Commitment is to actively participate in protecting the marine environment: a. Act No. 17/2008 about Shipping b. Government Regulation No. 21/2010 about Marine Enviroment Protection c. has ratified MARPOL 73/78 Annex I and Annex II since September 1986 d. Through Regulation of President of The Republic of No. 29/2012, ratified Annex III, Annex IV, Annex V and Annex VI of the International Convention for the Prevention of Pollution from Ship 1973 as modified by the protocol of 1978

STEPS IMPLEMENTED AFTER THE RATIFICATION OF ANNEX IV, V AND VI OF MARPOL 73/78 AMENDMENTS BY INDONESIA 1. Familiarization of the implementation of the amendments of Marpol 73/78 annex IV,V and VI through workshops between regional countries, branch offices, stake holders, classification society, and coordination with related ministries e.g. Ministry of Enviromental and Ministry of Fisheries; 2. Cooperating with Research and Development body in MoT, University and other related parties to conduct implementation of Marpol 73/78; 3. Making a draft of subsidiary legislation of act no. 17/2008 about Shipping and Government Regulation No. 21/2010 about Marine Environment Protection, by Minister Decree related to Marpol 73/78;

IMPLEMENTATION RELATED TO ANNEX IV The Directorate General of Sea Transportation cq. Directorate of Marine Safety has issued International Sewage Pollution Prevention Certificate (ISPP) for Flag ships in 2012 (until December 2012 = 305 ships) Government requires ships operating in its waters and visiting ships to comply with the discharge criteria to ensure provision of adequate sewage reception facilities Government shall notify IMO regarding all condition after the implementation process

IMPLEMENTATION RELATED WITH ANNEX V Maritime Administration has : Provided advice to its own flag ships Examined onboard garbage management plan Ensured the ship provide garbage facilities Ports should: Assess requirements for reception facilities Ensure adequate garbage reception facilities are available by the implementation date. Some of ports have cooperation with private sector for collecting garbage from the ships and processed into final disposal.

IMPLEMENTATION RELATED WITH ANNEX VI The Directorate General of Sea Transportation cq. Directorate of Marine Safety has issued International Air Pollution Prevention Certificate (IAPP) for Flag ships in 2012 (until December 2012 = 329 ships) n Government requires : Documentation - IAPP, EIAPP Compliance with SOx & NOx limits fuel record book Equivalent compliance e.g., approved EGCS including disposal of residues? Availability of fuel Operational procedures included in SMS Clean and green reception facilities

OTHER ACTIVITIES WHICH RELATED TO MEPC IMO (RECENTLY IN PROCESSING TO RATIFY FOR OTHER CONVENTION) CONVENTION OF ANTI FOULING SYSTEMS AND CIVIL LIABILITY CONVENTION FOR BUNKER CURRENTLY ARE STILL ON THE PROCESS OF RATIFICATION AND HAVE BEEN DISCUSSED AMONG MINISTRIES IN INDONESIA ORGANIZED BY LEGAL BUREAU OF MoT INDONESIA HAS CONDUCTED MANY WORKSHOPS TO DISCUSS ABOUT SHIP RECYCLING AND BALLAST WATER MANAGEMENT. RECENTLY IS PREPARING THE ACADEMIC PAPER FOR RATIFICATION IN INDONESIA. MANY OF INDONESIAN FLAG SHIPS HAVE INSURED THEIR VESSELS FOR CLC-BUNKER AND COMPLIED WITH ANTI-FOULING SYSTEMS. FOR THAT REASON, INDONESIAN GOVERNMENT HAS ISSUED ATTESTATION LETTER FOR THOSE SHIPS WHILE THE CONVENTION RATIFICATION IS STILL ON THE PROCESS.
