What s In It For ME? Working Together in an Impaired Driver Tracking System Erin Egan & Darlene Schwartz Wisconsin Department of Transportation Citations & Withdrawals Section July 27, 2010 Did You Know.. Wisconsin has approximately 4.1 million licensed drivers? there are 822,959 OWI related convictions on Wisconsin driver records? there are 540,801 total individual records with an OWI related conviction? 1

Did You Know.. 370,406 Wisconsin driver records have 1 OWI related conviction? 117 Wisconsin driver records have 10 or more OWI related convictions? One Wisconsin driver record has 16 OWI related convictions? The rest of the story. As of January 1, 1989, OWI related convictions are kept on driver records permanently We have 21 years of convictions to count! Data includes convictions for outof-state drivers as well 2

Discussion Topics How does Wisconsin s Model Impaired Driver Record Information System (MIDRIS) work? How has MIDRIS impacted daily operations? What other benefits have been achieved? What data is available? How is it used? How do our customers benefit? What is next? Focus of Project Electronically transmit data! Issue citations electronically by law enforcement officer Transfer citation data to court, district attorney Receive conviction & disposition information from courts, post to driver record & take licensing action, if needed Accept driver safety plan & course completion data from providers Make complete driver history available to law enforcement (including arrest) 3

Partners in Project Law enforcement 600 agencies issue citations Uniform Traffic Citation required Courts 72 circuit courts (one per county) 250 municipal courts DMV Treatment Providers Office of Justice Assistance Department of Justice MIDRIS Concept Citations, Complaints DL, Reg Data Crash reports, Cit Tracking TIME / etime (DOJ) Convictions, Court orders DL, Reg Data Driver safety plan, courses ecitation Web Service 4

Step by Step DMV assigns citation numbers to Law Enforcement Agency (LEA) DMV sends DL & vehicle registration to Department of Justice (DOJ) for distribution to LEAs LEAs issue paper citations manually, or use BadgerTraCS for electronic citations LEAs route citations to court hand carry paper citations, or use ecitation WebService for electronic citations Step by Step ecitation WebService routes to appropriate place (municipal, circuit, DA) Courts report dispositions to DMV. Paper dispositions are mailed; electronic dispositions are sent via CCAP, COWS, or a vendor interface 5

Step by Step Paper citation process at DMV: Citation is imaged & sent to keying vendor Data from keying vendor is run through nightly batch job Electronic process: Data is run through nightly batch job, often the same day as court was held Data is saved in a table, with form templates available to reproduce document Over 90% of withdrawals are automated DMV Efforts Redesign of violation and withdrawal management systems to update driver records with electronically transferred data Implement electronic citation & crash reporting program for law enforcement (BadgerTraCS) 6

DMV Efforts Forms Included in BadgerTraCS Uniform Traffic Citation Non Traffic Citation Natural Resources Citation Crash Reports Driver Condition & Behavior Report Alcohol Reports Forms Coming Traffic Stop Data Collection Citizen Contact / Field Investigation DMV Efforts Create electronic citation tracking (EARS) Design web interface for treatment providers (ANTSS) Build web interface for municipal courts (COWS) 7

Law Enforcement Efforts Implement BadgerTraCS EARS interface included Equip squads with MDCs, printers, related equipment Build interface to RMS (if they choose) Submit data to court, DMV Court Efforts Circuit courts Circuit Court Automation Project began in 1990s Municipal courts Implement COWS or vendor system (some agencies RMS have a court reporting module) District attorneys DA IT project (and case management tool) began in 1996 8

Treatment Provider Efforts Implement ANTSS Report driver safety plan, non-compliance (assessment agencies) Report Group Dynamics or Multiple Offender course completions (technical colleges) Receive on-line copies of driver records (all) Office of Justice Assistance Efforts Create and implement ecitation WebService Routes data directly from law enforcement agency to either municipal or circuit court; also routes data to DA Protect, if applicable Updates DMV Citation Tracking system 9

MIDRIS Concept BadgerTraCS Citations, Complaints DL, Reg Data CCAP, DA Protect, COWS Convictions, Court orders ANTSS Driver safety plan, courses Crash reports, Cit Tracking EARS TIME / etime (DOJ) DL, Reg Data ecitation Web Service Timeline 1987: CCAP began 1996: DA Protect started 2001: DMV implemented new withdrawal management system, including Electronic transfer of conviction & court orders Failure to Pay Suspensions automated 10

Timeline 2003: Internal BadgerTraCS crash entry completed 2005: BadgerTraCS rolled out to LE 2007: ecitation WebService done Current Status 71 of 72 circuit courts using CCAP 220 of 250 municipal courts reporting electronically 360 law enforcement agencies trained in BadgerTraCS; 215 submitting 11

How did we do it? Leveraged existing projects & resources Existence of CCAP & DA Protect was critical Redesign of DMV database helped; much was accomplished during current IT projects Lots of grants! NHTSA MIDRIS demo project FMCSA CDL Program Improvement grants NHTSA - State TRCC funding Workload Impact In 1998, our section only did withdrawal work, and had 72.5 FTE (including a night shift) In 2001, citation processing was added In 2005, Administrative Suspensions were added In 2008, BadgerTraCS was added As of July 1, 2010, our section has 42.8 FTE 12

Benefits for Customers Most convictions & withdrawals are processed overnight, if received electronically A secured system for accessing driver records in real-time is available (PARS), and includes an Employer Notification system for CDL drivers. PARS is the same tool used by ANTSS to provide DL records to assessors & instructors Data tends to be better quality than handprocessed work Benefits for Customers www.wisconsindmv.gov has a wealth of information for OWI offenders to help them drive legally, including: Reinstatement eligibility Occupational license eligibility SR-22 insurance filing DL status check 13

Benefits for DMV Close to meeting 10 day deadline for posting convictions Over 70% of citations are reported electronically and process overnight CDLIS posting for convictions is a weekly job now. Once it is changed to daily, we should meet the 10 day deadline Automated citation tracking system allows us to audit citations that aren t reported in a timely fashion Drawbacks When automation fails, problems can be huge and/or not detected right away Processors are no longer reviewing records every time a new conviction or withdrawal is added 14

Analyzing Data Data is stored in normalized DB2 tables Storage costs are minimized, but analysis is more difficult (have to know how to join a multitude of tables) To eliminate this problem, a series of files are created every month for purposes of running reports Statistical Files Available All violations appearing on WI driver records All revocation / suspension / cancellation / disqualification cases appearing on WI driver records (ie, the withdrawal file) All customers with a DL record All administrative per se arrests See materials for sample file layouts 15

Request #1 Q: I want the driver records for the top 100 OWI offenders in Wisconsin Requestor was a newspaper reporter Lengthy discussion about DPPA and redisclosing personal information Request #1 Wisconsin has strong Open Records Law; consulted with our attorneys and decided we should provide the info Top 100 cut off isn t a clean break Settled on offenders with 10 or more; 124 total records provided, at $5 each (request was in Feb 2008) 16

Request #1 Logic From the violation statistics file, records were chosen where the charge code is an OWI-type offense (one incident per day) court decision code = 1 (guilty) violation in WI flag = Yes Then, the records were grouped & counted by customer number Request #2 Q: How many people have OWIs with a minor passenger in the vehicle, by year? Requestor was a researcher, applying for a grant with the CDC Numbers are likely low; minor passenger is penalty enhancer, and often pled down 17

Request #2 - Logic From the violation file, records were chosen where: the charge code is an OWI-type offense (one incident per day) court decision code = 1 (guilty) violation in WI flag = Yes minor in vehicle flag = Yes Request #3 Q: How many drivers are suspended / revoked in my county? For what reasons? Request is common, especially from community groups working to restore people s operating privileges 18

Request #3 - Logic Licensed drivers by County From the driver statistics file, records were grouped by county, then DL status Driver s License Withdrawal by County From the withdrawal statistics file, records for certain counties were selected, then grouped by charge code Request #4 Q: How many people receive a 3 rd offense OWI within 5 years of a previous offense? What about a 4 th? Request was from Legislative Fiscal Bureau, working on recent OWI legislation The bill subsequently passed and became law on July 1, 2010 (2009 WI Act 100) 19

Request #4 - Logic Used recidivism query results (see first example) Violation dates of 3 rd & 4 th offenses were compared to 1 st, 2 nd, & 3 rd offenses What s Next? 2009 Wisconsin Act 100 requires the court to order an IID on ALL: 1 st offense with a BAC of.15 or higher ALL second & subsequent offenses ALL refusals Violation statistics file is being expanded to include IID order 20

What s Next? 2009 Wisconsin Act 28 Traffic Stop Data Collection required, effective January 1, 2011 Data must be sent to OJA for analysis & reporting Information will be collected electronically with TraCS, and submitted to OJA via the ecitation WebService Contact Information Erin Egan, Chief of Citations & Withdrawals, Wisconsin DMV (608) 266-9901 erin.egan@dot.wi.gov Dar Schwartz, Supervisor in Citations & Withdrawals, Wisconsin DMV (608) 266-8677 darlene.schwartz@dot.wi.gov 21
