CITY MANA6ER S REPORT JUNE 17 2013 CITY COUNCIL MEETING ITEM 49 ITEM ALLIED WASTE SERVICES COLLECTION RATES ADJUSTMENT FOR FY 2013 2014 RECOMMENDATION Adopt Resolution to Authorize an Increase of Allied Waste Collection Rates Based on the Consumer Price Index for All Urban Consumers for the San Francisco Oakland San Jose Area for Fiscal Year 2013 2014 SUMMARY Lathrop Municipal Code Section 816 170 and Section 26 of the original agreement between the City of Lathrop and Allied Waste of San Joaquin County Allied Waste dba Republic Services Company provide that residential and commercial collection rates shall be reviewed annually and adjusted effective July 1 Determination of any appropriate adjustments to the maximum permitted rate will be based on the Consumer Price Index for All Urban Consumers CPI U for San Francisco Oakland San ose California area On lune 5 2013 staff received a request from Allied Waste to adjust their commercial and residential rates by 23 effective August 1 2013 The proposed rate increase is based on the annual CPI U percentage change over the last year ending April 1 2013 BACKGROUND At the une 2 2009 City Council Meeting Council approved Amendment No 1 to the original Agreement dated as of October 21 2003 between the City of Lathrop and Allied Waste to provide the necessary services for the orderly and proper collection transportation and disposition of solid waste generated within the City limit and for compliance with the source reduction and recycling elements of the City s waste management plan Lathrop Municipal Code Section816 170 and Section 26 of the original Agreement provide that residential and commercial collection rates shall be reviewed annually and adjusted effective July 1 Determination of any appropriate adjustments to the maximum permitted rate will be based on the Consumer Price Index for All Urban Consumers CPI U for San Francisco Oakland San Jose California area not to exceed 40

RESOLUTION NO 13 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LATHROP AUTHORIZIIVG INCREASING THE ALLIED WASTE COLLECTION RATES BASED ON THE CONSUMER PRICE INDEX FOR THE SAN FRANCISCO OAKLAND SAN JOSE AREA FOR FISCAL YEAR 2013 2014 WHEREAS on une 2 2009 City Council Meeting Council approved Amendment No 1 to the original Agreement dated as of October 21 2003 between the City of Lathrop and Allied Waste to provide residential and commercial solid waste removal and WHEREAS Lathrop Municipal Code Section816 170 and Section 26 of the original Agreement provide that residentia and commercial collection rates shall be reviewed annually and adjusted effective July 1 and determination of any appropriate adjustments to the maximum permitted rate will be based on the Consumer Price Index for All Urban Consumers CPI U for San Francisco Oakland San Jose California area not to exceed 4 and WHEREAS the last rate increase approved by City Council was for fiscal year 2012 2013 effective August 1 2012 commercial and residential rates were increased by 21 and WHEREAS on June 5 2013 staff received a request from Allied Waste to adjust their commercial and residential rates effective August 1 based on the CPI U ending April 1 2013 and WHEREAS the change in the CPI U for the period of April 1 2012 through April 1 2013 was23 and WHEREAS Lathrop Municipal Code Section816 270 provides that the City Council shall set only maximum permissible rates and WHEREAS approval of these rates will insure continued compliance with the California lntegrated Waste Management Act of 1989 AB 939 and WHEREAS pursuant to Section 27 of the original agreement between the City of Lathrop and Allied Waste and LMC Ordinance 816 180 Allied Waste shall remit to the City of Lathrop a Franchise Fee of seven 7 percent and a A6939 Recycling Fee of three 3 percent of the gross revenue collected within ten 10 days following the completion of each calendar month NOW THEREFORE BE IT RESOLVED that to the extent that the solid waste hauler gives notice pursuant to paragraph 26 of the Agreement and pursuant to Lathrop Municipal Code Section 816 170 C the City s franchised solid waste hauler shall not be permitted to charge fees any higher than specified for each customer type listed
