Considering : DECREE OF THE MINISTER OF INDUSTRY AND TRADE NO. 191/MPP/Kep/6/2001 DATED JUNE 5, 2001 AMENDMENT TO DECREE OF THE MINISTER OF INDUSTRY AND TRADE NO. 551/MPP/Kep/10/1999 ON GENERAL MOTOR VEHICLE REPAIR SHOP THE MINISTER OF INDUSTRY AND TRADE, a. that the develop general motor vehicle repair shops according to their respective class in order to enable them to provide adequate services to the public, it is deemed necessary to amend Decree of the Minister of Industry and Trade No. 551/MPP/Kep/10/1999 on general motor vehicle repair shops; b. that for this purpose, it is necessary to issue a decree of the Minister of Industry and Trade. In view of : 1. Presidential Decree No. 234/M/2000 on the formation of the Cabinet for the 1999-2004 period; 2. Presidential Decree No. 165/2000 on the position, task, function, authority, organizational structure and working system of ministries, as has been amended the latest by Presidential Decree No. 172/2000; 3. Presidential Decree No. 177/2000 on the organizational structure and task of ministries; 4. Decree of the Minister of Industry and Trade No. 552/MPP/Kep/10/1999 on general motor vehicle repair shops; 5. Decree of the Minister of Industry and Trade No. 86/MPP/Kep/3/2001 on the organizational and working system of the Minister of Industry and Trade. DECIDES : To stipulate : THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE ON AMENDMENT TO DECREE OF THE MINISTER OF INDUSTRY AND TRADE NO. 551/MPP/Kep/10/1999 ON GENERAL MOTOR VEHICLE REPAIR SHOPS. Article I Several provisions in Decree of the Minister of Industry and Trade No. 551/MPP/Kep/10/1999 on general motor vehicle repair shops shall be amended as follows : 1. To amend Article 1 so that it entirely reads as follows : Article 1 Referred to in this decree as : 1. General motor vehicle repair shops, hereinafter referred to as repair shops, shall be general motor vehicle repair shops as meant in KKI 38431.9900 and KKI 38441.9900, whose function is to fix, repair and maintain motor vehicles so that they will always meet technical requirements and be roadworthy. 2. Motor vehicles shall be vehicles powered by technical equipment found in the motor vehicles. 3. Types of work shall be the types maintenance and repair work carried out by repair shops on parts of motor vehicles. 4. Quality system shall be organizational structure, responsibility, procedure, process and resources to apply quality management.
5. Mechanics shall be the people having technical capability to accomplish motor vehicle maintenance and repair activities. 6. Facilities and apparatuses shall be facilities and apparatuses or tools used for maintaining and repairing motor vehicles. 7. Information management shall be all the activities to get information, use it as effectively as possible and discharge it at the appropriate time. 8. Personnel shall be the people involved in and held responsible for the entire operations of repair shops to ensure that they will run as expected. 9. Certificates shall be proofs certifying that repair shops meet/reach requirements for the classification of repair shops. 10. Classification shall be the act of determining the class and type of repair shops to see to it that they have been classified according to the given requirements or the relevant class. 11. Surveyor institute shall be the company appointed to conduct classification by issuing certificates. 12. Minister shall be the Minister of Industry and Trade of the Republic of Indonesia 2. The amend Article 2 by adding new provisions to it so that it entirely reads as follows : Article 2 (1) The classification of repair shops shall be as follows : a. First class repair shops of types A; B and C; b. Second class repair shops of types A; B and C; c. Third class repair shops of types A; B and C; (2) The classification of repair shops as referred to in paragraph (1) shall be the extent to which they have fulfilled to requirements of quality system, mechanics, facilities and apparatuses as well as information management in accordance with their respective classes. (3) The classification of first class, second class and third class repair shops as referred to in paragraph (1) shall follow Attachment I to Decree of the Minister of Industry and Trade No. 551/MPP/Kep/10/1999. (4) The types of repair shops as referred to in paragraph (1) shall be based on the types of work they can carry out as follows : a. Repair shops of type A shall be those capable of carrying out periodic maintenance, minor repair, major repair, chassis and body repair. b. Repair shops of type B shall be those capable of carrying out periodic maintenance, minor repair, and major repair, or periodic repair, minor repair and chassis repair and body repair. c. Repair shops of type C shall be those capable of carrying out periodic maintenance and minor repair. (5) The classification of repair shops as referred to in paragraph (1) shall be done in stages through a decision of the Director General of Metal, Machinery, Electronic and Farious Industries. 3. To amend Article 3 so that it reads as follows : Article 3 (1) The classification of repair shops as referred to in Article 2 shall be done by a surveyor institute appointed through a decree of the Minister based on the existing rules.
(2) In conducting the classification of repair shops, the surveyor institute as referred to in paragraph (1) shall be allowed to impose sanction in the form of the revocation of certificates of repair shops failing to fulfill the requirements in accordance with their respective classes. (3) The appointed surveyor institute as referred to in paragraph (1) shall fulfill the requirements as contained in the attachment to this decree. (4) If the appointed survey institute as referred to in paragraph (1) fails to carry out the classification based on this decree, it shall have its appointment permit revoked. 4. To amend Article 4 so that it reads as follows : Article 4 (1) Certificates of class of repair shop shall be issued to repair shops fulfilling the requirements of classification according to their respective classes as referred to in Article 2. (2) The certificates as referred to in paragraph (1) shall be valid for 5 (five) years, provided that the repair shops still fulfill the requirements in accordance with their respective classes and types base on their certificates. 5. To amend Article 6 so that it reads as follows : Article 6 Any motor vehicle repair shop holding a business permit can voluntarily apply to a surveyor institute for the classification of repair shop. 6. To revoke Article 7 7. To amend Attachment I to Decree of the Minister of Industry and Trade No. 551/MPP/Kep/10/1999 No. 3 (REPAIR SHOP MECHANICS) in points 3.2.d, 3.3.2, 3.3.3 and 3.3.5 to become as follows : 3.2.d. Passing a test for mechanics organized by an institute accredited by an authorized agency 3.3.2. The acknowledgement of mechanics qualifications is done through a test for mechanics organized by an institute accredited by an authorized agency 3.3.3. Any mechanic declared as fulfilling qualifications (passing a test for mechanics) deserves to receive a certificate and a token of technical qualifications according to their respective qualifications from the institute accredited by an authorized agency 3.3.4. The qualification of repair shop mechanics shall be distinguished into : a. First level mechanics (junior mechanics) b. Second level mechanics (senior mechanics) c. Third level mechanics (master mechanics) 8. To amend Attachment II to Decree of the Minister of Industry and Trade No. 551/MPP/Kep/10/1999 so that it becomes as contained in the attachment to this decree. 9. All implementation regulations of Decree of the Minister of Industry and Trade No. 551/MPP/Kep/10/1999 shall remain valid, provided that they have not been revoked and do not contradict this decree. 10. All other provisions in Decree of the Minister of Industry and Trade No. 551/MPP/Kep/10/1999 shall remain valid.

ATTACHMENT REQUIREMENTS FOR SURVEYOR INSTITUTE OF GENERAL MOTOR VEHICLE REPAIR SHOPS The requirements for a surveyor institute are divided into : 1. General requirements : The surveyor institute must : a. provide equal treatment or must not discriminate in conducting classification; b. constitute an institute providing protection and not taking sides in the fulfillment of criteria and function of classification system; c. have regular personal working on a full-time basis under the leader ship of senior executive responsible for carrying out daily activities in such a way so that they are free from the influence of the people having direct interests in the relevant products/services; d. have an organizational chart showing clearly the responsibility and reporting system of the organization; e. have own source of funds; f. have written documents on classification system including regulation and procedure for issuing classification certificates; g. have competent personnel to carry out its function; h. have a certain system controlling all documents related to the class; i. maintain a recording system compatible with its specific condition and fulfill the existing rules; j. have the needed facilities and written procedure allowing the evaluation, classification and documentation of a repair shop classifying system in accordance with the given requirements; k. conduct a periodic supervision of the quality system of repair shops receiving classification certificates; l. have the required facilities, including the expertise of classification personnel and apparatuses to carry out evaluation, classification and supervision of quality system; m. have documented quality reference and procedure for fulfilling criteria; n. have an adequate system to ensure the confidentiality of information obtained in carrying out classification activities; o. have a system of publishing information and updated information on repair shops receiving certificates; p. have a procedure for filing an appeal against a decision; q. conduct an internal audit and periodic review of the compatibility with the criteria for classification guidelines; r. have a proper system of controlling the use of repair shop certificates already issued; s. require repair shops receiving certificates to keep records on all complaints and steps to settle the complaints with due observance of the quality system; 2. Specific Requirements : The surveyor institute must : a. constitute an institute having experience in the field of motor vehicles; b. have the status of Indonesian corporate body; c. have human resources majoring in technical engineering with S1 degree and the adequate number of auditors to conduct classification of repair shops throughout Indonesia; d. have representatives capable of conducting classification of repair shops throughout Indonesia; e. have bonafide capability by showing the year-end financial statement audited by a public accountant; f. have a permanent office and adequate space to accommodate activities, apparatuses and computer sets; g. understand and follow developments in policies in the field of motor vehicles in Indonesia; h. have data base and information system network of certified repair shops updated periodically;
i. have classification personnel having experience in quality management certification, survey and audit in the field of motor vehicle industry in Indonesia; j. have classification personnel having knowledge about the characteristics of products, production and trade as well as developments in motor vehicle technology in Indonesia; k. have representatives in regions.
