PARKING AND VEHICULAR RULES General Rules 1. All residents and guests must abide by all psted traffic signs, CC&Rs, Rules & Regulatins, Califrnia Vehicle Cdes, and San Clemente Municipal Cdes. All vilatins f any belw mentined Rule r Regulatin are subject t the Assciatin s Vilatin Plicy and Vilatin Fine Schedule. Vilatins n the Assciatin premises may als result in the twing f a resident s r guest s vehicle. 2. Mving Traffic Vilatins (Speeding, Failure t Stp, Failure t Yield, Imprper Lane Usage, etc ) are subject t citatin by the Assciatin, and the Owner may be called t a Hearing and subject t fines per the Assciatin s Vilatin Plicy and Vilatin Fine Schedule. 3. N vehicle may be parked n the street, r utside the cnfines f a resident s garage, vernight during the hurs f 1:00AM-6:00AM, unless they are displaying a Parking Permit and accmpanying Resident Vehicle ID Sticker, r have btained a Safelist number frm ur security patrl cmpany. 4. N vehicles may be stred n the street withut being mved fr a perid f 96 hurs r greater, regardless f whether r nt the vehicle has a Parking Permit r has been Safelisted. This vilatin is against Califrnia Vehicle Cde and may be enfrced by the Plice and/r Sheriff. 5. All vehicles parked n the street must be parked in the directin f traffic, adjacent t the curb, n mre than 18 frm the curb, per Califrnia Vehicle Cde. 6. All vehicles parked in Off-Street parking spaces must be parked head-in, per Califrnia Vehicle Cde. Any parked vehicles that encrach n the sidewalks are subject t citatin, fine, and/r twing. 7. Handicapped r Disabled Veteran fficial vehicle identificatins allw a vehicle t park n the street regardless f btaining a Parking Permit r Safelist number. 8. Street parking is prhibited n Street Sweeping Days, at the times indicated n the psted signs at the entrances t the cmmunity. 9. Sme parking spaces at the pls have been marked Pl Parking Only. During the pl hurs f 8:00AM 10:00PM, residents are asked t please leave these spaces pen fr pl users wh may have had a need t drive t the pl. 10. Please be mindful f street parking lcatin selectin n Trash Cllectin days s as nt t interfere with the placement f trash cans near the curb, r with the cllectin prcess itself. 11. N maintenance r restratin f any vehicle may be cnducted in the cmmunity except in an enclsed garage when the garage dr is clsed, prvided such activity in nt undertaken as a business, and prvided that such activity may be prhibited entirely by the Assciatin if the Bard determines that it cnstitutes a nuisance. Resident Vehicle ID Stickers 1. All residents are highly encuraged, thugh nt required, t btain a Resident Vehicle ID Sticker fr each f their vehicles. These will be FREE f charge. 2. The purpse f this sticker is t identify which vehicles belng t which residents in ur cmmunity. If a vehicle is fund t be in vilatin f a parking rule, and the vehicle has a Resident Vehicle ID Sticker, then the vehicle will NOT be twed unless it is vilating a safety-related Immediate Tw Vilatin (see belw), but will be fined instead; hwever, such vehicle may be twed upn the failure t pay fines as indicated in Sectin 1 under the article entitled Vehicle Vilatins (belw). If the same vehicle des nt have a Resident Vehicle ID Sticker, it MAY be twed, as the Assciatin has n way f identifying t which residence the vehicle belngs. each f their vehicles s that if they are fund in vilatin, the Assciatin can identify and fine them, instead f tw them. 3. This sticker will be permanently affixed t the resident s vehicle s frnt windshield where it can be easily identified by ur security patrl cmpany. 4. In rder fr a resident t btain a Resident Vehicle ID Sticker, they must fill ut a Resident Vehicle ID Sticker Applicatin Frm. This frm can be btained nline at www.talegavillageha.cm, r frm ur security patrl cmpany. The resident must als submit a current vehicle registratin fr each vehicle, fr which they are requesting a sticker. Renters must submit a current Lease Agreement (please black ut any scial security numbers r ther private infrmatin). The registratin must shw that the vehicle is either registered t the resident s Talega Village Center address, r that the wner f the vehicle is the Owner f the residence (n prperty title and n file with management), a legal dependent f the Owner, a Lessee named n the Lease Agreement fr the prperty, r a named persn n a utility bill fr the residence. 5. Exceptins can be made fr Cmpany vehicles (submit an authrizatin letter n cmpany letterhead), r vehicles belnging t Cntract Care (e.g., caregiver, nurse, nanny, etc.) with additinal supprting dcumentatin. 6. Our security patrl cmpany (infrmatin belw) will handle cllectin f all dcumentatin submissins, prcessing f requests, and distributin f stickers/permits. 7. Transfer f title f a residence immediately vids all Resident Vehicle ID Stickers (and Parking Permits) assciated with that residence. Parking Permits - General 1. Parking Permits will be hanging, r therwise remvable, permits which are cmpletely separate and distinct frm the Resident Vehicle ID Stickers mentined abve. These permits allw a resident t park n the street vernight during the hurs f 1:00AM 6:00AM. 2. The Parking Permit can be mved between a resident s vehicles freely; hwever, the Parking Permit can nly be used n a vehicle which has a Resident Vehicle ID Sticker affixed t it. Althugh residents are nt required t btain Resident Vehicle ID Stickers, they must btain them fr any vehicles n which they intend t use their Parking Permit. As such, guests will nt be able t use Parking Permits n their vehicles. Any vehicle fund displaying a Parking Permit withut a Resident Vehicle ID Sticker affixed t their vehicle is subject t twing and/r fines levied against the permit wner. 3. Parking Permits must be displayed hanging frm the rear view mirrr, r set n the dashbard in plain view, and be easily identifiable by the security patrl cmpany. 4. Lst Permits will be subject t a replacement fee f $50. The fee may be waived at the discretin f the Bard with submissin f a plice reprt related t the theft f the permit (please redact any private inf befre submitting). Any vehicle subsequently fund displaying a permit with the lst/cancelled permit serial number will be subject t immediate twing. Parking Permits Obtaining a Permit 1. Pursuant t Article II, Sectin 2.5.3 f the CC&Rs, all residents are required t use their garage t its maximum capacity fr parking f residents vehicles. Residents shall nt stre persnal items r install and/r maintain imprvements in the garage s as t prevent the use f the garage t its maximum capacity fr parking. Residents may, hwever, apply fr a Parking Permit fr Authrized Vehicles which cannt be parked in the garage, either due t the size f the vehicle, the size f the garage, r therwise, r that there are mre vehicles than can be accmmdated in the garage. Alassi Plan 1 tandem garages will be treated as ne-car garages fr the purpses f these Rules, based n such being sld as the same. ADOPTED 6/2/10 Page 9 f 13

2. The measurements set frth belw are deemed t accmmdate reasnable entry and exit frm the vehicle while parked in the garage. 3. All vehicle measurements will be btained nline at Edmunds.cm, r frm an fficial manufacturer s website r surce dcument (i.e. Hnda.cm, r Vehicle Operatr s Handbk, etc.). The dimensins f the resident s tw smallest cars will be used fr determining Parking Permit eligibility. 4. Specialty cars, r thse mdified in width, length, r height beynd that f the manufacturer s specificatins, r vehicles whse height exceeds the height f the garage dr pening, shall submit actual dimensins n their applicatin frm with a picture(s) f their vehicle. 5. Residents may determine, prir t applicatin, if their vehicle(s) will qualify fr a permit(s) by applying the fllwing criteria: Nn-Tandem Garages Car # 1 2 Ttal Width Width (in.) Length (in.) T apply fr a permit, residents must fill ut a Parking Permit applicatin frm. This frm can be fund nline at www.talegavillageha.cm, r btained frm ur security patrl cmpany. If the resident has nt already btained Resident Vehicle ID Stickers fr each and all f their vehicles, they must nw d s by fllwing the steps fr btaining the stickers utlined abve. Once all required dcumentatin fr the Parking Permit (applicatin) and all Resident Vehicle ID Stickers (registratins, lease/utility bill if needed) have been submitted t ur security patrl cmpany, they will research the applicant s vehicle dimensins and determine eligibility fr a permit. *Nte: Please be as specific as pssible when specifying yur vehicle s Make & Mdel, etc. Nt being detailed enugh will cause delays while ur security patrl cmpany fllws up t btain additinal infrmatin frm yu (i.e., EX mdel vs. LX mdel, 4 cylinder vs. 6 cylinder). 7. Every time a resident requests a new Resident Vehicle ID Sticker, r a Parking Permit needs t be renewed, all criteria fr eligibility fr a permit will be reviewed t determine if the resident is still eligible. If they are n lnger eligible based n their new vehicle cmbinatin, the Parking Permit will be cancelled. 8. Garage inspectins will never be required fr determining eligibility fr a Parking Permit, but can be requested by a resident in rder t appeal a denial based n special circumstances. If cnducted, a garage inspectin will be free f charge t the resident. 9. Residents requesting a Parking Permit fr safety-related reasns r fr any ther special circumstances, wh wuld nt nrmally qualify fr a permit under the abve listed criteria, shuld appeal t the Bard stating their justificatin. Reasnable accmmdatins t these Rules will be made fr persns having a disability in accrdance with the law. 10. The cst f Parking Permits will be graduated as fllws: 1 st Permit - $25; 2 nd Permit - $50; 3 rd Permit - $100. Each additinal permit beynd the 3 rd will increase $50 ($150, $200,...). A maximum f five (5) permits will be allwed per residence; any mre than five will require specific Bard apprval with justificatin. 11. Permits are valid fr ne year frm the date f issuance and must be renewed annually with the submissin f a new applicatin, previusly required updated supprting dcumentatin identified in this dcument, and payment f the current year s fees. Safelisting 1. All vehicles which d nt have a Parking Permit and wish t park n the street between the hurs f 1:00AM- 6:00AM must be Safelisted. 2. Each vehicle is allwed 30 nights f being Safelisted during a cnsecutive 90 day perid. This 90-day perid is cmprised f the last 90-days frm the night fr which the Safelisting is being requested. 3. Residents shuld cntact ur security patrl cmpany t btain a Safelist number fr each vehicle requiring ne. Safelist requests can be dne nline r ver the phne by cntacting ur security patrl cmpany. 4. Any nn-resident vehicle that wishes t exceed the 30 nights in 90 days f Safelisting detailed abve may d s by purchasing additinal Safelist nights in 30-night increments fr a fee f $25. Requests t purchase additinal Safelist nights will be crdinated thrugh ur security patrl cmpany. 5. After requesting a Safelist number nline r ver the phne, each resident shuld take nte f the Safelist cnfirmatin number. It is recmmended, thugh nt required, t place this number behind the frnt windshield f the Safelisted vehicle, s that the security patrl cmpany can clearly identify Safelisted vehicles during their night patrls. Authrized and Prhibited Vehicles 1. The CC&Rs define Authrized Vehicles as standard passenger vehicles including autmbiles, passenger vans designed t accmmdate ten (10) r fewer peple, mtrcycles, and pickup trucks having a manufacturer s rating r paylad capacity f ne (1) tn r less. These vehicles are specifically authrized t park n the street, withstanding all ther Rules and Regulatins listed here. 2. The CC&Rs discuss the fllwing instances f Prhibited Vehicles: Recreatinal vehicles (e.g., mtrhmes, travel trailers, camper vans, and bats) Cmmercial-type vehicles (e.g., stakebed trucks, tank trucks, dump trucks, step vans, cncrete trucks, and limusines) Buses r vans designed t accmmdate mre than ten (10) peple Vehicles having mre than tw (2) axles Trailers Inperable vehicles r parts f vehicles Aircraft Any vehicle r vehicular equipment deemed a nuisance by the Assciatin Any ther vehicle nt classified as an Authrized Vehicle 3. Prhibited vehicles may nt be parked, stred, r kept n any public r private street in, adjacent t, r visible frm the residences r any ther cmmn prperty parking area except fr brief perids f lading, unlading, making deliveries, r emergency repairs. 4. Prhibited vehicles may nly be parked in a resident s fully enclsed garage with the dr clsed, s lng as the presence at the residence des nt therwise vilate the prvisins f the CC&Rs r these Rules and Regulatins. 5. If a vehicle qualifies as bth an Authrized Vehicle and a Prhibited Vehicle, then the vehicle is presumed t be a Prhibited Vehicle, unless the vehicle is expressly authrized in writing by the Assciatin. 6. Prhibited vehicles shall nt be issued Resident Vehicle ID Stickers, r cnsidered in calculating dimensins when determining eligibility fr a Parking Permit. ADOPTED 6/2/10 Page 12 f 13

Vehicle Vilatins 1. If a vehicle is discvered with n valid Parking Permit r Safelist number, but has a Resident Vehicle ID Sticker, then the fllwing will ccur: 1 st Offense Warning Citatin 2 nd Offense Warning Citatin 3 rd Offense Fine (First Vilatin Rate, see Fine Schedule) 4 th Offense Fine (Secnd Vilatin Rate, see Fine Schedule) 5 th + Offenses Cntinuing Fines at Secnd Vilatin Rate, unless previus fines fr the same ffense have gne unpaid fr a perid f mre than 30 days. If a resident is 30 days r mre delinquent in paying their assessed fines, then the Bard may apprve twing f the vehicle as a methd f enfrcement. The vehicle will then be twed n this ffense and all subsequent ffenses, until all utstanding fines related t this ffense have been paid. 2. If a vehicle is discvered with n Safelist number, and des nt have a Resident Vehicle ID Sticker, then the fllwing will ccur: 1 st Offense Warning Citatin 2 nd Offense Warning Citatin 3 rd Offense Vehicle Twed 3. The fllwing vilatins are cnsidered Immediate Tw Vilatins, as they are either illegal r safetyrelated. Vehicles in vilatin f the fllwing are subject t immediate twing n the first ffense: Parking in Fire Lanes. Fire Lanes are marked by signs, red curbs, r bth. All mtr curts and driveways in the cmmunity are Fire Lanes. There is n grace perid fr parking in the mtr curts r driveways fr vehicle lading r unlading, r any ther purpse. Any stpping r parking in these areas, n matter hw brief, is dne at the resident s wn risk. Parking in a designated handicapped space withut prper handicapped identificatin. Parking in a manner which interferes with entrance t, r exit frm, Talega Village Center. Parking in a manner which interferes with the use f any sidewalk within Talega Village Center. Parking in a manner which interferes with the use f any street r mtrcurt within Talega Village Center. 4. Prhibited Vehicles (defined abve) which are parked n the street, r therwise in vilatin f these Rules and Regulatins, will receive tw warning citatins and then be twed n the third ccurrence at the vehicle wner s expense. 5.
