0 STATE OF WYOMING LSO-0 HOUSE BILL NO. HB0 Natural gas vehicles. Sponsored by: Representative(s) Roscoe and Miller A BILL for 0 AN ACT relating to motor vehicles; providing that the department of transportation may construct and operate natural gas stations as specified; providing that the public may utilize department of transportation natural gas stations as specified; providing requirements and regulations for retrofit natural gas vehicles; providing that the department of administration and information may enter into contracts for the construction and operation of natural gas filling stations; providing for the conversion of state vehicles to operate on natural gas as specified; providing rulemaking authority; providing appropriations; and providing for an effective date. 0 STATE OF WYOMING LSO-0 CHAPTER 0 NATURAL GAS VEHICLES -0-0. Definitions. (a) As used in this chapter: (i) "Bi-fuel vehicle" means a vehicle that can 0 operate on natural gas and another form of fuel; (ii) "CSA America CNG fuel system inspector" means an inspector with the highest level of certification that complies with the International Organization for Standardization (ISO) 0 standard and applicable CSA and ANSI standards for personnel certification programs to include the inspection of containers, valves, pressure relief devices, including vent system and other fuel system components of natural gas powered vehicles; 0 (iii) "Gasoline gallon equivalent (GGE)" means the amount of natural gas needed to equal the energy content of one liquid gallon of gasoline; HB0
0 STATE OF WYOMING LSO-0 (iv) "Motor vehicle" means any self-propelled vehicle intended primarily for use and operation on highways; (v) "Natural gas" means compressed natural gas (CNG) or liquefied natural gas (LNG); (vi) "Private individual or entity" means any individual or entity that: 0 (A) Is not acting under the authority of a state or local government agency; (B) Is not purchasing natural gas from the state's fuel network for sale, resale, distribution, redistribution, trade, exchange or in furtherance of a commercial enterprise; and (C) Is not purchasing natural gas from the 0 state's fuel network for use in a state vehicle. (vii) "Retrofit natural gas vehicles" means a vehicle which was not designed by the original equipment manufacturer to be powered by natural gas but was HB0
0 STATE OF WYOMING LSO-0 subsequently modified to be powered by natural gas solely, or natural gas and another form of fuel; and 0 (viii) "State vehicle" means a vehicle owned and operated by any agency, authority, bureau, board, commission, department or division under the control of the state, a county, city or town or other political subdivision of the state, the state legislature, a school district, community college, the University of Wyoming and the judiciary. -0-0. Department of transportation natural gas filling stations; authority of public to purchase natural gas from the state fuel network; rulemaking authority. 0 (a) The department of transportation is authorized to construct and maintain natural gas filling stations at any department of transportation fueling site or other site that the department deems appropriate which qualifies under the provisions of this section and the rules and regulations promulgated hereunder. (b) A natural gas filling station located at a department of transportation fueling site may have either HB0
0 STATE OF WYOMING LSO-0 fast fill capacity, time fill capacity or both as the department determines is appropriate. (c) The department may allow a private individual or entity to purchase natural gas from the state's fuel network if: (i) There is no commercial fuel site that meets 0 the geographical natural gas distribution needs of private individuals or entities; and (ii) There is no emergency that, as determined by the department, warrants the holding of natural gas in reserve for use by state or emergency vehicles. (d) The department may promulgate rules and regulations to effectuate the purpose of this section, including: 0 (i) Giving state and local agencies priority to dispense and receive natural gas from the state's fuel network sites; HB0
0 STATE OF WYOMING LSO-0 (ii) Designating state fuel network sites that may be made available to private individuals and entities for the purchase of natural gas; (iii) Defining the terms of operation for each site constructed and operated pursuant to this section; 0 (iv) Unless otherwise prohibited by law, limiting the amount of natural gas that may be purchased from the state's fuel network by any private individual or entity at any one time, or in the aggregate during any given period of time; (v) Providing conditions upon which a private individual or entity's authorization to purchase natural gas from the state fuel network may be granted, revoked, or suspended under this section; and 0 (vi) Defining the term "geographical natural gas needs of a private individual or entity." -0-0. Requests for proposals to construct and operate natural gas filling stations; terms of a contract. HB0
0 STATE OF WYOMING LSO-0 (a) The department of administration and information may issue requests for proposals for the construction of two () natural gas filling stations. The requests for proposals shall specify that for any contract awarded under this section: (i) The state will be responsible for seventy- 0 five percent (%) of the total cost of designing and constructing the natural gas station and the operating entity shall be responsible for the remainder of the cost of designing and constructing the natural gas station; (ii) The department of administration and information, in consultation with the department of transportation, will have final approval authority concerning all aspects of the location, design, construction, financing and operation of the natural gas filling station; 0 (iii) The price per gasoline gallon equivalent for natural gas for use in a state vehicle shall not exceed the lesser of the wholesale cost of natural gas paid by the operating entity plus ten percent (0%) or the price per gasoline gallon equivalent charged to the public. 0 STATE OF WYOMING LSO-0 price per gasoline gallon equivalent for natural gas for use in a state vehicle as specified in this paragraph shall remain in effect until the earlier of: (A) Five () years from the date the natural gas filling station becomes operational; or 0 (B) The date on which the dollar amount saved by the state from paying the price per gasoline gallon equivalent of natural gas specified in this paragraph as compared to the price the public paid for natural gas during the same time period, equals the state's investment in the natural gas filling station. (iv) Shall require that the contract term is not less than five () years; 0 (v) Specify that the natural gas filling station shall have both fast fill capacity and time fill capacity or both; and (vi) Any other term and condition the department of administration and information, in consultation with the department of transportation, deems appropriate. 0 STATE OF WYOMING LSO-0 (b) The department of administration and information shall consult with the department of transportation and interested parties in the private sector to determine where the two () natural gas filling stations shall be located. In determining the location of the natural gas filling stations, the department of administration and information shall consider cities or towns: 0 (i) With a significant number of government or private fleet vehicles with the potential to convert to natural gas; (ii) A site which will ensure a natural gas corridor across Interstate 0; and (iii) A site along another interstate highway or important transportation corridor. 0-0-0. Retrofit natural gas vehicles; inspections, standards and certification; compliance with other law; programs to coordinate; rulemaking authority. HB0
0 STATE OF WYOMING LSO-0 (a) A state agency which owns, operates and maintains motor vehicles may retrofit any motor vehicle to run on natural gas, or retrofit the vehicle as a bi-fuel vehicle. (b) An owner of a retrofit natural gas vehicle that 0 is retrofit on or after July, 0, may not operate the retrofit natural gas vehicle before the owner has the retrofit natural gas vehicle inspected and certified as safe in accordance with relevant standards, including the National Fire Protection Association Vehicular Gaseous Fuel Systems Code, by a CSA America CNG Fuel System Inspector. (c) A person who performs a retrofit on a retrofit natural gas vehicle shall certify to the owner of the retrofit natural gas vehicle that the retrofit does not tamper with, circumvent, or otherwise affect the vehicle's on-board diagnostic system, if any. 0 (d) After the owner of a retrofit natural gas vehicle that is retrofit on or after July, 0, has the retrofit natural gas vehicle initially inspected under subsection (a) of this section, the owner shall subsequently have the 0 HB0
0 STATE OF WYOMING LSO-0 retrofit inspected for safety by a CSA America CNG Fuel System Inspector the earlier of: (i) Every three () years after the retrofit; or after the retrofit. (ii) Every thirty-six thousand (,000) miles 0 (e) The department of transportation may develop programs and promulgate rules and regulations to coordinate amongst government agencies and interested parties in the private sector to facilitate: (i) Testing to ensure compliance with emissions and anti-tampering standards established in this section or by federal law; and (ii) The retrofitting of vehicles to operate on 0 natural gas vehicles in a manner that provides for safety and compliance with applicable law. (f) In developing a program under this section, the department of transportation shall: HB0
0 STATE OF WYOMING LSO-0 (i) Allow for testing using equipment widely available within the state, if possible; and (ii) Consult with relevant federal, state and local government agencies and other interested parties. Section. (a) There is appropriated one million eight hundred 0 thousand dollars ($,00,000.00) from the general fund to the department of administration and information for the construction and operation of natural gas filling stations as specified in this act. If any amount of this appropriation is unexpended as of June 0, 0, the unexpended amount of the appropriation shall revert to the general fund on July, 0. 0 (b) There is appropriated two hundred thousand dollars ($00,000.00) from the general fund to the department of transportation to retrofit twenty (0) motor vehicles in its fleet to operate on natural gas, or a combination of natural gas and another form of fuel.
