.

DRIVING SITUATION: OTHER VEHICLES CHANGING LANE OnGuardACTIVE (AEBS + ACC) may detect vehicles (truck, car, motorcycle) pulling into your lane a bit later. The distance to the vehicle entering in front of your lane may than be too short. Driver in this situation should make use of the service brake to maintain the required safe distance to the vehicle pulling in the front.

DRIVING SITUATION: OVERTAKING DRIVING SITUATION: WINDING ROAD When overtaking, OnGuardACTIVE (AEBS + ACC) may unexpectedly issue warnings or slows down the vehicle if driver: On winding stretches of road, OnGuardACTIVE (AEBS + ACC) may not detect which lane the vehicle in front is driving in. Drives too close to the vehicle in front and Is in the same lane as the vehicle in front Therefore driver should complete the lane change maneuver without reducing the safety distance to the front vehicle. OnGuardACTIVE hence may unexpectedly issue warnings or slow down your vehicle. OnGuard may also accelerate the vehicle unexpectedly if a vehicle in front is not detected by the distance sensor properly. Driver must pay extra attention on winding stretches and take full control of the vehicle by applying the service brakes.
