America's Auto Auction Policies 6615 Mobile Hwy T: (850) 944-1945 GENERAL POLICIES 1. All dealers must be licensed by their state and approved by dealer registration at this auction. It is the Dealers responsibility to remove all property. 2. Any changes on the dealer registration form such as ownership, authorized representatives, Bank, etc., must be immediately recorded with Auction by letter signed by the owner, Dealer Registration will request updates. 3. The Auction assumes no responsibility for fire, theft or other loss or damage to any vehicle or equipment. The Auction will not be responsible for any pull out (radios, phones, etc.) equipment left in vehicles. Please remove before registration. 4. All vehicles registered at the auction are subject to inspection by any appropriate authority to include state and local police. Vehicles without two points of identification or serial number IDs will be accepted at auctions discretion. 5. Children under the age of 16 and retail customers are strictly forbidden from attending the Auction. This Auction is open to Licensed Dealers Only! Any dealers who disregard this rule are subject to any and all privileges being immediately revoked. 6. Reassigned, replacement, or rebuilt VIN plates must be announced. These units are required to have vehicle inspected by Auction management before being offered for sale. Possible frame damage must be disclosed at time of sale. 7. Auction reserves the right to refuse anyone the use of its services. 8. In any case of arbitration, the decision of Auction management is binding and final. It is also the responsibility of buyer and seller to check with arbitration department concerning decisions on sale day before you leave. 9. Any purchase other than under the hammer is an AS-IS transaction. 10. All transactions must clear through office. 11. Buyer has the right to void purchase if seller fails to announce NO TITLE PRESENT at the block. 12. Buyer is responsible for verifying the following: VIN plate, model, year, mileage and odometer/speedometer operation on all purchases before leaving the sale. Make sure all information on Bill of Sale is correct. 13. All police, taxi, fire or flood, salvage, clipped or reconstructed cars, motorcycles, boats, personal watercraft and trailers must be sold Red Light and/or As Is. NO EXCEPTIONS! Seller is responsible for making appropriate announcements on all BRANDED titles, bonded; prev. salvage, rebuild, reconstructed, salvage, flood and frame, etc. must be announced on the block. Auction not responsible for any expenses incurred. 14. The Auction will not guarantee the year of foreign cars, house trailers, recreational vehicles, boats and motors, trucks, dune buggies, kit cars or motorcycles. Information provided on vehicles is just that information and will not be valid in arbitration. 15. IF or TRY purchases are binding until noon Wednesday after bidding and signing. Buyer may request a larger acceptance period if he desires. 16. The Auction does not guarantee any warranty books, records, or remaining factory warranties. 17. Diesel conversions, catalytic converters removed and/or gas tank necks altered must be announced. 18. Grey market vehicles and odometers reading kilometers will not be registered or offered for sale. NO FOREIGN TITLES ACCEPTED. 19. Any vehicle 10 years old or older is mileage exempt. Announced conditions regarding the mileage on an exempt vehicle is strictly between the buyer and seller and will not be subject to arbitration. 20. ODOMETER DISCLOSURES: The seller must immediately repurchase any vehicle with a documented odometer problem and pay all reasonable documented expense incurred by the buyer. The buyer must present documentation supporting the problem within a reasonable period of time and return the vehicle in the same condition in which it was purchased. Broken, replaced, or altered odometers on non-exempt vehicles must be announced and sold as true miles unknown. Sellers must announce if the mileage exceed 100,000 miles, 200,000, etc. Page 7 of 14
21. PROBLEM CARS such as frame, flood, salvage and/or reconstructed vehicles must be reported to Auction management within 7 days of purchase. Day 1 begins day after sale. 22. Any unit current year or newer not equipped with air conditioning must be announced and sold under Yellow Light. 23. The Auction reserves the right to void any transactions. 24. Buyers, check odometer/speedometer for proper operation the day of sale. Tomorrow is too late. 25. The Auction will not be responsible for administrative errors. 26. America s Auto Auction Pensacola adheres to the National Auto Auction Association s structural policy (frame). Please refer to frame specifications and disclosure policy available in main business office. 27. Auction policies are subject to change. Be aware of any changes or additions on bulletin board or newsletters. 28. Any vehicle selling for $2,500.00 or less becomes As-IS except for A True mileage unknown, broken odometers, or miles over 100,000 B Rebuilt or assigned VIN numbers C Branded, previous salvage or reconditioned titles D Police cars, taxis, boats, motorcycles, dune buggies, kit vehicles. 29. Any return checks or drafts will be accessed a $100.00 fee for each returned item. If Auction receives three (3) returns in a calendar year, Buying Dealer will be placed on a Cash Basis. 30. All units purchased should be test-driven and paid for within one (1) hours. Sale day arbitration ceases at 5:00 PM 31. Under NO circumstances shall a dealer stop payment on a check or refuse to honor a draft. 32. SELLERS turn in all titles in front office or on block before unit are offered for sale. 33. Any vehicle misrepresented by announcement, advertisement, logo, decal, nameplate, etc., is arbitratable day of sale ONLY, except AS-IS vehicles. 34. Manufacturer buy backs (lemon law vehicles) are subject to the disclosures required by the State of Florida. 35. Any vehicle not paid for in accordance with Auction policy will be consigned at the discretion of Auction management and resold. Should a deficit exist the dealer will be liable. Buying dealer will also be required to pay all expenses connected with collection of unpaid items. 36. Persons found tampering with or removing equipment from vehicles will be subject to suspension from the sale and WILL BE PROSECUTED. Dealers will be held responsible for the actions of their employees. 37. Please notify office immediately of any unsafe vehicle offered for sale. 38. The Auction accepts no responsibility for collisions or paint damage when Auction staff is not involved. VEHICLE REGISTRATION A. Please have vehicles on premises at least one hour prior to scheduled running time. Late arrivals are subject to running last. B. Please have company name and dealer number on windshield of vehicle to insure vehicle is registered to correct dealer. C. Vehicles that do not have a proper VIN will not be registered for sale. Abandoned vehicles will be sold 30 days after notice is given, to last known owner. $10.00 PER DAY STORAGE APPLIES -LICENSED DEALERS ONLY - NO RETAIL CUSTOMERS- Any dealer bringing retail customers to the sale is subject to lose Auction privileges for an indefinite period of time. GENERAL INFORMATION GENERAL REPRESENTATIONS: It is both seller and buyers obligation to verify the accuracy of preprinted information on the Auction Bill of Sale Invoices as well as all Announced Conditions, condition lights and the writing on the vehicle offered for sale. Buyers and sellers are also obligated to verify the accuracy of the mileage of the odometer compared to the Bill of Sale. Writing on vehicles is a courtesy and is not to be relied upon. Visually check all points made above. This Auction will abide by the rules and representations on the back of our Bill of Sale. OFFICE HOURS 8:00 AM to 5:00 PM - Monday through Thursday Closed Friday GATE HOURS The gate will be open during normal business hours with security guards on duty for your convenience. REMINDER: All vehicles leaving auction property must have a gate pass or the guard will not allow vehicle to leave. LIGHT SYSTEM GREEN LIGHT Sound Selling dealer declares car is subject to all arbitration policies. YELLOW LIGHT Defect Selling dealer must announce any item subject to arbitration, nonstandard motors and transmission, major exceptions to the original or advertised production specifications for items deleted or added, deployed or missing airbags, airbag light illuminated, and any unit with an excess of 100,000 miles or miles unknown. All other items that are subject to arbitration must be announced or the vehicle may be arbitrated. BLUE LIGHT No Title Present Assigned title does not accompany car. Buyer is cautioned not to spend any money on unit and not to excessively drive unit, not to damage unit, and not sell unit until title is received. After thirty (30) days from sale date, it is the buyer s option to return the car, or wait a reasonable additional period of time for the title. Buyer is advised not to spend any monies on until a marketable title has been received. Monies spent on unit prior to buyer s receipt of title are at buyer s risk. In the event that the title is not received by the Auction within the 30 day period special arrangements must be made with Auction before the unit is returned. The Auction title clerk must be notified twenty-four (24) hours prior to the return of the unit by the Buyer. Be sure to get the name of the person you speak with, date and time of discussion. Purchaser will be accessed a (.20) per mile charge for excessive use. Day One begins the day after sale. If a buyer calls to return a vehicle for no negotiable title and the Auction has received or mailed the title, buyer must keep car. When a buyer has received clearance to return a vehicle because the negotiable title is late or for any other reason, the seller is responsible for all Auction fees due on the transaction. RED LIGHT AS-IS Vehicles Selling For $2500 or Less Buyer assumes total responsibility for mechanical and physical defects with the following exceptions which the seller must announce: 1-Rebuilt or assigned VIN numbers 2- Branded, salvage or reconditioned titles even if current title is clear 3-Police cars, taxis, boats, motorcycles, dune buggies and kit vehicles. 4-Vehicles 10 years old or older 5-Frame damage must be declared. ATTENTION BUYERS Do not rely on verbal statements made under the Red Light. These units are sold AS IS with NO guarantees. Per federal guidelines all cars ten years old and older are exempt from disclosure requirements, therefore, the seller nor Auction make any certifications as to the odometer reading or working condition of odometer. BUYERS Examine all cars before bidding and be familiar with all announced conditions of the unit. Cars should not be road tested until the buyer has the proper sales receipts for release from the lot. Do not test drive unit on lot. Examine the serial number plate, Page 9 of 14
model year and the mileage reading before leaving the sale. Pay for each car with a separate check or draft. Cars left on the property must have keys left in them. All vehicles must be paid for sale day by cash, check or draft. A $50.00 charge will be assessed on next day payments. SELLERS Please have your units on the premises early in the morning, avoiding the Sale Day rush. Vehicles which are unsafe to operate will not be run through the auction lanes. Represent your cars accurately and fairly; be sure each vehicle has enough gas to be test driven. If fuel has to be obtained it will be twice the pump price. ODOMETERS Broken odometers, true mileage unknown and miles in excess of mechanical limits are specific conditions and must be announced as separate conditions at the time of sale. Any dealer guilty or innocent, who sells a car where odometer tampering can be confirmed, will be required to buy back the unit to include transportation and reasonable expenses. Odometers must read mileage not kilometers in order to be registered for sale. Vehicles (10) ten years or older are mileage exempt. Buyers check odometer/speedometer before you leave. DOCUMENTS Titles and supporting documents with corrections, erasures, deletions, or alterations are not acceptable. See Auction title clerk before you sell the vehicle if you have questions as to whether a title is acceptable or not acceptable. TITLES The following rules apply to titles: 1- Titles for motorhomes, motorcycles, trailers and boats must be approved by Auction before sale. 2- Certificate of origin (MSO) must be announced. 3- Seller must announce year of chassis and year of units on all motorhomes and dune buggies. 4- All RV s and conversion vans must have title present and accepted by the office manager prior to being registered for the sale. 5- Failure to announce no title present (blue light) at the block will permit the buyer to void the transaction on sale day only. I.D. CARDS Buyers and sellers must always use their I.D. cards or Badge to enter their vehicle for sale and sign for purchase. Your I. D. Card contains your computer number. Dealers who fail to use their cards delay the processing of their work. If you have lost your I. D. Card, or it is badly worn, a new one will be made for you at Dealer Registration upon request. Be prepared to show your I. D. Card to our security personnel at any time. Please help us serve you better by always using your I. D. Card. ATTENTION TO ALL DEALERS All cars registered are subject to inspection by the Federal Bureau of Investigation, the National Auto Theft Bureau, the Florida Highway Patrol, the Escambia County Sheriff s Department and Auction inspectors. Do not register a car without a Public V.I.N. Plate. All vehicles are subject to search prior to leaving the Auction property. Thank you for patronizing our sale. We are here to serve you. ARBITRATION POLICY Subject To Arbitration Unless Announced A. Mechanical Arbitration DAY OF SALE ONLY B. CURRENT YEAR MODELS ONLY: All Paint work must be announced C. C. FRAME DAMAGE must be announced. Discovery of frame damage or frame repair must be reported to the Auction within 7 (seven) days after purchase. All dealers beyond 250 miles of America s Auto Auction Pensacola will be allowed 14 (fourteen) business days due to transportation delays. DEALERS: Document the person s name that you report the damage to as well as day and time reported. Any Bolt On body parts are not considered part of frame. Tie Down damage is not arbitrable MapQuest will be used to determine distance. America s Auto Auction Pensacola abides by NAAA Frame Policy as revised January, 2010. D. All vehicles are guaranteed by Seller against cracked blocks for a period of forty-eight (48) hours after purchase. Page 10 of 14
E. Motor Transmission Rear End Clutch F. Front ends on front wheel drive and four wheel drive units. Rack and pinion on front wheel drive units. (CV joints excluded) G. Any single item that exceeds $500.00 to repair as judged by auction mechanic is subject to arbitration. H. After any accepted adjustment the unit automatically becomes an AS-IS deal with no further arbitration. I. Any unit unsafe to drive is reject able. J. Seller must announce all vehicles without air conditioning if less than 10 years old. K. Suspension Air Bags must be arbitrated day of sale and before leaving property. L. Seller must announce deployed missing airbags. M. Due to the Inherent Problems with Jeep Rear ends and Cadillac Northstar Engines we will NO LONGER ARBITRATE OR POST SALE any of these vehicles. All vehicles selling for $2525.00 and up are eligible to be sold with Ride and Drive. NOT Subject to Arbitration A. AS IS units except as noted under rules for Red Light vehicles. B. C. V. Joints C. Air conditioning, power accessories, radios, stereo systems, cruise control, brakes, convertible tops, dash gauges and electrical, computer control units. D. Vehicles with Air Bags light, brake and/or ABS lights illuminated. E. Verbal statements made by seller, such as seller guarantees. F. Excessive smoke, check engine lights. WARNING Seller may be required to buy back any vehicle that auction management deems warranted. Seller may be responsible for transportation expenses on After Sale Day Arbitrations. THE DECISION OF THE AUCTION MANAGEMENT SHALL BE FINAL IN ALL DISPUTES The Auction will not be responsible for transportation or other expenses of a returned vehicle.
