Executive Summary RECOMMENDATION Staff recommends the City Council (1) find that the conformance with the bidding procedures in the Municipal Code would be contrary to the best interests of the City, (2) waive the bidding requirements as the City is utilizing the National Intergovernmental Purchasing Alliance (NIPA) bid process, and (3) move to approve a purchase order in the amount of $338,022.60 to Toter, LLC for the purchase of specified 96-gallon waste containers. INTRODUCTION The 96-gallon waste containers are used to service the residential properties throughout the City. The existing containers are either missing, damaged or worn beyond repair and are past their ten-year warranty. With the current condition of the 95- and 96-gallon containers, landscapers are using their neighbor s containers or placing yard waste material in the black containers; black containers are not designated for yard waste and this practice reduces the City s diversion rate. If this purchase order is approved, these containers will replace all of the existing damaged 95- and 96-gallon waste containers throughout the City. Page 1 of 2 4/25/2017

Meeting Date: May 2, 2017 DISCUSSION The City of Tucson, Arizona s Department of Procurement issued Request for Proposal (REP) #120576 on June 14, 2012, to establish a national contract for refuse and recycling container solutions and related products, equipment and services. Notice of the solicitation was sent to potential bidders as well as advertised. On August 3, 2012, proposals were received from the following bidders, Otto - (Injection Molded), Rehrig - (Injection Molded), and Toter - (Rotational Molded). The proposals were evaluated by a committee using the criteria established in the REP and the committee elected to enter into negotiations with Toter. The City of Tucson, Arizona, National IPA and Toter successfully negotiated a contract and the City of Tucson executed the agreement with an effective date of January 31, 2013. The contract carries a five (5) year term and has an expiration date of January 30, 2018. The Environmental Services Bureau Solid Waste Division has had success with Toter waste container products dating back to the 1990 s, and has gained valuable experience during the past two major replacement schedules replacing the then-current 95-gallon waste containers. There are two types of container manufacturing processes, injection molded and rotational molded. Over the past 27 years, the Solid Waste Division has experienced superior durability from the rotational molded containers as compared to the injection molded containers. City-provided Toter FULL SERVICE CART MAINTENANCE City of Tucson/National IPA Contract 120576 February 1, 2017 through April 30, 2017 This service is intended to ensure that all Cityowned Toter Carts remain in complete working order and that the City can accurately budget its annual cart program cost. 1. Toter must provide field repair or replacement of all City-owned Toter Carts requiring maintenance service and deliver new carts to new residences within five (5) business days of receiving an electronic written work order from the City. 2. Toter is responsible for all repair or replacement cost, regardless of the cause of the maintenance problem (except fire, loss, theft or vandalism), including the cost of parts and City approved replacement carts. 3. Should the City choose to allow a resident to request swap of the cart size at his residence, Toter will retrieve the old cart and deliver a new or approved used cart provided by the City. The cost for each cart swap will be billed to the City at the end of each month. 4. Toter will base its maintenance decisions on the following: 1) specifically excluded items under Toter s Limited Warranty; 2) expired warranty; or 3) fire! vandalism! lost! stolen. Maintenance will be provided to the City using City provided parts/carts. Toter s decisions as they relate to maintenance regarding these items shall be final. 5. The City and Toter will coordinate the submittal of periodic reports as required by the City to monitor the performance of the service program. Using the evaluation criteria established in the REP, the committee elected to enter into negotiations with Toter and proceeding with contract award upon successful completion of negotiations. The City of Tucson, AZ, National IPA and Toter successfully negotiated a contract and the City of Tucson executed the agreement with a contract effective date of January 31, 2013.
