2 BY-LAW NUMBER 8-1983 A BY-LAW TO REGULATE TRAFFIC IN THE CORPORATION OF THE TOWN OF SHELBURNE. BY THE MUNICIPAL COUNCIL THEREOF ENACTS AS FOLLOWS: SECTION 1 DEFINITIONS 1. BOULEVARD means that portion of a highway, other than a sidewalk or an entrance from a roadway to a private road, driveway or lane, between the curb lines or the lateral lines of a roadway and the adjacent property line; 2. BY-LAW ENFORCEMENT OFFICER means a person appointed by the Corporation to enforce this By-Law; 3. CORPORATION means The Corporation of the Town Of Shelburne 4. CROSSWALK means: (a) That part of a highway at an intersection that is included within the connections of the lateral lines of the sidewalks on opposite sides of the highway measured from the edges of the roadway, or (b) Any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by signs or by lines or other markings on the surface; 5. GROSS WEIGHT means the combined weight of vehicle and load; 6. HEAVY TRAFFIC means the use of a highway by a vehicle, object or contrivance for moving loads being a gross weight including the vehicle, object, or contrivance and load, in excess of five (5) tonnes; 7. HIGHWAY includes a common and public highway, street, lane, avenue, parkway, driveway, square, place, bridge, viaduct or trestle, designed for and intended for, or used by the general public for the passage of vehicles; 8. HOLIDAY means a holiday as defined in the Interpretation Act; 9. INTERSECTION means the area embraced within the prolongation or connection of the lateral curb lines or, if none, then of the lateral boundary lines of two or more highways that join one another at an angle, whether or not one highway crosses the other; 10. MOTOR VEHICLE includes an automobile, motorcycle, motor-assisted bicycle unless otherwise indicated in the Highway Traffic Act and any other vehicle propelled or driven otherwise than by muscular power but does not include the cars of electric or steam railways, or other motor vehicles running only upon rails or a motorized snow vehicle, traction engine, farm tractor, self-propelled implement of husbandry or roadbuilding machine within the meaning of the Highway Traffic Act; 11. ONE-WAY STREET means a highway upon which vehicular traffic is limited to movement in one direction; 12. PARK OR PARKING, when prohibited, means the standing of a vehicle whether occupied or not, except when standing temporarily for the purpose of and while actually engaged in loading or unloading merchandise or a passenger. 13. PEDESTRIAN CROSSOVER means any portion of a roadway designated by bylaw of a municipality at an intersection or elsewhere, distinctly indicated for pedestrian crossing by signs on the highway and lines or other markings on the surface of the roadway as prescribed by the regulations; 14. PEDESTRIANS means a person on foot and invalids and children in a wheelchair or carriage; 15. PHYSICALLY HANDICAPPED PERSONS means any person whose mobility

3 is severely impaired or possesses a physical disability; 16. ROAD BUILDING MACHINE means a self-propelled vehicle designed and used primarily in connection with the building or maintenance of highways and not designed or used for carrying a load; 17. ROADWAY means the part of the highway that is improved, designated or ordinarily used for vehicular traffic, but does not include the shoulder, and where a highway includes two or more separate roadways the term roadway refers to any one roadway separately and not to all the roadways collectively; 18. SAFETY ZONE means the area or space set apart within a roadway for the exclusive use of pedestrians which is protected or is so marked or indicated by adequate signs as to be plainly visible at all times while set apart as a safety zone; 19. SELF-PROPELLED IMPLEMENT OF HUSBANDRY means a self-propelled vehicle manufactured, designed, redesigned, converted or reconstructed for a specific use in farming; 20. SIDEWALK means that portion of a highway between the curb lines or the lateral lines of a roadway and the adjacent property lines intended for the use of pedestrians; 21. STAND OR STANDING, when prohibited, means the halting of a vehicle, whether occupied or not, except for the purpose of and while actually engaged in receiving or discharging passengers. 22. STOP OR STOPPING, when prohibited, means any stopping of a vehicle, even momentarily, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a constable or other police officer or of a traffic control sign or signal; 23. TRAFFIC includes pedestrians, ridden or herded animals, vehicles and other conveyances either separately or together while using any highway for the purposes of travel; 24. TRAFFIC CONTROL DEVICE means any sign, or other device erected or placed under the authority of the Municipal Council for the purpose of regulating traffic; 25. TRAFFIC SIGNAL means any device manually, electrically or mechanically operated for the regulation or control of traffic; 26. U-TURN means to turn a vehicle within a highway so as to proceed in the opposite direction; 27. VEHICLES include a motor vehicle, trailer, traction engine, farm tractor, roadbuilding machine and any vehicle drawn, propelled, or driven by any kind of power, including muscular power, but does not include a motorized snow vehicle and the cars of electric or steam railways running only upon rails. SECTION 2 GENERAL 1. Where any expression of time occurs or where any hour or other period of time is stated, the time referred to shall be standard time except in periods when daylight saving time is in effect, in which periods, it shall be daylight saving time. 2. (a) The Works Supervisor for the Town of Shelburne or his designate, is authorized to place or erect and to maintain such authorized signs, and signs in accordance with the Regulations of the Highway Traffic Act, as are required to give effect to the provisions of this By-Law. (b) No person shall place, maintain or display on any highway, any sign, marking or device which purports to be or is an imitation of or resembles an authorized sign or sign in accordance with the Regulations of the Highway Traffic Act. 3. The Chief of Police and the Works Supervisor are hereby authorized to erect or place temporary No Parking and/or No Stopping signs on any highway. 4. (a) No person who is selling or offering for sale, goods or produce from a stationary vehicle on a highway shall park the vehicle or permit the vehicle to remain parked in such a manner as to obstruct traffic

4 (b) No person shall offer for sale or sell goods or produce from a vehicle on a highway except from the side of such vehicle facing an inner boulevard. (c) No person shall stop or permit to remain stopped, a vending vehicle on any highway unless parking is permitted and the person shall be governed by the regulations specified in relation to the location. (d) Notwithstanding (c) above, no person shall park or permit to remain parked a vending vehicle for longer than fifteen (15) minutes in any one location in any one day. 5. The Schedules referred to in this By-Law form part of this By-Law and each entry in a Column of such a Schedule shall be read in conjunction with the entry or entries across there from and not otherwise. 6. If any section, subsection or part of this By-Law be declared by any Court of Law to be bad, illegal or ultra vires, such part or parts hereof should be declared to be separate and independent and enacted as such. 7. The provisions of this By-Law shall be enforced by the Police Department and/or Municipal By-Law Enforcement Officers. SECTION 3 GENERAL STOPPING AND PARKING REGULATIONS 1. No person shall park or stop any vehicle on any highway or portion thereof except as follows: (a) where there is a curb on the right side of the traveled portion of the highway having regard to the direction such vehicle was proceeding with its right front and rear wheels parallel to and not more than 15 cm. out from such curb. (b) Where there is no curb with the right front and rear wheels parallel to and as near to the right-hand limit of the highway as is practicable without stopping or parking on or over a sidewalk, footpath or boulevard. 2. The provisions of subsection 1 do not apply where angle parking is permitted under section 9, hereof or to parking or stopping a vehicle on the left hand side of the traveled portion of the highway designated for one-way traffic. 3. Where angle parking is permitted on a highway, no person shall stop or park any vehicle except at an angle of 90 degrees from the curb or boundary of the roadway, with the front end of the vehicle at such curb or boundary. 4. Where angle parking spaces are designated by lines painted on the roadway, no person shall stop or park any vehicle except within an area designated as a parking space 5. Where parking is permitted on the left-hand side of the traveled portion of a highway designated for one-way traffic, no person shall park or stop any vehicle on the left-hand side of the highway or portion thereof except as follows: (a) where there is a curb on the left side of the traveled portion of the highway, having regard to the direction such vehicle was proceeding, with its left front and rear wheels parallel to and not more than 15 cm. out from such curb; (b) where there is no curb, with the left front and rear wheels parallel to and as near to the left-hand limit of the highway as is practicable without stopping or parking on or over a sidewalk, footpath or boulevard. 6. No person shall on any highway park any vehicles: (a) on or over a sidewalk, footpath, or boulevard; (b) within an intersection or crosswalk; (c) within a designated pedestrian crossover; (d) within 10M.of a pedestrian crossover; (e) on the roadway alongside of any stopped or parked vehicles; (f) other than a bus in a designated bus stop, except that the driver of a passenger vehicle may temporarily stop therein for the purpose of and while actually

5 engaged in loading passenger when such stopping does not interfere with any bus; (g) alongside or across the highway from any excavation or obstruction in the roadway where the free flow of traffic would thereby be impeded; (h) on any street within Town limits daily, 12 midnight to 8 A.M. December 1 st to March 31 st. SECTION 4 PARKING REGULATIONS - UNSIGNED AREAS 1. No person shall on any highway park any vehicle: (a) in such a manner as to interfere with the movement of traffic or the clearing of snow from the highway; (b) in such a manner as to interfere with highway cleaning operation; (c) in front of, or within 2M of a driveway or laneway or so as to obstruct vehicles in the use of driveway or laneway; (d) within 3M of a point on the curb or edge of the roadway adjacent to any fire hydrant; (e) within 10M of an intersecting roadway; (f) for the purpose of washing, greasing, or repairing a vehicle (g) for the purpose of displaying the vehicle for sale (h) alongside the tracks of any railway (i) within 15M of the nearest rail or any level crossing of a railway (j) in such a position as will prevent the removal of any other vehicle previously parked; (k) within 15 M of any intersection controlled by traffic signals; (l) on the traveled portion of the roadway other than a cul-de-sac where the roadway width is 6M or less; (m) no person shall park or leave any motor vehicle on any Municipal property where by means of one or more signs, it is indicated that such parking or leaving is not authorized. SECTION 5 PARKING REGULATIONS SIGNED AREAS Where signs in accordance with the Regulation of the Highway Traffic Act are displayed, no person shall park any vehicle: 1. On any highway in front of an entrance to, or exit from any building or enclosed space in which persons may be expected to congregate in large numbers. 2. On any highway within 8M of any fire hall on the side of the highway on which the fire hall is located, or within 30 M of such fire hall on the opposite side of the highway. 3. Within 15 M of an intersection controlled by traffic lights. 4. Within 15 M of an intersection. 5. Within the turning basin of a cul-de-sac. 6. Within 15M of the end of the roadway on a dead end highway. 7. Other than a school purpose vehicle in a school bus loading zone. 8. Any time between the hours of 8:30 A.M. and 4:30 P.M. Monday to Friday inclusive, on one or both sides of a highway or portion thereof which is immediately adjacent to a school.

6 SECTION 6 STOPPING RESTRICTIONS AND PROHIBITIONS ON CERTAIN HIGHWAYS 1. Where signs in accordance with the regulations of the Highway Traffic Act are displayed, no person shall stop a vehicle on any highway at the side and between the limits set out respectively in Columns 1, 2 and 3 of Schedule A to this By-Law during the prohibited times or days set out in Column 4 of the said schedule. SECTION 7 PARKING RESTRICTIONS AND PROHIBITIONS ON CERTAIN HIGHWAYS 1. Where signs in accordance with the Regulations of the Highway Traffic Act are displayed, no person shall park a vehicle on any Highway at the side and between the limits set out respectively in Columns 1, 2 and 3 of Schedule B to this By-Law during the prohibited times or days set out in Column 4 of the said schedule. 2. Where signs in accordance with the Regulations of the Highway Traffic Act are displayed, no person shall park a vehicle on any highway at the side and between the limits set out respectively in Columns 1 and 2 of Schedule C to this By-Law during the times or days set out in Column 3 of the said schedule for a longer period than that set out in Column 4 of the said schedule. SECTION 8 STANDING RESTRICTIONS AND PROHIBITIONS ON CERTAIN HIGHWAYS 1. Where signs in accordance with the Regulations of the Highway Traffic Act are displayed, no person shall stand a vehicle on any highway at the side and between the limits set out respectively in Columns 1, 2 and 3 of Schedule D to this By-Law during the prohibited times or days set out in Column 4 of the said schedule. SECTION 9 PERMITTED ANGLE PARKING 1. No person shall angle park in accordance with the provisions of subsection 3 and 4 of Section 3, on the highways at the sides and between the limits set out respectively in Column 1, 2 and 3 of schedule E to this By-Law, for a longer period than set out in Column 4 of the said schedule. SECTION 10 LOADING ZONES 1. Where signs in accordance with the Regulations of the Highway Traffic Act are displayed, vehicles actually engaged in the loading and unloading, delivery, and receipt of goods, wares, merchandise or passengers to adjoining premises may be parked during such time as the said loading, unloading, delivery or receipt is actually taking place on any highway at the side and between the limits set out respectively in Columns 1, 2 and 3 of Schedule F to this By-Law. SECTION 11 STANDS FOR TAXICABS 1. No person shall stop or park a vehicle or permit a vehicle to remain stopped or parked in a stand for taxicabs other than a taxicab waiting for hire or engagement. 2. Stands for taxicabs are hereby authorized and assigned on the highways at the sides and at the locations, set out respectively in Columns 1, 2 and 3 of Schedule G to this By-Law for the permitted number of taxicabs set out in Column 4 of the said Schedule for use between the hours set out in Column 5 of the said schedule and when signs to that effect are erected. SECTION 12 DESIGNATED ONE-WAY STREETS 1. The highways set out in Column 1 of Schedule H to this By-Law between the limits set out in Column 2 of the said Schedule, during the times or days set out in Column 3 of the said schedule, are hereby designated for one-way traffic only in the direction set out in Column 4 of the said schedule.

7 SECTION 13 TURNING MOVEMENTS 1. Where signs in accordance with the regulations of the Highway Traffic Act are displayed, no person operating a vehicle shall at any time make a U-Turn at the locations set out in Column 1 of Schedule I to this By-Law while traveling in the direction set out in Column 2 of the said schedule. SECTION 14 THROUGH HIGHWAYS 1. The Highways set out in Column 1 of Schedule "J" to this By-Law between the limits set out in Column 2 of the said Schedule, are, except as provided in subsection (2) of this Section, hereby designated as through highways. 2. The designation in subsection (1) of this section of a highway or portion of highway as a through highway shall not include any intersection thereon where the highway intersected is a King's Highway or where traffic control signals are installed. SECTION 15 STOP SIGNS 1. The intersections set out in Column 1 of Schedule K to this By-Law are designated as intersections where stop signs shall be erected at the locations shown in Column 2 of the said schedule. SECTION 16 YIELD SIGNS 1. The intersections set out in Column 1 of Schedule L to this By-Law are designated as intersections where yield right-of-way signs shall be erected at the locations shown in Column 2. SECTION 17 SPEED ZONES 1. Where any highway or portion of highway set out in Column 1 of Schedule M of this By-Law, between the limits set out in Column 2, is marked in compliance with the regulations under the Highway Traffic Act, the maximum rate of speed thereon shall be the rate of speed prescribed in Column 3 of said schedule. SECTION 18 PEDESTRIAN CROSSOVER 1. The roadways set out in Column 1 of Schedule N to this By-Law at the locations set out in Column 2 of said schedule are designated as pedestrian crossovers and shall be indicated at such locations, as prescribed by the regulations made under the Highway Traffic Act. SECTION 19 HEAVY TRAFFIC 1. Where signs in accordance with the regulations of the Highway Traffic Act have been erected, heavy traffic as defined in Section 1 hereof, is prohibited on the highways or parts of highways set out in Column 1 of Schedule O to this by-law between the limits set out in Column 2 of said schedule during the times or days set out in Column 3 of said schedule. 2. The provisions of subsection 1 of this section shall not extend to the use of said highways or parts of highways for deliveries to or removal from any premises abutting thereon or to ambulances, police or fire department vehicles public utility emergency vehicles, vehicles actually engaged in works undertaken for or on behalf of the Corporation. SECTION 20 PHYSICALLY HANDICAPPED PARKING 1. Where official signs to that effect are displayed, no unauthorized vehicle may be parked on the highways or part of highways set out in Column 1 of Schedule Q to this By-Law between the limits set out in Column 2 of said schedule during the times or days set out in Column 3 for a longer period than set out in Column 4 of the said schedule.

8 SECTION 21 SCHOOL BUS LOADING ZONES 1. Where signs are erected in accordance with the regulations made under the Highway Traffic Act, the highways or portions of highways set out in Column 1 of Schedule P to this By-Law, on the side of the highway set out in Column 2 of the said schedule between the limits set out respectively in Columns 3 and 4 of the said schedule, are hereby designated as school bus loading zones. SECTION 22 PENALTIES 1. Any person who contravenes any of the provisions of Sections 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 20, 21, of this by-law 8-1983 shall be liable to a fine of not less than $5.00 and not more than $100.00 exclusive of costs. Such fines shall be recoverable under the provisions of the Provincial Offenses Act. 2. Any persons violating any of the provisions of Sections 12, 13, 19, of this by-law shall be subject to a penalty of not more than $50.00 exclusive of costs for the first offence and not more than $100.00 for each subsequent offence. Such fines shall be recoverable under the provisions of the Provincial Offences Act. 3. Any person violating any of the provisions of Sections 14, 15, 16, 17 and 18 of this By-Law shall be subject to the penalty provided for such violation in the Highway Traffic Act. 4. The owner of any vehicle for which a notice of violation has been issued alleging a contravention of any of the provisions of the By-Law referred to in Section 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 20, and 21 may make payment of the fine set out in accordance with this By-Law on the notice of violation out of court by remitting such payment to the appropriate authority in violation within the time limit prescribed thereon. 5. A constable or an officer appointed for the carrying out of the provisions of this by-law, upon discovery of any vehicle parked, stopped or standing in contravention of this by-law may cause it to be moved or taken to and placed or stored in a suitable place and all costs and charges for removing, care and storage thereof if any, are a lien upon the vehicle, which may be enforced in the manner provided by Section 48 of the Mechanic's Lien Act. 6. The owner of a vehicle shall incur the penalties provided for any contravention of this by-law unless at the time of the contravention the vehicle was in the possession of some person other than the owner or his chauffeur without the owner's consent in which case the driver or operator of the vehicle not being the owner, shall also be liable to incur the penalties provided for any such contravention. SECTION 23 APPLICATION 1. This by-law applies to all highways under the jurisdiction of the Town of Shelburne. 2. Sections 12, 13, and 19 of this by-law shall not, if compliance therewith would be impracticable, apply to: (a) Ambulances, Police or Fire Department vehicles or Public Utilities emergency vehicles; or (b) Vehicles actually engaged in works undertaken for, or on behalf of any Municipal Corporation; or, (c) Vehicles actually forming part of a funeral procession for as long as may reasonably be required for the purpose of such funeral. 3. By-Laws 788a, 15-1966, 12A-1969, 33-1970, 19-1971, 29,1974, 12-1975, 40-1975, 8-1976, 25-1977, 26-1977, and 3-1983 be and the same, are hereby repealed, or any other by-law which may be in conflict. 4. (a) Subject to subsection 2, the provisions of this by-law shall become effective upon enactment. (b) The provisions of this by-law affecting traffic on a highway designated as a connecting link pursuant to the Public Transportation and Highway Improvement Act
