1. Introduction The building industry in Hong Kong has made tremendous progress in recent years but its increased activities have brought about a correspondingly high accident rate. To protect workers in this industry, the Construction Sites (Safety) Regulations were introduced in August, 1973 under the Factories and Industrial Undertakings Ordinance. These regulations lay down legal requirements to ensure the safety, health and welfare of the workers on construction sites. This guide sets out briefly the provisions of the Construction Sites (Safety) Regulations and explains the law in simple language. It is so designed that besides serving as a handy reference, it also serves as a checklist of matters requiring attention. While every care has been exercised in the preparation of this guide, the Construction Sites (Safety) Regulations remain to be the sole authority for the provisions of the law explained; Enquiries concerning the regulations may be made to the Factory Inspectorate of the Labour Department at the following address: Labour Department Kowloon Regional Office Canton Road Government Offices 9th floor Kowloon Telephone 3-691588 3-691720 2. Definitions Except where the context otherwise requires, the terms in the regulations are defined as follows: "competent examiner", in relation to the carrying out of any test and examination required by these regulations, means a person who is R. 2(1)

(a) (b) appointed for that purpose by the contractor required by these regulations to ensure that the test and examination is carried out; and by reason of his qualifications, training and experience, competent to carry out the test and examination; R. 2(1) "competent person", in relation to any duty to be performed under these regulations by a competent person, means a person who is (a) appointed for that purpose by the contractor required by these regulations to ensure that the duty is carried out by a competent person; and (b) by reason of substantial training and practical experience, competent to perform the duty; R. 2(1) "construction site" means a place where construction work is undertaken and also any area in the immediate vicinity of any such place which is used for the storage of materials or plant used or intended to be used for the purpose of the construction work; R. 2(1) "crane" means any appliance equipped with mechanical means of raising and lowering a load and for transporting the load while suspended; and also all chains, ropes, swivels, or other tackle (down to and including the hook), used in the operation of a crane; but does not include (a) a hoist block running on a fixed rail or wire; (b) a stacker or conveyor whereby a load is moved by means of a belt or platform; or (c) an earth or mineral moving or excavating appliance not fitted with a grab; R. 2(1) "hoist" means a lifting machine, whether worked by mechanical power or not, with a platform, or cage, the movement of which is restricted by guides; and also the supports, well and enclosures, and the platform or cage, and the whole of the mechanical and electrical apparatus (if any) required in connection with the operation and safety of a hoist;

"lifting appliance" means a crab, winch, pulley block, j R. 2(1) or gin wheel used for raising or lowering and a hoist, crane, sheerlegs, excavator, drag line, pile driver, pile extractor, or overhead runway; "lifting gear" means a chain sling, rope sling, ring, or R. 2(1) similar gear, and a link, hook, plate clamp, shackle, swivel, or eyebolt; "maintained" means maintained in an efficient state, in R. 2(1) efficient working order and in good repair; "person trained in first-aid" means a person who R. 55(1) (a) holds a current certificate of competency in first aid issued by the St. John Ambulance Association; (b) is a registered nurse within the meaning of the Nurses Registration Ordinance; or (c) has otherwise completed a course of training in first aid approved by certificate under the hand of the Commissioner; "plant" includes any plant, equipment, gear, machinery, R. 2(1) apparatus, or appliance, or any part thereof; "prime mover" means any engine, motor, or other R. 2(1) appliance, which provides mechanical energy derived from (a) steam or electricity; (Z?) the combustion of fuel; or (c) any other source; "raising or lowering or as a means of suspension" R. 2(1) means raising or lowering or as a means of suspension of a load on a lifting appliance or lifting gear; "safe working load", in relation to a lifting appliance R. 2(1) or to lifting gear, means either (a) the appropriate safe working load for operating the appliance or gear as specified in the current certificate of test given in the prescribed form by a competent examiner in respect of the appliance or gear for the purposes of these regulations; or

(ft) where no such certificate is required, the relevant safe working load marked or exhibited on the lifting appliance, lifting gear, chain, rope, or other article of plant; R. 2(1) R. 2(1) R. 2(1) R. 2(1) R. 2(2Xfl). R. R. 3 R. 4 "subcontractor" means a person employed by a contractor to perform construction work under a contract for services; "transmission machinery" means any shaft, wheel, drum, pulley, system of fast and loose pulleys, coupling, clutch, driving belt, or other device, by which the motion of a prime mover is transmitted to or received by any plant; "used" or "in use", in relation to any plant, means used or in use in construction work; "workman" means a person engaged in construction work. 3. Responsibility of Contractors A contractor is responsible for a construction site if (i) he is undertaking construction work there, or (ii) where there is more than one contractor undertaking contruction work at the site, he is the principle contractor undertaking work there. A contractor is responsible for any plant referred to in these regulations if it is located at a construction site for which he is responsible. 4. Application of the Regulations The regulations apply to all construction work and to all construction sites. 5. Exemptions The Commissioner may grant by certificate in writing conditional exemption from any requirement of these regulations relating to safety or health in respect of a particular class or description of plant or of any special description or method of work.

6. Notification of Construction Work 6.1 Information to be furnished A contractor shall notify the Commissioner in writing the following information within seven days after the commencement of any construction: (a) the contractor's name and address; (if the contractor is a firm, the name under which it carries on business and the name and address of every partner in the firm.) (b) the name and address of every subcontractor employed on the work; (c) the location of the construction work; (d) the nature of the work; (e) the date upon which the work was commenced; (f) whether any mechanical power is being or will be used and, if so, its nature; and the expected duration of the work. te) However, such notification is not necessary if (a) the work takes less than six weeks to complete or the work is additional to any other construction work on the same site for which the Commissioner has been notified; or (b) not more than 10 workmen are or will be employed on the work at any one time. R. 51(1) R. 51(2) 6.2 Further Information If requested by the Commissioner by notice in writing, a contractor shall, within 14 days from the date of the notice, furnish in writing to the Commissioner such further information about the construction work as may be specified in the notice. R. 52

R, 61(1X6) R. 61(lXc) R. 56 6.3 Notification of Change The contractor shall, within seven days after becoming aware of any change in the information furnished, notify the Commissioner in writing of such change. 6.4 Notification of Completion The contractor shall also, within seven days after the date of completion of the construction work, notify the Commissioner in writing of the date of completion. 7* General Health and Welfare Requirements 7.1 Shelter A room or covered area where workmen can take shelter during inclement weather shall be provided. 7.2 7.3 Drinking Water A supply of wholesome drinking water shall be provided. Places for Cooking and Meals If facilities for obtaining meals are not available in the vicinity of the site, or if the Commissioner so directs, a room or covered area where workmen can take meals and one or more stoves on which hot meals can be prepared shall be provided. Note If the room or covered area where workmen can take meals provides shelter from inclement weather, it is not necessary to provide a separate shelter as stipulated by Regulation 7.4 First Aid Facilities A construction site with five or more workmen shall have a separate first aid box or cupboard for every 50 workmen or part thereof. The first

aid box or cupboard shall be readily accessible and large enough to contain the items specified in the Second Schedule (See Page 43) and any additional items that may be required by the Commissioner. All items in the box or cupboard shall be maintained in a serviceable and sanitary condition and all materials for dressings shall be those designated in, and are of a grade not lower than the standards specified by, the British Pharmaceutical Codex or by any supplement to it. The box or cupboard shall contain nothing but equipment for first aid and shall be marked "FIRST AID" in English and "«*" in Chinese. 7.5 Persons in Charge of First Aid Facilities All first aid boxes or cupboards shall be placed R. 57 in the charge of a team of responsible persons whose name shall be put down in a notice in English and Chinese affixed to each first aid box or cupboard. If a first aid box or cupboard is not provided in a workroom at a construction site, a notice in English and Chinese stating its location and the names of the team of responsible persons shall be displayed in such workroom. At least one member of such team shall be always readily available during working hours. 7.6 First- Aiders A construction site with not less than 30 but R. 53 less than 100 workmen shall have available a person trained in first aid. A construction site with 100 or more workmen shall have available at least two persons trained in first aid. 7.7 Provision of Stretchers A construction site with 50 or more workmen R. 59 shall have a readily serviceable stretcher.

R. 60 R. 41 R. 50 R. 42 R. 43(a) 7.8 Exemption from Regulations 56-59 If a room for the sole purpose of providing first aid or medical treatment is available at a construction site, the Commissioner may, by notice in writing, exempt the site from the requirements of Regulations 56-59. The notice shall be prominently displayed in the room so provided. 8. General Safety Requirements 8.1 Handling and Stacking of Materials Materials shall not be placed or stacked close to the edge of any excavation, pit or opening. Similarly, load or plant shall not be placed near such edge. Materials, including scaffolding materials and waste materials, tools and other objects, shall not be thrown, tipped or shot down from a height if they are liable to cause injury to any person on or near the site. Where proper lowering by lifting appliances or gears is impractical or demolition is being carried on, steps shall be taken to protect persons from being hit by falling debris. All platforms, gangways, floors or other places on the sites used as passageways shall be kept clear of any loose materials which are not required for immediate use. 8.2 Dust and Fumes If grinding, cleaning, spraying, mixing or working of any material gives off injurious dust or fumes, there shall be adequate ventilation or suitable respirators or other means of preventing the inhalation of such dust or fumes. 8.3 Protective Equipment Goggles or screens shall be provided for the protection of workmen who are engaged in any process which results in particles of material or 8

dust being produced in such a manner as to be likely to enter or damage the workmen's eyes. The contractor shall ensure that the workmen R. 43(6) use the goggles or screens so provided. Suitable safety helmet shall be provided to R. 46 each workman employed by the contractor who shall take all reasonable steps to ensure that workmen on the construction site wear the helmets so provided. 8.4 Fencing of Machinery (whether operated by power or hand) Every flywheel and moving part of the prime R. 44(1) mover, every part of the transmission machinery, or every dangerous part of any other machinery shall be securely fenced unless it is safe by position or construction. Such fencing shall be kept in position while R. 44(2) the machinery is in motion, unless lubrication or adjustment necessitates the removal of the fencing. 8.5 Use of Electricity Where workmen employed at a construction R. 45(1) site are liable to come into contact with any live electric cable or apparatus, the contractor shall, before the commencement of work and during its progress, take steps to prevent them from being endangered by the cable or apparatus. Where there is any electrically charged over- R. 45(2) head cable or apparatus, the contractor shall ensure that the cable or apparatus will not be dangerous to the workmen. This may be done by the provision of adequate and suitably placed barriers or other methods. 8.6 Lighting Adequate and suitable lighting shall be R. 48 provided for all working places, approaches, dangerous openings and places where lifting and lowering operations are in progress.

R. 49 8.7 Projecting Nails No timber or other materials with projecting nails or other sharp objects shall be used or left on any construction site if the nails or objects are dangerous to workmen. 9. Lifting Appliances R. 5(1) R. 5(2) R. 6(1) R. 6(2) R. 7(1) 9.1 Construction, Maintenance and Inspection All lifting appliances shall be of good mechanical construction, made of strong and sound materials, free from patent defect and properly maintained. Adequate arrangements shall be made for fixing and anchoring the appliance to secure its safety. Weekly inspection of the lifting appliances shall be carried out by the driver (or operator) or, if the driver is not competent, by a competent person. The lifting appliances shall not be used again until it has been reported in the prescribed form (Form 1, First Schedule) to be in safe working condition. 9.2 Precautions for Lifting Appliances with Travelling or Slewing Motion Passageway of two feet or more shall be maintained between the slewing or other moving parts of lifting appliances and the guard rails, fences or other fixtures. If passageway cannot be maintained at any particular place, access to that place shall be prevented. 9.3 Platforms for Crane Drivers and Signallers Every platform for the person driving or operating a crane, or for any signaller, shall be 10

(i) of sufficient area for the persons employed ] on it; (ii) close planked or plated; and (iii) provided with safe means of access. j If any such platform has a side from which j R. 7(2) persons may fall a distance of more than six feet six inches, the following shall be provided: (i) a suitable guard rail of adequate strength to a height of at least three feet above the platform and above any raised standing place on the platform; and (ii) toe boards at a height of not less than eight inches above the level of the platform and any raised standing place on it. The boards shall be so placed as to prevent as far as possible the fall of persons, materials and tools from the platform. The space between any toe board on the platform and the lowest guard rail above it shall not exceed two feet three inches. Such guard rail or toe board may be removed R. 7(3) or remain unerected only when it is necessary for persons or materials to go to or leave the platform. 9.4 Driver's Cabin The contractor shall provide a suitable cabin R. 8 which (a) gives the driver or operator of the powerdriven lifting appliance adequate protection from the weather; and (b) is so constructed as to (i) give him a clear and unrestricted view that will enable him to use the appliance safely; and (ii) give ready access to those parts of the appliance that are within the cabin. 11

R. 11(6) R. 12(1) 9.5 Drums and Pulleys Every drum or pulley on which a wire rope of any lifting appliance is carried shall be of sufficient diameter and construction for the rope used. Every rope which terminates at the winding drum of a lifting appliance shall be properly secured to the drum. At least two turns of the rope shall remain on the drum in every operating position of the appliance. 9.6 Brakes, Controls, Safety Devices, etc. Every crane, crab and winch shall be provided with an efficient brake or brakes or other similar safety devices to prevent a suspended load from falling out of control. Every lever, handle, switch, or other device used for controlling the operation of any part of the lifting appliance shall, where practicable, be provided with a suitable spring or other locking arrangement to prevent the accidental movement or displacement of the lever etc. Such lever, handle, switch or other device shall bear clear markings to indicate its purpose and the mode of operation. 9.7 Poles or Beams Supporting Pulley Blocks or Gin Wheels A pulley block or gin wheel suspended from or supported by a pole or beam shall "be. effectively secured to the pole or beam. The pole or beam shall be of adequate strength and be properly secured so as to support the load safely without undue movement. 9.8 Stability of Lifting Appliances If a construction site has a soft or uneven slope, the contractor shall take appropriate pre-

cautions to ensure the stability of the lifting appliances. A crane shall be securely anchored or adequately ballasted. Rails and sleepers shall not be used as an anchorage. 9.9 Anchoring and Ballasting of Cranes Before a crane is erected, all devices used for R. 13(1) anchoring or ballasting shall be examined by a competent examiner. The crane shall be tested by a competent R. 13(2) examiner after each erection, removal, or any adjustment, if such removal or adjustment involves changes in the arrangements for anchoring or ballasting the crane. The crane, having been so examined, shall not R. 13(3) be used until a report in the prescribed form (Form 2, First Schedule) has been obtained. The maximum load of the crane may be R. 13(4) modified by the examiner as he considers necessary. Where a modified safe working load has been R. 13(5) specified in the examiner's report, the contractor shall cause a loading diagram to be placed in a position where the driver can see it. 9.10 Stability of Cranes Secured by Removable Weights A diagram or notice shall be conspicuously R. 14 displayed on the crane showing the amount and position of the removable weights required for stability. 9.11 Use of Cranes in Bad Weather Cranes shall not be used under weather con- R. 15 ditions likely to affect their stability. After exposure to such weather conditions, the cranes shall not be used until the anchorage and 13

ballast have been examined by a competent examiner and necessary steps taken to ensure stability. R. 16 R. 17 R. 18 R. 19 R. 20(1) R. 20(2) 9.12 Cranes with Derricking Jibs The cranes shall be provided with properly maintained and effective locking arrangement between the derricking clutch and the pawl sustaining the derricking drums, unless the hoisting and derricking drums are independently driven or the derricking drum mechanism is selflocking. 9.13 Precautions and Restrictions on the Use of Cranes The hoisting mechanism of a crane shall not be used except for raising and lowering loads vertically, unless it can be used otherwise without imposing undue stress or endangering the stability and unless a competent person supervises the operation. Any crane which has a derricking jib shall not be used with the jib extended at a greater radius than that specified in the certificate of test and examination. A crane which has any structural member made of timber shall not be used. A crane shall not be erected on a construction site except under the supervision of a competent person. Only trained and competent persons shall operate lifting appliances. In case an appliance is operated by a person not so qualified, the operation must be supervised by another qualified person. No person under 18 years of age shall operate any lifting appliance driven by mechanical power or to give signals to the driver of the appliance. 14

9.14 Signals Arrangement for signalling by trained signallers R. 21 to operators of lifting appliances shall be made where necessary. Signals shall be of a distinctive character, and easily seen or heard by the persons to whom they are given. Devices used for giving signals shall be adequately maintained and protected from accidental interference. 9.15 Testing, Examination and Thorough Examination (see Table on Pages 23-24) R. 22-24 9.16 Defects to be Notified (see Footnote to Table on Pages 23-24) ) R. 25 9.17 Marking of Safe Working Loads A crane, crab or winch shall be marked with f R. 26(1) means of identification and the safe working load. A pulley block, gin wheel, sheerlegs or derrick pole or derrick mast shall be marked with means of identification and safe working load if used for loads of one ton or more. A crane (including a crane with a derricking R. 26(2) jib) with variable operating radii shall be marked with safe working load at various radii of the jib, trolley or crab. In the case of a crane with a derricking jib, the maximum permissible radius at which the jib may be worked should be marked on it Such crane shall have an accurate indicator visible to the driver, showing radius of jib, trolley or crab at any time and safe working load for that radius. 9.18 Load Limit Safe working load of lifting appliances shall R. 27 not be exceeded, except when tests of such appliances are being done by competent examiners. 15

9.19 Scotch and Guy Derrick Cranes R. 28(1) The jibs of a Scotch derrick crane shall not be erected between the backstays, and the crane shall not be used to move any load lying in the angle between the backstays. Precautions shall be taken against the foot of the king post of a Scotch derrick crane being lifted from the socket of support whilst in use. R. 28(2) If the guys of a guy derrick crane cannot be fixed at approximately equal angles to the mast so that the angles between adjacent pairs of guys are approximately equal, the contractor shall take such measures as to ensure the stability of the crane. 10. Chains, Ropes and Lifting Gear 10.1 Construction and Safe Working Load R. 29(1) Chains, ropes and lifting gear shall be of good construction, sound material, adequate strength, and shall be free from patent defects. They shall be marked with safe working load and means of identification. R. 29(2) A rope or sling need not be marked with its safe working load if (i) its safe working load is specified in and can be ascertained from the examination report; or (ii) in the case of fibre rope or fibre rope sling or a wire rope which was in use immediately before the commencement of these regulations, its safe working load can be ascertained from a table posted prominently on the construction site. - 29(3) The safe working load required to be entered in an examination report or shown in a table, as the case may be, is deemed to be the safe working load of the rope or rope sling. 16

A wire rope shall not be used for raising or R. 29(4) lowering, or as a means of suspension, if, in any length of 10 diameters, the total number of visible broken wires exceeds five per cent of the total number of wires in the rope. The safe working load shall not be exceeded, R. 29(5) except for the purpose of making tests. 10.2 Examination (See Table on Pages 23-24) R. 30 11. Special Provisions as to Hoists 11.1 Safety of Hoistways, Platforms and Cages R. 31(1) The hoistway of every hoist shall, at all points at which access to the hoistway is provided, or at which persons are liable to be struck by any moving part of the hoist, be efficiently protected by a substantial enclosure, which shall, where access to the hoist is needed, be fitted with gates. The enclosure and gates shall extend to a height of at least six feet six inches except where a lesser height (minimum three feet) is sufficient to prevent any person from falling down the hoistway and there is no risk of any person coming into contact with any moving part of the hoist. The contractor shall ensure that the gate is kept closed except where the platform or cage is at rest at a landing place and it is for the time being necessary for the gate to be opened for the purpose of loading or unloading or allowing persons to enter or leave the cage. Every person using a hoist shall ensure that R. 31(2) the gate is closed immediately after use, unless it is for the time being necessary for the gate to be opened for the same purpose as stated in the preceding paragraph. 17

R. 31(3) The contractor shall provide and maintain (a) efficient devices which will support the platform or cage of a hoist and its safe working load in the event of mechanical failure; and (b) one or more efficient automatic devices to check against over-running of the platform or cage. 11.2 Operation of Hoists A hoist shall not be used unless R. 32(1) (a) it is constructed in such a way that it can be operated only from one position at any one time; and (b) the requirements of Regulation 36 (See Page 19) are complied with. R. 32(2) If the operator of a hoist does not have a clear and unobstructed view of the platform or cage throughout its travel, except at points where such a view is not necessary for.safe working, effective arrangements shall be made for signals to be given to him from each landing place at which the hoist is used and to enable him to stop the platform or cage at the appropriate level. R. 33 11.3 Winches Where a hoist is operated by means of a winch, the winch shall be so constructed that the brake is applied when the control lever, handle or switch is not held in the operating position. The winch shall not have pawl and ratchet gear.' on which the pawl has to be disengaged before the hoist can descend. 11.4 Safe Loading and Marking on Hoists R. 34(1) The safe working load shall be marked on the hoist or on its platform or cage and shall not be exceeded except during tests by a competent examiner. 18

The maximum permissible number of pas- R. 34(2) sengers shall be marked on the hoist or on its platform or cage, and this number shall not be exceeded. Hoists not intended for carrying persons shall R. 34(3) bear a notice prohibiting the carriage of persons. 11.5 Test and Examination of Hoists (See Table on Pages 23-24) R. 35 12. Carrying of Persons and Securing of Loads on Hoists 12.1 Hoists for Carrying Persons The hoist shall be provided with a cage which R. 36 is so constructed that, when the cage gate is shut, will prevent persons from falling out and from being trapped or struck by objects falling down the hoistway. Interlocks shall be fitted ta cage gates to prevent the gates from being opened unless the cage is at a landing place and to prevent the cage from being moved away if the gates are open. Similar interlocks shall be fitted to the gates in the hoistway enclosure. Automatic devices shall be provided to ensure that the cage stops before reaching the lowest point of travel. 12.2 Carrying of Persons by Means of Lifting Appliances No person shall be carried by a power driven R. 37 lifting appliance, other than in a hoist (referred to in 12.1) or on the platform of a crane. 12.3 Securing of Loads Every part of a load shall be securely R. 38 suspended, supported and secured to prevent displacement or slipping. 19

All practicable measures shall be taken to prevent the load from coming into contact with, and displacing any other object. Receptacles for raising or lowering materials shall be so enclosed or constructed as to prevent the fall of such materials. (Grabs, shovels or similar excavating receptacles are exempted if steps are taken to prevent persons from being endangered by a fall of materials or objects therefrom.) Loose materials or goods shall not be carried on the platform of the hoist unless the platform is enclosed or other precautions have been taken to prevent the materials or goods from falling from the platform. No load shall be left suspended unless a competent person is present to supervise the use of the lifting appliance. 13. Excavations on Construction Sites R. 39 13.1 Safety of Excavations, etc. A structure made of suitable timber or other material shall be erected for the excavating or earthworking operations as soon as necessary so as to prevent workmen employed on the site from being endangered by a fall or displacement of earth, rock or other material adjacent to or forming the side of the excavation or earthwork. Every part of the excavation or earthwork shall be examined weekly by a competent person who shall report on the safety of the excavation or earthwork and the above-mentioned structure. (Also see Table on Pages 23-24) The requirements in the preceding two paragraphs do not apply to cases where there is no likelihood of a fall or displacement of earth, rock or other material to bury or trap a workman 20

or to -strike him from a height of more than four feet above him. Similarly, they are not applicable to workmen actually engaged in erecting the structure or in rendering any excavation or earthwork safe, or to a person engaged in examining any such structure. 13.2 Fencing of Excavations, etc. Barriers or covers shall be provided to excava- R. 40 tions, pits and openings in which persons can fall a vertical distance of more than six feet six inches, except when excavation or earthwork is actually in progress. 14. Miscellaneous Provisions 14.1 Keeping of Records Certificates and reports received by a contractor R. 62 in respect of any test or examination on any equipment, excavation or earth-work shall be kept at the relevant construction site. If the construction work at the site will be completed within six weeks from its commencement or if the construction work at the site has been completed or the equipment has ceased to be located at a construction site, these certificates and reports shall be kept at his main office. Unless the Commissioner has previously directed to the contrary, these certificates and reports shall be made readily available for inspection but may be destroyed after the lapse of six years since their receipt by the contractor. If requested by an inspector within a period of time (minimum seven days), the contractor shall deliver to him a copy of or an extract from any certificate or report. 14.2 Offences and Penalties relating to Contractors A contractor, if convicted of an offence under R. 63 Regulations 5 to 24, Regulations 26 to 54 and 21

Regulations 56 to 62, shall be liable to a fine of $10,000. R. 64 R. 65(1) R. 65(2) R. 66 14.3 Offences by Persons employed Any contractor or workman engaged in construction work who wilfully and without reasonable cause does anything likely to endanger himself or others shall be guilty of an offence and shall be liable on conviction to a fine of $2,000. 14.4 Offences by Competent Examiners, etc. Any competent examiner or competent person shall be guilty of an offence and shall be liable on conviction to a fine of $1,000 if he, having carried out any test or examination required by these regulations (a) (Z>) fails or refuses to deliver to a contractor a report in respect of any test or examination; or fails to comply with regulation 25 or 35(5). (See Footnote of Table on Pages 23-24). Any such competent examiner or competent person who delivers to a contractor any certificate or report, the material particular of which is knowingly false, shall be guilty of an offence and shall be liable on conviction to a fine of $10,000. 14.5 Offences by Other Persons Any person who, using a hoist, fails to ensure that the gate is closed immediately after use unless it is for the time being necessary to keep the gate open at a landing place for loading or unloading or for passengers to enter or leave the cage, shall be guilty of an offence, and liable on conviction to a fine of $500. 22
