TOWAMENSING TRAILS PROPERTY OWNERS ASSOCIATION 2014 RECREATIONAL VEHICLE REGULATIONS Recreational vehicles may be used on the roads of Towamensing Trails and marina area only in conformity with State regulations and the regulations listed below. The existing Security Force shall govern the enforcement of all regulations relating to Recreational Vehicles. Copies of the Rules & Regulations for operating a recreational vehicle on TTPOA roads and marina will be available in the POA office and should be read by owners and operators. Riding a vehicle on the Dam will result in a $1000.00 (one thousand dollar) fine. APPROVED RECREATIONAL VEHICLES 1. ATV Class I 2. ATV Class II 3. Snowmobile 4. Golf Cart 5. Electric Bicycle (A two or three wheeled vehicle with fully operable pedals and electric motor of less than 750 watts, whose maximum speed is less than 20mph (32 km/h). Annual Registration 1. All recreational vehicles used on Towamensing Trails roads and marina area must be registered at the Administration Office. The property owner may not accomplish registration before compliance with all requirements below. Only Property Owners can register. a. Owner must be a member in good standing of the Towamensing Trails Property Owners Association. b. Completion of a registration form approved by the Board of Directors to be maintained in the Administration office. c. Proof of State registration where required d. Proof of ownership where state registration is not required. e. It will be mandatory for all persons who operate, own, or use any of the previously mentioned vehicles to sign a waiver of liability, absolving all TTPOA Association Members, their families and heirs, of any claim arising from, or caused by the operation of, contact with, or injury/death, or any other such malady involving any of the said vehicles on any Association roads or subdivision property either public or private. f. In case of the operation of any vehicle by a minor less than eighteen (18) years of age, it will be mandatory for an Acceptance of Responsibility Form to be signed by the parent or the Guardian. The parent or guardian accepts full responsibility for the actions and it is with operation alone, to be construed to be by their implied consent. With this acceptance of responsibility the parent or guardian agrees to be responsible for any and all fines incurred by any infractions. Minors must carry TTPOA issued waiver card while operating vehicles. g. The owner must provide a copy of their Liability insurance h. payment of registration fee 1

2. Upon compliance an appropriate identification plate and/or sticker and flag will be given for display on the vehicle. Plates will be given for all golf carts. The flag must be affixed to the vehicle so that it is visible 6 (six feet) from the roadway. The identification plate and/or sticker must be visible from the rear of the recreational vehicle. If your plate or flag is lost or stolen you must notify Security immediately. REGISTRATION FEE All Recreational Vehicles New Registration $35.00 Renewals $35.00 Replacement Plate or sticker $10.00 Replacement Flag $25.00 Boat Registration $10.00 Expiration of TTPOA Registration 1. January 1 of the following year 2. Expiration upon Transfer The certificate of registration issued to the owners of all recreational vehicles shall expire and the plate shall become invalid when ownership is transferred. Upon sale of the vehicle, the seller must surrender the plate to the Administration office. 3. Lack of Liability Insurance Anyone dropping Liability insurance during the year of operation of said vehicles will be subject to a fine of s and removal of vehicle from the property. 4. Multiple Violations When guilty of multiple violations and/or willful disregard of a Security Officer s orders, the vehicle shall be banned from Towamensing Trails roads and the registration will be suspended for a period of up to one (1) year. Repeat violations will result in permanent revocation of registration. The operator shall not drive any recreational vehicle on TTPOA roads for a like period. 5. Failure to Pay Fines If found guilty; payment of these fines will be mandatory, within a (15) fifteen day submission period from the day of the offense. Failure to pay these fines will result in the withholding of all privileges by the TTPOA for the following year. (Trash permit included). 2

General Operating ATV All Property Owners must register their recreational vehicle. No one under ten (10) years of age shall operate a recreational vehicle in Towamensing Trails. All Towamensing Trails traffic rules must be obeyed. Pedestrians and bicyclists have the right of way over all motor driven vehicles. Do not operate your recreational vehicle in a careless way as to endanger any person or the property of another. Operation of any vehicle in such a manner so as to constitute harassment or a nuisance is prohibited, and shall be viewed as disorderly conduct. All state regulations must be obeyed No persons between the age of 10 and 16 shall drive an ATV across any roads in Towamensing Trails unless they have a valid safety Certificate and TTPOA ATV safety card and are accompanied by a parent or guardian. No more than one (1) person may ride a four wheel ATV at any time, except when the driver is 18 years of age or older. GOLF CART No persons between the age of 10 and 16 shall drive a golf cart across any roads in Towamensing Trails unless accompanied by a parent or legal guardian. No more passengers than the number of full seats provided may ride a golf cart and all passengers must be occupying said seats in a proper manner. Golf carts must maintain satisfactory lighting system to include headlights and tail lights. Snowmobile All state regulations must be obeyed All youth ages ten (10) through sixteen (16) must show proof of passing an approved snowmobile training course before operating a snowmobile on Towamensing roads (state required). Electric Bicycle Person must be sixteen (16) years of age to operate an electric bicycle. Only one rider per bicycle. Electric bicycle must have headlights and taillights to operate after sunset and before sunrise. Waiver of Liability form must be completed at the TTPOA office. 3

Hours of Operation There is a curfew for all ATV I and ATV II, Golf Cart and Electric bicycles for anyone under sixteen (16) years of age. Curfew as follows: 1. Sunday through Thursday from 9:00 PM to 8:00 AM 2. Friday through Saturday from 10:00 PM to 8:00 AM 3. Adults 21yrs of age and older with Golf Cart/ATV II are permitted with proper lighting, to operate at any time. There will be a (15) fifteen minute grace period after a TTPOA function. The operator must then follow a direct route from the TTPOA function home. Accident Reports The operator of a recreational vehicle involved in an accident must stop and exchange all pertinent information with the other party involved, i.e. name, address, the name and address of the owner of the recreational vehicle, registration and insurance information. Information must be given to Security. The operator of any recreational vehicle involved in an accident which results in the injury or death of any person, or property damage to the extent of $100.00 or more, MUST report the matter in writing within seven (7) days, to the DEPARTMENT OF CONSERVATION AND NATURAL RESOURCES. It is a violation of the recreational vehicle law not to report an ATV accident to the DEPARTMENT OF CONSERVATION AND NATURAL RESOURCES Snowmobile/ATV Unit. Accidents involving all other recreational vehicles shall be reported in the same manner. There is a zero tolerance dealing with the operation of a recreational vehicle Owners of recreational vehicles are responsible for all Fines issued and take responsibility for all liability. 4
