Purpse This plicy prvides guidelines fr the purchase, maintenance and use f Off-Rad Vehicles (ORV) n the campus f Texas Christian University. Fr the purpse f this plicy, ORV s cvered under this plicy include: Cnventinal glf carts, as defined by the Texas Transprtatin Cde Small utility trucks, such as Micrtruck and Daihatsu s Lw-speed vehicles (<25 mph), as defined by 29 CFR 571.500 All-terrain style r utility vehicles designed fr ff-rad use. Vehicles nt cvered in this plicy are: T-3 Mtin scters Pwered wheelchairs, scters, etc., used fr medical r disability reasns Segway scters Garden equipment, such as tractrs and riding mwers. II. Prcedures The intent is t establish prper safety prcedures and practices, and t prmte and prvide fr a pedestrian friendly envirnment fr students, faculty, and staff. All members f the University cmmunity are gverned by this plicy (students, staff, faculty and utside cntractrs). A. LICENSING - All peratrs f ORV s must meet the fllwing criteria befre perating any ORV n the Texas Christian University campus: Pssess a valid Texas driver's license Operatrs will successfully cmplete an ORV Safety Training Prgram (peratr's training will include signing a statement f understanding f the ORV prgram) thrugh TCU Risk Management. B. Apprval t Purchase Departments must receive written apprval t purchase an Off-rad vehicle including glf carts thrugh their assciated Vice-Chancellr, r designee. This apprval must accmpany the wner at the time f purchase, registratin, and request fr insurance cverage f the Off-Rad vehicle. Purchasing Upn publicatin f this plicy, all purchases f Off-Rad Vehicles including glf carts will be made thrugh the TCU Fleet Manager in Facility Services. C. REGISTRATION OF VEHICLES All TCU-wned ORV s will be registered thrugh the TCU Plice wh will maintain a centralized database fr enfrcement and insurance needs. Reviewed as f 1/15/2009 pg. 1 f 6

TCU Plice will develp prcedures fr registratin and the cllectin f registratin data. Registratin labels will be placed n the frnt, driver s side f the vehicle, under the windshield. Registratin will be required nly nce during the life f the ORV. Once the vehicle is remved frm service, the wner r department will ntify TCU Plice fr remval frm the database. Cntractrs that will have vehicles perating n campus prperty utside f a designated cnstructin site will register with the TCU Plice. Rental ORV s that will be perating n campus prperty will be registered with the TCU Plice. D. DISCIPLINARY ACTIONS -The safe peratin f ORV s is paramunt. Failure t fllw this plicy, render cmmn practices r curtesies, r fllw the rules f the rad fr the State f Texas culd result in cunseling including apprpriate disciplinary actin, suspensin f peratr's driving privileges and/r pssible terminatin. E. MARKING OF VEHICLES All TCU-wned r rented ORV s will be identified and marked with the fllwing: The name f the University department perating the vehicle t be lcated n the frnt f the vehicle, when pssible, with the ptin f placement n the sides and back. A unique identificatin number fr the vehicle with numbering f at least 2 3 / 4 height. The identificatin number will be lcated n bth sides f the ORV. A TCU lg which meets the current TCU graphic standard as listed by the Divisin f Marketing and Cmmunicatin. The lg graphic will be lcated n the frnt f the ORV, when pssible, with the ptin f the placement f graphics n the sides and back. All lettering will be f cntrasting clr t the backgrund clr f the label r the clr f the ORV. TCU-rented ORV s may use a laminated 8 x12 sheet f paper as a substitute fr permanent markings. Cntractrs and ther nn-tcu cmpanies, crpratins, etc., must display their cmpany name n their carts at the wner's expense. F. SAFETY FEATURES - Minimum safety features fr ORV s include: Three-wheeled ORV s are prhibited. All riginal equipment and safety features must be kept in gd wrking rder and cannt be mdified r repaired except by the manufacturer r their representative. A slw-mving reflective triangle shuld be displayed n all TCU wned utility trucks whse speed is n greater than 25 mph. A permanent yellw strbe light, viewable frm 360º, may be substituted n glf carts r ATV style vehicles. The wner (department) is respnsible fr csts assciated with this installatin. ORV s perating at night must be equipped with headlights and a light visible frm the rear. ORV s perating at night must nt perate n any street, ther than t crss ver. ORV s will have small fire extinguisher munted n the vehicle. G. OPERATING PROCEDURES - The fllwing rules utlines prcedures fr the safe peratin f carts: Supervisrs will mnitr and ensure that all persns perating ORV s have been instructed in the safe peratin f their equipment and have had the required training in Risk Management prir t perating the ORV. Glf carts and ATV s are prhibited frm perating n the public radways in and arund the campus except when crssing frm ne side f the street t anther r utilizing a radway where n accessible sidewalk exists fr the safe peratin f an ORV. Glf carts and ATVs must utilize nly legal crsswalks as nted n the attached campus map. ORV s will park and nt perate during scheduled class changes. All lads carried by ORV s will be secured (bungee crds, etc.) t prevent them frm falling ut f the vehicle. The maximum speed limit ff f public radways (sidewalks, parking lts, etc.) is 8 mph. All vehicles nt registered as street legal will be gverned dwn t 8 mph. Operatrs may nt wear headsets, earphnes, etc., while perating ORV s. Pedestrians have the right-f-way n campus. Carts must yield t pedestrians n sidewalks. Speed is t be reduced when appraching, passing pedestrians and ther OVRs. Operatrs are t be diligent and pay particular attentin t the needs f disabled persns, as limitatins in visin, hearing r mbility may impair their ability t see, hear, r mve ut f the way f ORV s. ORV s are nt t be verladed, i.e. carrying mre passengers than seating prvided r verlading the ORV s recmmended carrying r lad capacity. Emplyees and students are prhibited frm riding in the utility bed f glf carts and ATV s. Operatrs are respnsible fr ignitin keys fr the perid f time in which they are using the ORV. D nt leave keys in the carts. Where available, peratrs must park in designated cart parking areas. Operatrs are nt t blck the path r limit pedestrian access t walkways. D nt blck handicap access pints. University-wned carts are t be used fr University business nly and are nt allwed ff-campus. Operatrs are nt allwed t drive ORV s under the influence f drugs r alchl. Operatrs f ORV s will present TCU identificatin cards, upn request, t TCU Plice r Risk Management. H. MAINTENANCE PROCEDURES - University-wned ORV s are t be maintained in accrdance with the manufacturer recmmended service schedule. Repairs and regular maintenance are the respnsibility f the Department wning the cart. The Departments are financially respnsible fr all repair and mainten- Reviewed as f 1/15/2009 pg. 3 f 6

ance csts (labr, parts, and supplies). The Department is required t keep all preventative maintenance and repair recrds related t the ORV. Departments are respnsible fr keeping all riginal equipment and safety features in gd wrking rder. Repairs r mdificatins that d nt meet r exceed the riginal manufacturer s specificatin are prhibited. Readjustment r the remval f speed-cntrl devices (gvernrs) is strictly prhibited and will result in the vehicle being red-tagged and taken ut f service until the prblem is crrected. Failure f brakes requires that the vehicle be taken ut f service immediately and returned t service upn repairs. The Risk Management department will investigate any reprts f unsafe vehicle cnditins. G. THIRD PARTY ORV S - Except under certain cnditins, cntractr r third-party perated ORV s are prhibited frm perating n University prperty. Exceptins include: Cntractr ORV s assciated with any current cnstructin r landscaping prjects as apprved thrugh the Physical Plant. Cntractr ORV s assciated with the Office f Telecmmunicatins. Students with disabilities with apprval by the Vice-Chancellr f Student Affairs r a Student Affairs designee. Departments will prvide the Risk Management department with the needed infrmatin cncerning cntractr r third-party ORV s t be maintained in a database. H. PROHIBITED LOCATIONS N Driving Znes include the fllwing lcatins: Any grassy r flwerbed areas. Any public radway with mre than tw lanes. Inside, under, r thrugh the cnfines f any University building. The Campus Cmmns between the Student Unin and Scharbauer Hall. (The exceptin is Physical Plant maintenance vehicles, if they are required t perfrm maintenance activities within the cnfines f the Campus Cmmns.) N Parking Znes include the fllwing lcatins: Any grassy r flwerbed areas Inside the Campus Cmmns between the BLUU and Scharbauer Hall In frnt f the BLUU facing Stadium Drive In frnt f any building facing University Drive that is lcated n either the east r west side. I. ACCIDENTS AND ASSESSMENT FOR DAMAGES The peratr must reprt any accidents immediately t his supervisr, t TCU Plice department, and t Risk Management fr prcessing. TCU Plice and the Risk Management departments will investigate all accidents resulting in prperty damage r persnal injury invlving ORV s t determine negligence. Reviewed as f 1/15/2009 pg. 4 f 6

Each department will be held liable fr the first $500.00 f any prperty damage resulting frm negligent peratin f its vehicle. III.
