1 of 10 AVAILABILITY Available to any county or municipality in which the Company operates the local electric distribution system or to the State of Alabama for service along any highway adjacent to an electric distribution system of the Company. APPLICABILITY Applicable to street or highway illumination, including ornamental lighting. Service hereunder shall be subject to the additional terms, conditions and adjustments set forth in Special Rules and Regulations of the Company governing application of this rate. ADDITIONAL FACILITIES CHARGE When the installation requires facilities not covered by the specific service conditions described below for the type of lighting equipment being installed, an Additional Facilities Charge will be added to the other monthly charges. The Additional Facilities Charge will be applied monthly in an amount equal to 2.50% of the estimated cost of any additional facilities utilized, provided, however, that any such charge shall not be less than $1.00. CHARACTER OF SERVICE FOR COMPANY OWNED The annual rates set forth on pages 3-7 are applicable to the following service conditions: Standard and Off-Road Luminaires: The annual rate is for the luminaire and the initial installation of the luminaire mounted (with an 8 bracket or shorter) on a pole to be used for any other electric distribution service. The annual rate also covers the luminaire maintenance and the replacement of lamps and photoelectric controls upon failure. Decorative Post Top and Shoebox Luminaires: The annual rate is for the luminaire, the luminaire maintenance, and the replacement of lamps and photoelectric controls upon failure. Poles: Any pole installed to serve only lighting facilities will be billed the annual rate. The annual rate is for the pole only. The poles are available for use with all Company-owned luminaires subject to luminaire/pole mounting compatibility. The Company shall determine the most economical method of installation and control for all Company-owned luminaires. When the installation requires facilities not covered by the specific service conditions described above, an Additional Facilities Charge, computed as described under the heading "Additional Facilities", will be added to the other applicable charges for the

Neither the annual rate nor the Additional Facilities Charge covers the replacement of lamps, luminaires, poles, or conductors damaged or destroyed due to vandalism or willful abuse. Such replacements will be performed by the Company at the Customer's expense. CHARACTER OF SERVICE FOR CUSTOMER OWNED The annual rates set forth on page 8 cover the replacement of lamps and photoelectric controls upon routine failure. Lamps or photoelectric controls damaged or destroyed due to vandalism or willful abuse are not covered by the rate and will be replaced at the Customer's expense. Customer-owned luminaires and PE cell controls must be approved in advance as to serviceability and accessibility to be eligible for the Customer-owned SLM rate. Where access requires traffic control measures deemed to be beyond the Company s standard procedures (e.g., Freeways), the Company will provide lamps and photoelectric controls to the Customer and the performance of the necessary replacements will be the responsibility of the Customer. The Customer is responsible for the installation of all equipment and the electrical distribution system for the lighting. The distribution system shall serve no other electrical loads except the lighting equipment eligible for this rate. The Customer-owned fixtures may not be installed on Company poles. The Customer is responsible for all maintenance other than the replacement of lamps and photoelectric controls, except where access requires traffic control measures deemed to be beyond the Company s standard procedures as specified above. The Company may, at the request and at the expense of the Customer, replace or repair fixtures and glassware, if in stock.

CONTRACT PERIOD Service under this rate shall be for a minimum period of five (5) years and thereafter extended from year to year unless terminated by written notice from the Consumer sixty (60) days or more prior to the expiration of the initial period or any subsequent anniversary date. Service under this rate is subject to rules and regulations approved or prescribed by the Alabama Public Service Commission. ENERGY COST RECOVERY The amount calculated at the above rate will be increased under the provisions of the Company's Rate ECR (Energy Cost Recovery) by applying the effective Energy Cost Recovery Factor. RATE STABILIZATION AND EQUALIZATION Rate RSE (Rate Stabilization and Equalization Factor) is incorporated in this rate and will be applied to adjust (increase or decrease) kwh charges calculated hereunder. ADJUSTMENT FOR COMMERCIAL OPERATION OF CERTIFICATED NEW PLANT Rate CNP (Adjustment for Commercial Operation of Certificated New Plant) is incorporated in this rate and will be applied to increase kwh charges calculated hereunder.

10 of 10 GENERAL The amount calculated at the above rate is subject to possible tax adjustment as set forth in Rate T (Tax Adjustment) and to rules and regulations approved or prescribed by the Alabama Public Service Commission, including any Special Rules and Regulations governing the application of this rate.
