CITY OF KAMLOOPS BYLAW NO. 40-63 A BYLAW TO AMEND SOLID WASTE AND RECYCLABLES BYLAW NO. 40-59, 2011 The Municipal Council of the City of Kamloops, in open meeting assembled, enacts as follows: 1. This bylaw may be cited as "City of Kamloops Solid Waste and Recyclables Bylaw No. 40-59 Amendment Bylaw No. 40-63, 2015". 2. City of Kamloops Solid Waste and Recyclables Bylaw No. 40-59, 2011, as amended, is hereby further amended as follows: a) Division One - Definitions and Interpretation, Section 101, by: i) adding the following definitions: '"COMMERCIAL NON-ORGANIC WASTE" means waste that originates from commercial or institutional sources that excludes commercial organic waste.'; '"COMMERCIAL ORGANIC WASTE" means compostable organic material including raw and cooked food waste from a commercial premise and includes, but is not limited to: Fruits and vegetables; Meat, fish, shellfish, poultry, and bones thereof; Dairy products; Bread, pasta, and baked goods; Tea bags, coffee grounds, and filters; and Soiled paper plates and cups.'; '"CRUSHABLE MATERIAL FOR AGGREGATE" means crushable material usable for aggregate, including, but not limited to, asphalt, concrete with or without rebar or metal reinforcing, masonry, brick, or ceramic that does not include plastic, insulation, wood, asbestos, garbage, vegetation, or other contaminants.'; '"RESIDENTIAL SOLID WASTE" means waste that originates from residential (single- and multi-family) sources.'; ii) deleting the following definition: '"GREEN WASTE" means grass and hedge clippings, flowers, leaves, garden waste, and branch and tree prunings up to 15 cm (approximately 6 in.) in diameter.'; iii) repealing the definition of "CITY LANDFILL SITE" and re-enacting it as follows: 47

BYLAW NO. 40-63 PAGE 2 '"CITY LANDFILL SITE" means either or all of the following: Mission Flats Landfill; Barnhartvale Landfill; and Kamloops Resource Recovery Centre.'; iv) repealing the definition of "SOURCE - SEPARATED DEMOLITION, LAND CLEARING, AND CONSTRUCTION (DLC) MATERIAL" and re-enacting it as follows: '"SOURCE - SEPARATED DEMOLITION, LAND CLEARING, AND CONSTRUCTION (DLC) MATERIAL" means DLC material that is sorted prior to arriving at the landfill and can be disposed of in its individual waste stream, including, but not limited to, asphalt shingles, gypsum, wood waste, and scrap metal.'; v) repealing the definition of "YARD WASTE" and re-enacting it as follows: '"YARD WASTE" means biodegradable, organic materials, substances, or objects, which may include, but is not limited to, grass, lawn and hedge clippings, flowers, weeds, leaves, garden waste, shrubs, shrub and tree prunings up to 15 cm (approximately 6 in.) in diameter, and material, which originates from household, commercial, or municipal gardening or other horticulture activities, but does not include tree stumps, noxious weeds, rocks, sand, soil, fruit, or vegetable material.'; b) By deleting the words "Finance and Information Technology Director" wherever they appear in the bylaw and inserting therefor the words "Finance Director"; c) By deleting the words "green waste" wherever they appear in the bylaw and inserting therefor the words "yard waste"; d) Division Nine - Disposal Sites, by: i) repealing Section 903 in its entirety and re-enacting it as follows: "903. City residents may dispose of solid waste at City landfill sites if not identified as banned or prohibited as set out in Schedule "J", and at the rates set out in Schedules "F", "G", or "I".'; ii) deleting Section 905 in its entirety: "905. Commercial waste materials shall not be deposited at the Barnhartvale Landfill."; e) Division Twelve - Schedules, by repealing Division Twelve it its entirety, and reenacting it as follows: "DIVISION TWELVE - SCHEDULES The following Schedules are attached to and form part of this bylaw and are enforceable in the same manner as this bylaw: 48

This bylaw shall come into force and effect on the 1st day of January, 2016. READ A FIRST TIME the day of, 2015. READ A SECOND TIME the day of, 2015. READ A THIRD TIME the day of, 2015.
