Periodic Operations and Maintenance Walkthrough Inspections - beginning no later than October 13, 2018 (40 CFR 280.36) Inspections conducted according to: Described in the 2015 UST regulation Spill bucket every 30 Days, sumps annually, Or A code of practice developed by nationally recognized association or independent testing laboratory PEI s RP 900, Or Requirements determined by the implementing agency comparable to 1 or 2 above. 2
Testing Requirements Spill Buckets, Overfill Prevention, and Containment Sumps (40 CFR 280.35) Beginning no later than October 13, 2018: Test all spill buckets at least once every three years to ensure liquid tight using vacuum, pressure or liquid. Inspect/test overfill prevention equipment once every three years to ensure proper operation. Test all containment sumps that are used for interstitial monitoring of piping at least once every three years to ensure liquid tight using vacuum, pressure or liquid. 3

Code of practice developed by nationally recognized association or independent testing laboratory PEI RP 1200. Requirements determined by the implementing agency to be no less protective of human health and the environment. e.g. alternative low-level containment sump testing. 4

Status of State Regulations & Program Approval 1 state Oklahoma has an approved UST program under the 2015 federal UST regulation. 5 states Utah, West Virginia, Colorado, Georgia, and Idaho have pending applications with EPA for state program approval under the 2015 federal UST regulation. 32 states and territories have updated their regulations to incorporate the revised 2015 federal UST regulation. EPA has reviewed draft regulations for 44 states during the regulatory update process. 6

SPA states which have updated their regulations to incorporate the revised 2015 federal UST regulation and chose extended compliance date (1-3 years beyond October 2018). SPA states which have not yet updated their regulations to incorporate the revised 2015 federal UST regulation.
