This action authorizes a total modified contract amount of $45,540,795 plus applicable taxes contingent upon approval of the 2019 Budget. KEY FEATURES SUMMARY This action authorizes the purchase of thirteen 42-foot double deck clean diesel high-capacity buses for Sound Transit routes operated by Community Transit. This procurement will enable the expansion of the bus fleet to meet service requirements. The newly purchased buses will be delivered to Community Transit, Sound Transit s only bus partner with the capability to operate and maintain double deck buses. Compared to other high capacity buses, 42-foot double deck buses provide maximum passenger capacity. Production of the buses is scheduled to begin in February 2020 with delivery expected in July 2020. This procurement will use 13 of the 43 Sound Transit options on an existing Sound Transit contract. Applicable taxes for the options are currently estimated to be $1,249,788. BACKGROUND Double deck buses have proven to be a cost effective means of adding capacity on Sound Transit s Snohomish County ST Express bus service. This will be Sound Transit s third procurement of double deck buses. The first procurement of five double deck buses in 2014 was made using options from a Community Transit contract, and the second procurement of 32 double deck buses in 2016 was the result of a Request for Proposals issued by Sound Transit. This procurement will use options from that 2016 contract. The cost of the bus ($898,481) includes passenger amenities, such as passenger reading lights, seat upgrades, on-board mobile communication systems, and security cameras. Contingency is included in the request for unexpected cost items.

PROCUREMENT INFORMATION A Request for Proposals was issued on January 27, 2016 for 32 buses and options for 43 additional buses. A single proposal was received from Alexander Dennis. Sound Transit performed a cost analysis and determined that the pricing was fair and reasonable. A contract was awarded to Alexander Dennis on August 29, 2016. This action will exercise 13 of the 43 option buses. FISCAL IMPACT The authorized project allocation to date for the ST Express fleet expansion project is $39,756,769. Within that amount, $39,756,769 has been allocated to the vehicle phase. The proposed action would commit $13,054,059, leaving a budget shortfall of $6,456,171. While this action executes the contract, no funds will be spent until the delivery of the buses until 2020. The Proposed 2019 Budget revisions reflects a change in the authorized project allocation to date of $7,000,000 resulting in an uncommitted budget balance of $543,829 in the vehicle phase. Upon approval of the Proposed 2019 Budget, this action is within the authorized project allocation and sufficient monies remain after the approval of this action to fund the remaining work in the vehicle phase as contained in the current cost estimates. SMALL BUSINESS PARTICIPATION As a transit bus manufacturer, Alexander Dennis, LLC must submit its own Disadvantaged Business Enterprise (DBE) program and goal to the Federal Transit Administration, and according to FTA s transit bus procurement rules, transit bus manufacturers must certify to transit agencies that they have a DBE program in place. Alexander Dennis, LLC has certified that they have a DBE program and complied with FTA rules for participation in this procurement. PUBLIC INVOLVEMENT Not applicable to this action. TIME CONSTRAINTS A one-month delay would create a significant impact as this procurement has a very tight deadline to meet delivery deadlines for the service change in September 2020. PRIOR BOARD COMMITTEE ACTIONS Motion No. M2016-66: Authorized the chief executive officer to execute a contract with Alexander Dennis Incorporated to manufacture and deliver thirty-two 42-foot double deck diesel buses in the amount of $31,691,928, with a 5% contingency of $1,584,596, for a total authorized contract amount not to exceed $33,276,524.
