An Ordinance of the Township of Manalapan Creating a New Chapter 84 Commuter Parking and Repealing Articles XVI (Commuter Parking Areas) and XXI (Franklin Lane - New Jersey Transit Park-and-Ride) of Chapter 226 Vehicles and Traffic ORDINANCE NO. 2009-07 NOW, THEREFORE, BE IT ORDAINED by the Township Committee of the Township of Manalapan that Article XVI (Commuter Parking Areas) and XXI (Franklin Lane-New Jersey Transit Park-and-Ride are hereby repealed and reserved, and a new Chapter 84 (Commuter Parking) shall be established as follows: ARTICLE I. Commuter Parking Areas Pay Per Year 84-01. Purpose. This article is adopted for the purpose of promoting a safe and orderly parking of motor vehicles within areas designated and established by the Township as commuter parking lots. All areas so designated as commuter parking lots within the Township are included under this article, except for the Franklin Lane-New Jersey Transit Park-and-Ride facility, which is regulated by a separate article in this chapter. 84-02. Applicability. The provisions, rules and regulations of this article pertaining to commuter parking areas are applicable to all those parcels of land and premises owned, leased, occupied or controlled by the Township of Manalapan, now or hereafter, except for any lands or areas within the right-of-way of any street, road or highway and do not apply to the Franklin Lane-New Jersey Transit Park-and-Ride facility, which is regulated by a separate article under this chapter. 84-03. Permit required and regulations. A. Parking on said lands and premises hereinbefore shall be designated by permit only, which shall be evidenced by a tag issued to an applicant by the Township.

B. Such parking areas shall be marked by signs indicating that parking will be by permit only, Monday through Friday, and vehicles must display a valid tag. The Franklin Lane Commuter Lot parking will be by permit only Monday through Friday except during the hours of 6:30 p.m. and 9:30 p.m. C. No vehicle shall be parked in any such parking area unless it displays on the interior rear view mirror a current and valid permit so issued by the Township of Manalapan as herein provided. D. No vehicle shall be parked in any such parking area displaying a parking permit that is reported lost, stolen, mislaid or undelivered or whose identification number is obscured or has been removed. E. All vehicles shall be parked within a single designated parking space as indicated by marked lines on the surface of the parking area or unless otherwise instructed by a police officer or other attendant in charge. F. Vehicles, because of size, which occupy more than one parking space or which extend into a traffic aisle shall be excluded from commuter parking areas. G. No vehicle shall be parked within the entrance or exit to any such commuter parking area or within any of the aisles thereof. 84-04. Issuance of permits. A. The required permits shall be issued by the Municipal Clerk. Applications will require the completion of a form supplied by the Clerk to include a copy of the applicant's current New Jersey Driver's License and vehicle registration certificate. The address on the driver's license must establish the applicant as a resident of the Township of Manalapan or as a resident of the Township of Marlboro. B. The Municipal Clerk shall issue not more than 100 permits to the residents of the Township of Marlboro on a first-come-first-served basis at the Franklin Lane Commuter Lot. After the issuance of the authorized 100 permits to said residents of the Township of Marlboro, no further permits shall be issued in any one year.

C. Residents of the Township of Manalapan and qualified residents of the Township of Marlboro shall be provided permits as hereinafter set forth, but no permits shall be issued to any parking facility that has been determined by the Township to be filled to capacity. D. Application and renewals thereon shall be for one year or any part thereof, terminating on March 31, and the annual fee for same shall be $150. In the event that a permit is issued during the annual period from April 1, through March 31, then the charge for same shall be at $12.50 for each month remaining during the aforesaid period. No refunds shall be made. E. Only one permit per resident, per car, shall be issued as specified in Article. F. Said permits shall have written thereon, "Manalapan Parking Permit," together with the number of the permit, the date of expiration and the name of the appropriate parking area. G. The Municipal Clerk shall make and keep a record of all permits issued to include the completed application form, the parking area assignment, the tag number, and the copies of the applicant's driver's license and registration certificates. 84-05. Presumption of permission. Any person parking a motor vehicle with such permit affixed thereto shall be presumed to have properly applied for and received permission to park said motor vehicle in any such parking area of the Township of Manalapan. 84-06. Disabled vehicles prohibited. No person shall permit a disabled vehicle to remain in any commuter parking area for more than 36 hours without the express permission of the police.

84-07. Towing. Any vehicle parked in any such parking area in violation of this article may be removed from the parking area on order of any police officer, and the owner thereof shall pay the reasonable cost of such removal and storage which may result from such removal before being allowed to regain possession of the vehicle, and such costs of removal and storage shall be in addition to any penalty or fine hereinbefore provided in Chapter 216, Towing. 84-08. Exceptions. This article shall not apply to any municipal vehicles registered to the Township of Manalapan. ARTICLE II. Commuter Parking Areas Daily Parking 84-09. Purpose. A. The Township may designate spaces for daily parking within the Township commuter parking areas that shall be permitted on a first-come-first-served basis to Manalapan residents only. A decal or permit shall be required to park within said areas as proof of residency and shall be valid at all Township commuter parking locations that provide for daily parking. Such parking areas shall be known as Manalapan Daily Parking within the commuter lots established by Article I. B. For the purpose of the orderly and safe parking of motor vehicles, the pay per day parking shall be regulated as set forth in Article I, as applicable, unless otherwise stated in this Article. 84-10. Residency Permit Requirement. A. Proof of residency shall be established in the same manner as yearly permits and valid for a period of two years expiring on September 30 th. Permits issued during the months of June through September shall not be counted as a year. B. Any resident displaying a valid yearly commuter parking permit as established by Article I may park in the pay per day area for that lot only, and only if other parking spaces are not available. Said parking is not subject to the daily fee.

C. Any resident who currently has a yearly commuter parking permit is not eligible to receive a daily residency permit/decal. D. The permit/decal shall be affixed in the lower rear corner of the driver s side rear window. 84-11. Fee Established. A. A daily parking fee is hereby established which shall be consistent with the fee established by Article III Franklin Lane-New Jersey Transit Daily Park-And-Ride and payment for the same by coin shall be prohibited. B. The Township of Manalapan shall charge a fee for the residency permit/decal which fee shall include the cost of the permit/decal plus administrative costs. A $5.00 fee is hereby established for the residency permit/decal. C. Daily parking areas shall be marked by signs indicating that parking will be by fee and valid residency permit/decal only, and subject to the same hours of operation for that lot. ARTICLE III. Franklin Lane - New Jersey Transit Daily Park-and-Ride 84-12. Purpose. This article is adopted for the purpose of promoting the orderly and safe parking of motor vehicles within the Franklin Lane - New Jersey Transit Daily Park-and-Ride facility. 84-13. Applicability. The provisions, rules and regulations of this article shall apply only to the Franklin Lane - New Jersey Transit Daily Park-and-Ride facility. 84-14. Manner of parking. A. Parking in the aforesaid daily park-and-ride facility shall be permitted on a firstcome-first-served basis, and no decal or permit shall be required to park in the aforesaid facility.

B. For the purpose of the orderly and safe parking of motor vehicles, the pay per day parking shall be regulated as set forth in Article I, as applicable, unless otherwise stated in this Article. 84-15. Fee. The daily parking fee shall be $2.00 and payment for the same by coin shall be prohibited. SEVERABILITY If any section, paragraph, sub-division, clause or provision of this Ordinance shall be judged invalid, such adjudication shall apply only to that section, paragraph, sub-division, clause or provision and the remainder of this Ordinance shall be deemed valid and effective. REPEAL All Ordinances or parts of Ordinances inconsistent herewith are hereby repealed as to such inconsistency. EFFECTIVE DATE This Ordinance shall take effect July 1, 2009 and publication in accordance with law. PUBLIC NOTICE The Ordinance published herewith was Introduced and approved at a meeting of the Township Committee of the Township of Manalapan held on March 25, 2009. This Ordinance will be further considered for final passage after a Public Hearing thereon before the Township Committee of the Township of Manalapan during a meeting to be held on April 7, 2009 at the Municipal Complex, 120 Route 522 and Taylors Mills Road, Manalapan, New Jersey at 8:00 p.m. or as soon thereafter as the matter may be reached, or at any meeting to which that meeting may be adjourned, at which time any and all persons who may be interested therein will be given an opportunity to be heard. The proposed Ordinance in its entirety is on file in the Municipal Clerk s Office and copies may be obtained without charge between the hours of 8:30 a.m. and 4:30 p.m. Monday through Friday.
