III. 86, Act No XXXIX of 2001 on the entry of foreign citizens into Hungary Before transporting a foreign citizen into or through the territory of Hungary, the transport operator must ascertain that the foreign citizen has a valid travel document and visa. The transport operator must arrange for the immediate transport of the foreign citizen back to the country from which he brought him/her if he/she is refused admittance into the territory of Hungary, if he/she is refused admittance to the destination country and is sent back to Hungary, or if the operator undertaking the ongoing transport operation refuses to embark him/her. If the transport operation cannot be carried out immediately, all costs related to the stay of the foreign citizen until his repatriation shall be borne by the transport operator. Furthermore, the immigration authorities will impose on the operator a penalty of 4000 per person transported illegally. If, however, the transport operator can prove that he carried out the necessary checks as mentioned above and that the person in question was in possession of valid travel documents when boarding his vehicle, he will be released from the obligation to repatriate the foreign citizen and to cover the related costs.
