The Beaton family has farmed at Flints Farm for almost 100 years and this well maintained farm machinery comes onto the market as a result of the recent death of the late Mr Derrick Beaton, bringing to an end the family farming business. SPECIAL NOTES All prospective purchasers are required to register at the Pay Office before bidding for any lots. All purchases not removed by Friday 3 rd November, 2017, will be disposed of. The Auctioneers will not accept any transfer of any lot purchased (See Conditions of Sale). Persons attending the sale do so entirely at their own risk. METHODS OF PAYMENT All lots must be paid for on the day of sale and payments will only be allowed by the following method:-. Cash or Bankers Draft Cheques up to the limit of a current cheque guarantee card. Personal Cheques above the amount of any guarantee card must use one of the following arrangements: 1. Ask your Bank Manager to inform us by phone and/or in writing, at least 48 hours prior to the sale, that it will be in order to accept your cheque up to a maximum specified amount, at the Sale and on the date of the sale. 2. Provide a letter from your bank, stating that it will be in order to accept your cheque up to a specific amount, at the place and date of sale, fax copies or photocopies will not be acceptable. 3. Arrange with your bank to issue to you a guaranteed cheque made payable to Maxey Grounds & Co., prior to the sale, which you can then use for payment. If there are any cheques presented that do not follow the above methods, there will be a charge of 10 made to you to cover the cost of the special clearing of the cheque through our bank. Any items paid for by such a cheque, cannot be removed from the sale, until the cheque clears. The lots remain at the purchasers risk during this time. CONDITIONS OF SALE 1. The highest bidder to be the buyer, and if any dispute arises between the bidders, the lot in dispute shall immediately be put up again and resold. The Auctioneers reserve the right of refusing the bid of any person, and to regulate the bidding. 2. (a) The purchase price payable by the buyer, shall be the final bid thereon, together with VAT on the final bid (if applicable), together with the auctioneers commission of 5%, together with VAT thereon on the commission. The "final bid" means the price at which a lot was knocked down to the buyer. The Auctioneers will not accept any transfer of lots. (b) On the purchase of a lot, the buyer shall show his REGISTRATION NUMBER to the auctioneer. REGISTRATION NUMBERS can only be obtained from the Pay Office, prior to bidding for any lots. The buyer shall pay forthwith, if required to do so, the whole of the purchase price and if he fails to do so, the lot or lots may, at the auctioneers absolute discretion, but put up again and resold and condition 5 shall remain applicable. The contract of Sale is to be deemed in all cases as made exclusively with the Auctioneers and the payment should be made to them or their clerk only. 3. No Lot or Lots shall be removed from the premises until paid for, but each and every Lot shall immediately at the fall of the hammer be considered as delivered and be and remain in every respect at the absolute risk of the respective Purchaser or Purchasers thereof and shall be removed from the place of sale at the Purchaser's expense. The descriptions of the Lots are believed to be correct, but are not intended as a warranty, and therefore shall be taken with all faults and errors of description. 4. The quantities, measurements and descriptions of the various Lots have been carefully taken, and are believed to be correct, but it must be expressly understood that no allowance will in any case be made on account of an error or misdescription. 5. If any Purchaser shall fail to comply with the above conditions or any part of them, the Auctioneers shall be at liberty either to recover in full the amount of the Lot or Lots bought by such a Purchaser without reference to any delivery or acceptance of the Lot or Lots other than the first delivery by fall of the hammer, or to resell any Lot or Lots bought by such purchaser, either by Public or Private Sale and the full amount of the purchase money at the present Sale or the deficiency (if any) arising from such second sale shall be made good by the defaulter arising from such second sale shall be made good by the defaulter at the present Sale, and be recoverable as and for liquidated damages. 6. ALL PAYMENTS TO THE AUCTIONEERS SHALL BE MADE IN CASH, UNLESS OTHER ARRANGEMENTS HAVE BEEN MADE WITH THE AUCTIONEERS AND CONFIRMED BY THEM IN WRITING AT LEAST 48 HOURS PRIOR TO THE DATE OF SALE. A bill statement may be delivered to the purchaser at the end of the sale for the convenience of such Purchaser, no stamped receipt shall be required by such Purchaser except at his or her expense. 7. No undertaking of the Auctioneers or their servants to take charge of the Lots after the sale, or to forward them to their destination, shall be held to impose upon the Auctioneers any legal obligation or vitiate any of the foregoing conditions. 8. The Auctioneers do not hold themselves responsible for accidents or damage to persons or property either on or in the vicinity of the Farm. 9. Should any question arise, not provided for in the foregoing Conditions, the decision of the Auctioneers shall be final, from which there shall be no appeal. 10. All items included in the sale are sold subject to VAT, except where otherwise stated by the Auctioneers. 11. Anti Money Laundering Regulations: The auctioneers will not accept payment in cash in excess of 15,000 Euros.
