TOWN OF BRUNSWICK NOTICE OF PUBLIC HEARING In accordance with Maine law, 23 M.R.S.A. 3026, notice is hereby given that the Town Council of the Town of Brunswick will hold a Public Hearing in the Town Council Chambers of the Town Hall, located at 85 Union Street, Brunswick, Maine at 7:00 p.m. on Monday, November 20, 2017 to consider input from neighbors and the general public regarding the potential discontinuance of a portion of Pine Street, a public way in Brunswick Maine, more particularly described as follows: Beginning on the northeasterly sideline of Pine Street at the southerly sideline of Bath Road; thence southeasterly by and along the northeasterly sideline of Pine Street to the southwesterly corner of land now or formerly of William C. Elmore, as conveyed by the deed recorded in the Cumberland County Registry of Deeds in Book 31754, Page 25; thence southwesterly perpendicular to the northeasterly sideline of Pine Street, crossing Pine Street, to the southwesterly sideline of Pine Street; thence northwesterly by and along the southwesterly sideline of Pine Street to the southerly sideline of Bath Road; thence easterly by and along the southerly sideline of Bath Road to the point of beginning. The section to be discontinued is illustrated on the enclosed map. To be clear, approval of the discontinuance order would mean that section of Pine Street would no longer be a public street. Discontinuance of the street would allow Bowdoin College to utilize the land on both sides of the discontinued portion of the street to construct improvements related to its Whittier Field athletic complex. Bowdoin College has agreed to construct a new access road from Bath Road to the remaining section of Pine Street. This new road could be a new public road. Alternatively the road could be designated as a private way and not be connected to Pine Street, meaning that the new road would not provide public access from Bath Road to the neighborhood. Brunswick public safety services prefer that the new access be a public road. A traffic study commissioned by the Town of Brunswick predicted that the proposed new road would have little impact on neighborhood traffic. A map depicting an approximate location of a new public road is enclosed. TOWN OF BRUNSWICK, MAINE IN TOWN COUNCIL November 6, 2017 Order of Discontinuance of a portion of Pine Street THE TOWN OF BRUNSWICK HEREBY ORDAINS AS FOLLOWS: That, pursuant to 23 M.R.S. 3026, the proposed order of discontinuance set forth below be filed with the Town Clerk. It is further ordered that the Town Clerk notify the owners of the abutting parcels of land of the proposed discontinuance and of the time and place for a public hearing on that discontinuance. Such notice shall be mailed by United States Postal Service, postage prepaid, first class, to the owners of the abutting parcels at the addresses which appear in the Town s assessment records. PROPOSED ORDER: Pursuant to 23 M.R.S. 3026, the Town of Brunswick hereby discontinues the public way of the portion of Pine Street more particularly described as follows: Beginning on the northeasterly sideline of Pine Street at the southerly sideline of Bath Road; thence southeasterly by and along the northeasterly sideline of Pine Street to the southwesterly corner of land now or formerly of William C. Approval of this Order of Discontinuance by the Town Council shall be expressly conditioned upon the Council s acceptance of an Easement Agreement from Bowdoin College and Pine Grove Cemetery in the form attached hereto as Exhibit A. 12365024.1

EASEMENT AGREEMENT This agreement is made by and between Bowdoin College ( Bowdoin ), a Maine corporation, Pine Grove Cemetery Association of Brunswick, Maine ( Pine Grove ), and the Town of Brunswick (the Town ), a body politic and corporate in Cumberland County, Maine. Bowdoin owns land abutting Pine Street in Brunswick, Maine. At the request of Bowdoin, a portion of Pine Street has been discontinued and is no longer a public way, with no public easement retained. As used in this agreement, the Road means the said discontinued portion of Pine Street. In order to provide for the continued use of the Road by the Town, Bowdoin and the Town agree as follows. 1. Bowdoin grants to the Town an easement to use the Road for pedestrian and vehicular traffic. During the term of this easement, the Town shall be responsible for the maintenance of the Road, at its own expense. Neither Bowdoin nor Pine Grove shall be liable for any claims for injury or loss arising from or occasioned by the maintenance of the Road (or lack thereof), except for its willful misconduct or bad faith. This easement shall terminate in accordance with Section 5 below. 2. Bowdoin also grants to the Town an easement to use a portion of the Road for a pedestrian walkway and/or a bicycle path (the Walkway/Path ) providing access between Bath Road and the portion of Pine Street remaining a public way. The locations of the Walkway/Path shall be subject to the right of Bowdoin to relocate them from time to time, provided that any such substituted locations shall be of reasonable convenience and safety for the said uses. Said easement for the Walkway/Path shall continue notwithstanding construction of the Substitute Road pursuant to Section 5 below. 3. Bowdoin shall be responsible for the maintenance of the Walkway/Path, at its own expense. The Walkway/Path shall be maintained in a passable condition, but passage may be adversely affected by snow, ice, and other weather conditions. Bowdoin shall not be liable for any claims for injury or loss arising from or occasioned by its maintenance of the Walkway/Path (or lack thereof), except for its willful misconduct or bad faith. 4. Routine maintenance services shall be performed at such intervals as will keep the Walkway/Path in good repair, but some services may be delayed or deferred to obtain a better rate or to make a more efficient work schedule. Any condition which renders the Walkway/Path impassable shall be repaired or remedied as soon as practicable. 5. At its own expense, Bowdoin shall construct a new road (the Substitute Road ) to provide access between Bath Road and the portion of Pine Street that remains a public way. The approximate location of the Substitute Road is shown on Exhibit A attached hereto. The Substitute Road shall be constructed to meet all applicable standards of the Town. When the Substitute Road is completed, the easement set forth in Section 1 above and the Town s maintenance obligations shall terminate, and Bowdoin shall deliver to the Town s officers a duly executed deed conveying the Substitute Road to the Town for use as a public way, in accordance - 1 -

with 23 M.R.S. 3025. Alternatively, at the election of the Town, Bowdoin shall retain the Substitute Road as a private way and shall grant the Town an easement to use the Substitute Road for access by emergency and municipal vehicles. 6. The use of the Road and the rights granted hereby shall at all times comply with all applicable governmental laws, ordinances, and regulations. 7. This agreement benefits and burdens the parties hereto and their successors and assigns. References herein to the named parties refer also to all future owners of their lands affected by this agreement. 8. Pine Grove joins in this agreement for the purpose of granting the easement, as set forth in Section 1 above, over the discontinued portion of Pine Street, a portion of which is owned by Pine Grove. By this limited joinder, Pine Grove does not undertake any obligation for any of the other provisions of this agreement. 9. This agreement assumes the discontinuance of a portion of Pine Street, but may be executed and delivered before such discontinuance. This agreement shall take effect upon the later of (a) the date of its execution stated below or (b) the date of said discontinuance. Town of Brunswick, Maine OFFICE OF THE TOWN MANAGER MEMORANDUM TO: FROM: DATE: SUBJECT: Town Council John Eldridge Town Manager November 2, 2017 (revised 11/9/17 for website) Discontinuance of Pine Street Staff Analysis of Request By letter dated October 20, 2017, Bowdoin College has requested that the Town discontinue, as a public way, a portion of Pine Street that runs from its intersection with Bath Road to the boundary of Bowdoin's ownership near the intersection of Pine and Bowker Streets. A map depicting the portion of the street proposed to be discontinued is attached. This memorandum summarizes staff s analysis of Bowdoin s request. Background Pine Street is a public way over land owned by the abutters. Bowdoin College is one of the abutters and its property is bisected by Pine Street. The College has recently made substantial improvements to its Whittier Field athletic complex, a facility the College owns, located on the south side of Pine Street. Phase I of the improvements included widening and resurfacing of the track, installation of a turf field, installation of bleachers on the north side of the field, and other improvements. Bowdoin College is currently planning Phase II of the project. Part of Phase II would include the location of locker room facilities on the north side of Whittier Field and an extension of the recently installed north side bleachers. These two improvements would encroach into the Pine Street rightof way. Bowdoin has determined that this location best serves the activities at Whittier Field. It also believes that locating the facilities on the north side of the field responds to the residents of Bowker Street who requested that improvements and traffic be moved away from the Bowker street residential properties. A neighborhood site walk was conducted by the Town s Planning and Development Department on August 14, 2017. This was followed by a meeting at Town Hall on the same date. The purpose of the site walk and meeting was to get a sense of the neighborhood reaction to the discontinuance of Pine Street and the creation of a new access road from Bath Road to the section of Pine Street that would remain. Subsequent to the site walk and Town Hall meeting, Town Staff met to discuss the public safety and traffic implications of the discontinuance, as the public has significant rights and responsibilities related to this right of way. Analysis Staff reviewed the request for discontinuance and concluded a newly constructed publicly owned and maintained connection from Bath Road to Pine Street would best serve public safety access and

Fire/EMS stated a strong preference for a public connection. Police also preferred a public connection to Maine Street. From the site walk and public meetings, there did not seem to be a clear neighborhood consensus about creating a new access road. Those who opposed or had reservations about the plan were concerned that a new public connection in the proposed location would increase the potential for traffic to cut through the neighborhood by using the new access to avoid the Bath Road/Sills Drive/Federal Street intersection. To address the cut through concerns the Town commissioned Maine Traffic Resources (MTR) to conduct an analysis to determine the likelihood of increased neighborhood traffic from a perceived cut through. In its report dated October 27, 2017, Maine Traffic Resources concluded that it is the professional opinion of MTR that cut through traffic would be highly unlikely on any of these three side streets. 1 2 MTR went on to add that, As previously determined, while no traffic from outside the neighborhood would be expected to cut through the neighborhood due to the proposed relocation of Pine Street, some of the neighborhood residents may be expected to alter their travel to use the relocated Pine Street connection from Bath Road. 3 So while MTR concluded that no additional traffic would likely cut through the neighborhood, it is possible that the residents of the neighborhood would find the new access/egress useful. In the event that the MTR s analysis did not accurately predict the impact, and there in fact was greater cut through traffic, staff and MTR believes this could be mitigated by several traffic calming measures. For one, the new connection to Bath Road could be converted to a private driveway that only allowed public safety vehicles pass through access. Another possibility is a one way public road. Should a new public access be constructed, staff recommends additional traffic counts be conducted post construction to ascertain traffic impacts on the neighborhood and the necessity for any traffic calming measures. As Pine Street serves as a bike and pedestrian access, staff also considered the impact discontinuing Pine Street would have on bike and pedestrian access to the Brunswick Landing Perimeter Road. In 2015, the Town constructed and opened a new connection to the Perimeter Road from the terminus of Pine Street. Staff does not believe that bike and pedestrian traffic should be encouraged to travel on Bath Road to reach the new access road. To minimize this concern, Bowdoin has agreed to maintain public bike and pedestrian access from Bath Road, near the route of the existing Pine Street. Another issue raised was traffic to and from the three cemeteries that are accessed from Pine Street. Bowdoin and the Pine Grove Cemetery Association have reached an access agreement that would allow visitors to the Pine Grove Cemetery to access the cemetery over a private way. That private way would be maintained by Bowdoin College and be located essentially where Pine Street now exists. It would not be a public way for general access; only a private way to access the cemetery. For the Varney and St. John s cemeteries, the public would be encouraged to access via Bath Road and the new connector to Pine Street. Should this new connector not allow public access, those visiting the cemeteries would travel on the neighborhood streets. On street parking on game or event days occurs throughout the neighborhood. Busses carrying athletes to and from events use local streets. If Pine Street is discontinued and a new connection made to Bath Road, staff expects Bowdoin College to utilize the new access and development flexibility to address these issues. Summary Discontinuance of Pine Street and the establishment of a public connection provide Bowdoin College with the greatest flexibility in planning improvements to Whittier Field and for the future development of College property between Pine Street and Bath Road. It also allows the College to meet the neighborhood preference that activities related to the field occur away from residential properties. A potential drawback is that a new access from Bath Road could result in increased vehicular traffic in the neighborhood. However, the Town s traffic consultant believes that cutthrough traffic was unlikely and that any increase in traffic in the neighborhood would result from the neighborhood residents use of the new access. The traffic consultant and the staff believe that any negative traffic impacts, determined from the post construction traffic counts, can be mitigated with traffic calming measures. Eldridge DATE: October 27, 2017 Town Manager Town of Brunswick 85 Union Street Brunswick, ME 04011-2418 RE: Traffic Review and Additional Analysis for the Pine Street Relocation for Whittier Field Improvements at Bowdoin College, Brunswick Maine Traffic Resources (MTR) was retained by the Town of Brunswick to review a memorandum completed by Sebago Technics regarding the potential Pine Street relocation due to planned improvements at Whitter Field at Bowdoin College. The memorandum was prepared by Derek H. Caldwell, P.E. and dated May 23, 2017. This memorandum summarizes the review of Sebago Technics study, which was performed to determine the effect of the Pine Street relocation on the Bowker Street neighborhood. In addition, the Town of Brunswick requested additional traffic analysis regarding the potential for cut-through traffic destined to the neighborhoods on Bowker Street, McLellan Street and Chamberlain Avenue, specifically as related to potential diverted trips due to the relocation of Pine Street, as opposed to traffic simply cutting through these neighborhoods. Pine Street currently intersects Bath Road at a skew away from Sills Drive, approximately 525 feet from the signalized intersection of Bath Road, Federal Street and Sills Drive. According to the Sebago memorandum, Bowdoin College is proposing to relocate Pine Street approximately 1,375 feet east of the existing location. The new intersection would intersect Bath Road at approximately a 90-degree angle, as opposed to the current skew, which is less than 45 degrees. Data Collection Sebago Technics obtained turning movement counts on April 19, 2017 at the Bath Road intersections of Federal Street/ Sills Drive and Pine Street during the AM (7:00 9:00 AM) and PM (4:00 6:00 PM) peak hour periods. The AM peak hour for both intersections occurred 8:00 to 9:00 AM. The PM peak hour for both intersections occurred from 4:00 to 5:00 PM. In addition, automatic traffic recorder (ATR) data was also collected at 20 Bath Road and 54. Page 1

The counts, including Sebago s counts, were factored to the first week in September, which is generally considered peak for school and college areas, using MaineDOT urban group mean factors. These factors are derived by MaineDOT from numerous continuous count stations located throughout Maine since peak volumes are used for traffic design and analysis purposes. The factored volumes are also shown on the count records. The resulting 2017 peak hour volumes for both the AM and PM peak hours, expected under early September conditions, are summarized graphically in Figure 1. Travel Time Analysis Sebago Technics calculated travel times between 20 Bath Road and 54 Harpswell Road by utilizing the traffic simulation software, VISSIM. This model simulated the total travel time along the 4,000-foot route from Bath Road through the signalized intersection of Bath Road, Federal Street and Sills Drive to and vice versa. Their results for the AM and PM peak hours are shown below: Sebago Technics Travel Time Simulation Results Travel Route AM Peak Hour PM Peak Hour to Bath Road 93 seconds 98 seconds Bath Road to 100 seconds 101 seconds In comparison, Maine Traffic Resources conducted field measured travel time runs for both paths during the AM peak hour period on October 12, 2017 and during the PM peak hour period on October 18, 2017. A table showing all of the travel time results is attached to this memorandum. MTR calculated the average travel time for each route. It is important to note that MTR s runs were conducted from Chamberlain Avenue to 20 Bath Road since MTR was also interested in projecting Chamberlain Road residents who Page 2

Pine Street Relocation, Brunswick 10/27/2017 may utilize a relocated Pine Street. The timed difference in the field between Chamberlain Avenue and 54 was approximately 7 to 8 seconds. Therefore, 7 seconds was subtracted from the MTR field observed travel times for comparison purposes. The results are summarized below: MTR Field Measured Travel Time Results Between 54 and 20 Bath Road Travel Route AM Peak Hour PM Peak Hour to Bath Road 94 seconds 94 seconds Bath Road to 118 seconds 128 seconds As shown above, MTR s field results were similar to the Sebago simulation results for the to Bath Road direction. However, MTR found the travel times for the Bath Road to direction to be significantly longer, primarily due to delay at the signal. As one would expect, the PM peak hour delays were longer than the AM peak hour delays given the greater PM traffic volumes. To compare the mainline travel times to the potential cut through route with a relocated Pine Street, Sebago calculated total travel time by using the distance of each piece of the cut through route between 54 Harpswell and 20 Bath Road and the 85 th percentile speeds. They assumed the cut through route would result in a vehicle traveling from Bath Road taking a left onto Pine Street, a right onto Bowker Street and then a left onto. Based on their calculations this would result in a travel time of 76 seconds, not including associated delays at each of the turns. MTR concurs with this methodology to calculate travel times for portions of the roadway that do not currently exist. However, given that the majority of the potential cut-through routes are on existing roadways, MTR again performed field measured travel time runs to determine actual travel times. Additionally, MTR believes that McLellan Street and Chamberlain Avenue also have the potential to carry cut through traffic, not just Bowker Street, due to a relocation of Pine Street. Therefore, travel time runs were completed for all three of these residential roadways. The travel time runs were completed from the existing Bowdoin Pines drive on Pine Street (the approximate new location for Pine Street) to 54 and vice versa. The run via Chamberlain Avenue was started and completed at the intersection with given the ATR was located north of the intersection and cut through traffic would not be making that maneuver. The remainder of the relocated route via the new Pine Street to and from Bath Road was calculated based on roadway lengths and assumed speeds, as shown in Figure 2. Given that Pine Street is proposed to be relocated approximately 1,375 feet east and that 20 Bath Road is about 1,550 feet east, this results in a 175-foot span of Bath Road that needs to be accounted for. In this distance, a vehicle would not get up to the posted Page 3

Therefore, an average speed of 30 miles per hour was utilized which results in a travel time of 4 seconds for this portion of Bath Road. The length of the new piece of Pine Street was measured to be approximately 450 feet from the existing Pine Street to Bath Road. Based on a travel speed of 25 miles per hour, this proposed section of roadway would take 12 seconds. To account for the two turning maneuvers unmeasured along Bath Road and Pine Street, 5 additional seconds was added on. This totals 21 additional seconds for the portions that could not be field measured. The average field measured travel time runs are summarized in a table attached to this memorandum. The results with the measured times added to the 21 seconds of calculated time are shown below: MTR Field Measured Travel Time Results Travel Route AM Peak Hour PM Peak Hour to Bath Road via Bowker 101 seconds 104 seconds Bath Road to via Bowker 119 seconds 109 seconds to Bath Road via McLellan 113 seconds 117 seconds Bath Road to via McLellan 120 seconds 141 seconds to Bath Road via Chamberlain 117 seconds 131 seconds Bath Road to via Chamberlain 119 seconds 134 seconds As demonstrated above, all three cut-through routes would be expected to take longer to traverse from to Bath Road, during both the AM and PM peak hours, given that the mainline is estimated to take an average of 94 seconds during both the AM and PM peak hour periods. Hence, no outside traffic would be expected to cut through the neighborhood during either peak hour to travel from to Bath Road since there would be no time savings and the route would require four turning maneuvers and would be on densely developed residential streets as opposed to wider numbered state highways. Traveling in the opposite direction, from Bath Road to, during the AM peak hour is also longer on all three of the potential cut-through routes compared to the mainline (118 seconds), by a small margin. Although the cut-through route times are comparable to the mainline in this situation, the typical driver would not be expected to veer off the mainline given that they will not be saving time and four turns would be required. Additionally, both Bowker Street and McLellan Streets are fairly narrow roadways as opposed to Harpswell and Bath Roads. This potential cut-through route would require two left-turns, one from Bath Road onto the new Pine Street and one from the side street back to, one or both of which might be challenging during peak hours. It is important to note that cut-through traffic is most likely to occur during peak hours since this is when roads are most congested, accommodating the heaviest traffic volumes. As such, this analysis focused upon those peak hour travel times. Page 4

Pine Street Relocation, Brunswick 10/27/2017 During the PM peak hour, traveling from Bath Road to via the mainline is estimated to take an average of 128 seconds. Only one cut-through route, via Bowker Street is estimated to take less time. However, the same possible left-turn delays (onto Pine Street and onto ) would be expected via this route. It is also important to again note that Bowker Street is very narrow with a significant number of pedestrians. Bowker Street was also noted in the field to have poor sightlines at the intersection of making it difficult to enter. For all of these reasons, and based upon the travel time results, outside traffic would not be expected to use Bowker Street to travel from Bath Road to if Pine Street was relocated to align with Bath Road at a 90-degree angle. Based upon all of the travel time results, it is the professional opinion of MTR that cut-through traffic would be highly unlikely on any of these three side streets. In addition, cut-through routes are generally straight and fairly apparent to users on the main roads. Bowker, McLellan and Chamberlain would not appear to be a cut-through route as one passed by them. Cut-through routes are generally direct and not circuitous with as many turns as all these would require. A driver would need to purposely seek out an alternate route on a map to locate these routes. Lastly, as previously noted, given the narrow streets and dense residential development with pedestrian activity, as opposed to the wider numbered state highways, the potential cut-through routes are simply not as comfortable to drive regardless of the travel time results. The neighborhood residents are the ones with the knowledge of the area that may be likely to divert to the relocated Pine Street from Bath Road. This potential is evaluated in the following section. Diverted Neighborhood Trips As previously determined, while no traffic from outside the neighborhood would be expected to cut-through the neighborhood due to the proposed relocation of Pine Street, some of the neighborhood residents may be expected to alter their travel to use the relocated Pine Street connection from Bath Road. The existing traffic volumes in Figure 1 were reviewed to determine potential diverted trips from within the neighborhood. During the AM peak hour, 15 trips enter the neighborhood as an entering left from. Similarly, during the AM peak hour, 36 vehicles exit the neighborhood to as a right-turn. During the PM peak hour, 51 enter from as a left in with 34 exiting as a rightturn. Some of these trips may instead use the relocated Pine Street if they are destined to or from Bath Road. Based upon the traffic patterns recorded by the turning movement counts at the intersection of Bath Road, Federal Street and Sills Drive and at Pine Street and Bath Road, the following percentage of vehicles were found to be destined to and from Bath Road. Based upon these distributions up to 11 additional trips may travel Pine Street to Bath Road during the AM peak with up to 11 during the PM peak hour. In the opposite direction, traveling from Bath Road, up to 6 additional vehicles would enter at the new Pine Street during the AM peak hour with up to 14 during the PM peak hour. These are the maximum number of trips that would be expected to alter their travel patterns as it assumes that every vehicle destined to and from the neighborhood from Bath Road would now use Pine Street. In actuality, given the number of turns and narrow roads, many neighborhood residents residing towards may still elect to travel versus Pine Street. The numbers are also conservative since they assume that all of the commercial trips to the laundromat and convenience store now using Chamberlain and McLellan would also divert to the relocated Pine Street. The reduction and relocation of this maximum number of potentially relocated trips that could utilize the relocated Pine Street are shown in Figure 3. Summary of Findings Based upon field measured times, all three neighborhood street routes (Chamberlain, McLellan and Bowker) from to Bath Road would take longer to traverse than staying on Harpswell/Bath Roads during both AM and PM peak hour periods, hence no outside cut-through trips would be expected in this direction. In the opposite direction, traveling from Bath Road to, it is faster to remain on Bath Road/ during the AM peak hour so no AM cutthrough trips would be expected. For the Bath Road to direction, during the PM peak hour, only one neighborhood route, via Bowker Street, is expected to be any shorter than staying on the mainline route and this is likely due to the fact that some of that route is on. However, given the time savings is minimal at 6 seconds and given that the route requires four turning maneuvers and would be on densely developed residential streets, as opposed to wider numbered state highways, no outside cut-through traffic is expected.
